RE: APPROVAL OF RECORDED EXEMPTION #2285 - RORY AND CATHERINE GOSCHA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), C.R.S., as amended, did determine at a public meeting held in the Chambers
of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #2285, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #2285 was submitted by Rory and
Catherine Goscha, 890 East Highway 56, Berthoud, Colorado 80513, for property which is
located in part of the N% NE% of Section 19, Township 4 North, Range 68 West of the 6th P.M.,
Weld County, Colorado, being more particularly described in the plat which shall be provided by
the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into two parcels estimated to be
approximately 4.77 acres each.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2285 submitted
by Rory and Catherine Goscha be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The applicant shall submit a sketch of the existing septic system in
relation to the proposed lot line to the Weld County Health Department.
The applicant shall submit evidence of Health Department approval to the
Department of Planning Services.
B. The plat shall delineate a 20-foot access easement from State Highway
56 across Lot A for the benefit of Lot B. The access easement
certification shall be shown on the plat in accordance with Section
11.7.1.12.5 of the Weld County Subdivision Ordinance.
C. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Public Works Department to determine if a
culvert is necessary at any approved access point.

D. A total of 75 feet from the centerline of State Highway 56 right-of-way
reservation for future expansion of State Highway 56 shall be delineated
on the plat.
E. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum
setback and offset requirements for the Zone District in which the
property is located.
2) Any future structures or uses on site must obtain the appropriate
zoning and building permits.
3) Prior to the release of building permits on Lot B, the applicant shall
submit evidence to the Department of Planning Services that the
lot has an adequate water supply of sufficient quality, quantity and
dependability.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Department of Planning Services. The applicant
shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 26th day of August, A.D., 1998.

Subject: Subdivision Exemption-2285
Dear Commissioners:
Mr. and Mrs. Rory and Catherine Goscha has requested a Recorded Exemption to occur on part of
the N2 NE4 Section 19 T4N R68W of the 6th PM. The 9.54 acre parcel is located approximately
1/8 mile from Berthoud; South of and adjacent to Hwy 56 and approximately 350' West of WCR 3.
The parcel of land under consideration is the total contiguous land holdings of the applicant.
Based upon submitted information,referral agencies, and the governing mechanism of the County,
the Department of Planning Services' staff has determined that the applicant has not provided
sufficient justification and recommends this request be denied.
The applicant is requesting to divide this section into two parcels. The staff believes the applicant
has evaded the intent of the recorded exemption process by creating multiple lots without utilizing
the appropriate subdivision process. This quarter section has eight existing lots, created prior to
zoning, which makes it an urban scale development as defined by Section 2.21 of the Weld County
Subdivision Ordinance. The potential for eight additional land splits exists in this quarter section,
the result of these splits will be a quarter section which will be inundated with piecemeal
development.
Staff has the following concerns:
1. The applicant has not demonstrated that this application is consistent with efficient and
orderly development in accordance with Section 1.3 of the Subdivision Ordinance. This
quarter section is already considered an urban scale development as defined by Section 2.21
of the Weld County Subdivision Ordinance which states " Developments exceeding 5 lots
and/or located in close proximity to existing PUD's, subdivisions, municipal boundaries, or
urban growth corridors and boundaries..." Although this is the first request for an Recorded
Exemption in the Northeast quarter of Section 19,the potential exists for eight(8) additional
splits, creating sixteen (16) lots.
2 Section 10.5.10 of the Weld County Subdivision Ordinance states, "A flag lot configuration
shall be avoided when possible." This application proposes a flag lot configuration..

3. The applicant has failed to comply with the A(Agricultural) zone district intent. This parcel
is located outside of an Urban Growth Boundary Area. Continued division of this parcel
emphatically opposes the intent of the A (Agricultural) zone district. The potential to
interfere and encroach upon the agricultural activities of this area is evident. The A
(Agricultural) zone district was established to promote and maintain agriculture as a vital
support element for Weld County Citizens,and not to be continually decreased for residential
development. The Agricultural zone policies discourage the conversion of agricultural land
for residential uses within an area located outside of an urban growth boundary. The intent
is to eliminate incompatibilities that exist and minimize costs to Weld County tax-payers.
4. Weld County Comprehensive Plan R. Policy 3 states, "Weld county should encourage a
compact form of urban development by directing residential growth to urban growth
boundary areas and to those areas where urban services are already available before
committing alternate areas to residential use." This application is proposing use of
septic systems.
5. The conflict between rural and urban activities is evident in this request. When an urban
growth pattern is established without regard to long range comprehensive planning the
outcome lacks the essential elements of long term desirability. Higher costs are incurred by
providing many public services to urban sprawl areas. As urban areas develop and expand
they inadvertently influence surrounding areas. These areas are either converted to urban
uses themselves or are in direct conflict and competition with agricultural areas.
Specifically,the Department of Planning Services' staff recommendation of denial for this request
is based upon the application's inconsistency with Sections 1.3 and 10.5.10 of the Weld County
Subdivision Ordinance, which ensures orderly and efficient subdivision development within the
county,and conflict with A. Goals 6,7,and 9 of the Comprehensive Plan,which define appropriate
development goals and policies within the Agricultural zone district.
Scattered residential development in rural areas necessitates an increased demand for roads and
bridges, police and fire protection, education facilities, utilities and other services. The cost of
providing services and the conflicts between rural and urban land uses can be reduced if
development is encouraged within urban growth boundary areas or are adjacent to existing
municipalities.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider the application and determine if the standards of Sections 11.2 through 11.8 of the Weld
County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld
County Comprehensive Plan.

