A regular meeting of the Weld County Planning Commission was held January 16,1996, in the County
Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by Chairman, Richard Kimmel.

The summary of the last meeting of the Weld county Planning Commission January 4, 1996, was
approved.
1. CASE NUMBER: USR-1104
PLANNER: Shani L. Eastin
APPLICANT: Guy Grigsby and Amy Fieling
REQUEST: Use by Special Review and Site Specific Development Plan for a single family
dwelling unit on a lot less than the minimum lot size in the A(Agricultural)
zone district.
LEGAL DESCRIPTION: Located in the NW4 of Section 33, T2N, R68W of the 6th P.M.,
Weld County, Colorado.
LOCATION: East of and adjacent to Weld County Road 5 and approximately
1/2 mile; north of State Highway 52.
Shani Eastin, Current Planner, explained that the applicant is requesting a Special Review Permit for a
single family dwelling on 32.7 acres. The property being created from an estate by the courts, in
September 13, 1994, and divided into four lots it does not meet the legal minimum lot size in Weld County
of 80 acres.
Numerous referrals were sent and incorporated into the recommendations of this application. Shani Eastin
explained she did not receive a written response from Tri-Area Planning, but Tri-Area Planning gave verbal
approval. Shani Eastin confirmed this site is not located within an overlay district. The Department of
Planning Services' staff requested approval of this Special Review permit with the Conditions of Approval
and Development Standards.
The Chairman asked if there was anyone in the audience who wished to speak for or against this

Guy Grigsby, applicant, explained that he and his wife, Amy Fieling, grow herbs and the ground is certified
organic by the State Department of Agricultural and has been for six years. Mr. Grigsby express they
would like to live on the same property. The applicant was in agreement with the Staff recommendations
and
Development Standards.

Ann Garrison moved Case Number USR-1104 be forwarded to the Board of County Commissioners with
the Planning Commission's recommendation for approval. Zachary Allely seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision.

2. CASE NUMBER: USR-1105
PLANNER: Chris Goranson
APPLICANT: Great Guns!
REQUEST: Use by Special Review and Site Specific Development Plan for a shooting range
(shotgun sports gun club and pro shop) in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Part of the NW4 of Section 11, T8N, R66W of the 6th P.M.
Weld County, Colorado.
LOCATION: South of and adjacent to Weld County Road 96; approximately 550 feet east of
Weld County Road 33.
Chris Goranson, Current Planner explained the Special Review Permit area is 125 acres with 800 acres
owned by the applicant. Referral agencies had been contacted and responses were received from all of
them except the Sheriffs Department and Ault Fire Protection District. Chris Goranson explained that the
applicant is now requesting that a tower be included on the property that was not previously mentioned in
the application. The Department Planning Services' staff did not have concerns, but felt since the
applicant's letter of request for the town came after referrals had been sent out, the Weld County Health
Department should have time to review the change prior to the Board of County Commissioners Hearing.
Staff requests a change (6D) to the Conditions of Approval to include the tower be added.
The Department of Planning Services Staff is recommending approval of this application with the
Conditions of Approval and the Development Standards.
Zachary Allely, Planning commission member had concerns what the tower was for Chris explained this
would be a clay target thrower on an above ground tower.
Ann Garrison expressed if there had been any concerns from surrounding property owners. Chris stated
that he had received a call from a relative of a surrounding property that had expressed interest in the
application, but had not received any other concerns from surrounding property owners.
The Chairman asked if there was anyone in the audience who wished to speak for or against this
application.
The applicant, Patty Deplazes, did have concerns about Conditions of Approval#2, #3, and#5 and
Development Standards#7 and#17. After discussion from Planning Commission members, Jeff Stoll,
Director, Environmental Protection Services, Lee Morrison, Assistant Weld County Attorney, Monica
Daniels-Mika, Director, and Chris Goranson, Current Planner, Department Planning Services verbiage
was changed for Conditions of Approval#2 and#3 and Development Standards#7 and#17. Tim Ruff,
President of the Colorado Trap Association, expressed support for the applicant.
Lee Morrison, Weld County Assistant Attorney, addressed concerns with Development Standard#17
about the five year provision. Concerns were addressed from planning commission members and
applicant.
Ann Garrison moved that Case Number USR-1105 Great Guns!, be forwarded to the Board of County
Commissioners with Planning Commission changes to the Conditions of Approval#2, and#3 and
Development Standards#7 and#17.

The changes should read as stated:
Condition of Approval#2, The perimeter of the range along Weld County road 96 shall be landscaped to
provide natural noise barriers. The remainder of the range shall be planted and maintained with grass or
suitable cops. the landscaping shall be maintained by the applicant and dead or dying materials shall be
replaced immediately upon notice.
Conditions of Approval#3, All users for the target shooting area shall be supervised by a range officer or
instructor qualified by the National Rifle Association, military service or other similar training.
Development Standards#8, All users for the target shooting area shall be supervised by a range officer or
instructor qualified by the National Rifle Association, military service or other similar training.
Development Standards#7, The perimeter of the range along Weld County Road 96 shall be landscaped
to provide natural noise barriers by using berming and/or evergreen species. the remainder of the range
shall be planted and maintained with grass or suitable crops. The landscaping shall be maintained by the
applicant and dead or dying materials shall be replaced immediately upon notice.
Development Standards#17, The Special Review Permit is issued for a period of five years. After the
completion of five years, the Permit shall be reviewed every five years after and maybe revoked when a
substantial change has occurred regarding compatibility with surrounding land uses. Revocation
proceedings shall follow the procedures set forth in the Weld County Zoning Ordinance.
Jack Epple seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision.