In the matter of the above referenced property,the following information applies:
1. The following domestic and irrigation water supplies are available for each proposed lot:
a. Domestic water supplied to each lot by the Little Thompson Water District. See the
attached letter of supply.
b. Each lot will have one share of Loveland Lake and Ditch Company irrigation water
and one half share of McIntyre Lateral Ditch for delivery.
2. Waste water disposal for each lot shall be by individual septic system. The improvements
on Lot A are currently served by an adequate septic system (see attached letter from Weld
County Environmental Services). Lot B will be served by a new septic system to be installed
at time of improvement. The Town of Berthoud will also be serving this area with a new
waste water line some time in the near future.
3. The subject property is currently a rectangular 9.54 acre residential horse property. The
current improvements consist of a home,detached garage,small barn and sheds on
approximately 2 acres. The remaining 7.54 acres is flood irrigated grass pasture.
4. The purpose of this requested exemption is to allow the current owners to split the property
into two equal 4.77 acre lots and develop Lot B as a residential home site.
5. The new Lot B is the southern 4.77 acres of the existing property and is currently fenced
grass pasture.
6. The current 9.54 acre does not have any unique features other than mountain views.
7. All existing structures on the subject property meet or will meet applicable setback and
offset requirements.
8. Due to the limited size of the proposed Lots A and B,no conservation easements are
provided. However,both lots should remain as residential horse properties with several
acres of open space.
9. No building envelopes have been designated for Lot B at this time.
10. This proposal is consistent with the annexation and urban growth and service plans for the
Town of Berthoud and Weld County.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
The main access to Lots A and B will be from State Highway 56 so the Colorado Department of Transportation
would have jurisdiction. Please contact Gloria Idler or Tess Jones at the Greeley office to verify any additional
access permits or improvements needed for this access.
REQUIREMENTS:
Prior to final approval, proof of access from State Highway 56 must be shown.
The applicant is indicating a 20-foot access and irrigation easement to Lots A and B. Adequate documentation
should be supplied on the plat or on the deed to guarantee access to both parcels. This should be a graded and
drained all-weather access to both parcels.

Dear Mr. & Mrs Goscha:
On May 20, 1998, an evaluation of the existing individual septic disposal system at 890 East
Highway 56, Berthoud, Colorado; Section 19, Township 04 North, Range 68 West, was conducted
by Stephen J. Wiatrowski.
The existing individual sewage disposal system is of sufficient size and capacity to adequately
handle the proposed load. This evaluation is based on a final treatment capacity for
a 2 bedroom residence.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume
any liability to the owner of the above property, to any purchaser of the above property or to any
lending agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations
and for detecting health hazards observable at the time of inspection. This does not constitute a
warranty that the system is without flaw or that it will continue to function in the future. Inspections
requested during periods of snow cover and high soil saturation may be of questionable value to
• potential buyers due to adverse conditions. Evaluations based on Statements of Existing (S.O.E.)
relies on information the property owner provides, under oath, indicating current status of the
system and representing to the best of his/her knowledge the system is not failing to function
properly.

Dear Mr. Cowdin ;
This letter is in response to your request that the Little
Thompson Water District provide a water commitment for one new tap
at the location, described as follows:
NE 1/4, Sec. 19, T4N, R68W -- Weld County CO
The request is for 1 additional residential water tap. We will
commit to provide service to this lot with the following
conditions:
1. The District has implemented a "system impact" fee for
all lots added to our system. The fee is $1, 050. 00 per
lot and is due and payable upon application for the tap.
2 . All improvements to District facilities required to
provide service will be the financial responsibility of
the developer in accordance with District Rules and
Regulations. All improvements must conform to District
Specifications.
3 . We currently have a 10" Dia. line along the South side of
Hwy 56 with additional capacity available.
4 . If a fire hydrant is needed at the site you would be
required to pay a $ 2 , 000. 00 hydrant fee in addition to
installing the hydrant.
This commitment will expire one year from the date of this
letter if the tap has not been purchased and installed by that
date. The current fee for the domestic 5/8" X 3/4" tap is $5, 700. 00
These fees area subject to change without notice.
