Dear Sheri,
Thank you for the referral concerning the Lewis Farm Sand & Gravel Project. I have
reviewed the materials in the packets that I received from you and visited the site on the
14 September 1999.
This site is situated in and associated with a riparian flood plain approximately '/z mile
west of the South Platte River. It is approximately 30 % + forested with cotton wood
trees. From a wildlife standpoint, this habitat type is the most important wildlife habitat,
in terms of species abundance and diversity,found in our state.
This project will displace numerous wildlife species that are known to use this area;
namely, eagles and other raptors, wild turkey, deer and other small mammal/bird species.
Immediately to the south of this project site is an active prairie dog town, ant important
prey species, especially to raptors.
Regarding reclamation (if this project is approved), the resulting ponds should be
configured in a more irregular shape to maximize the shoreline, including jetty type
—, structures protruding into the pond as well as several islands to encourage plant and
wildlife species. The slope of the ponds created should include shallower areas than the

proposed 3:1 slope ratio, with a minimum of 5:1 slope ratio to encourage more diverse
flora and fauna to inhabit the area. Lining ponds does little to encourage such growth,
especially from a fisheries standpoint. Also consider adding underwater topography and
structures for the same reasons.
A significant setback of the ponds from the enclosing property boundaries would be very
useful to allow some reforestation of the damaged area. Maximum reforesting of the area
is recommended to encourage wildlife recovery.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview
of the Weld County Site Specific Development Plan and Use by Special Review for an Open Cut Mining Operation
standards. Our comments and requirements are as follows:
COMMENTS:
WCR 8 is designated on the Weld County Transportation Plan Map as a local gravel road. This road is in good
condition and is approximately 28 feet wide. A traffic count was done on August 26, 1999, between WCR 23 and US
Highway 85 which shows an average count of 175 vehicles in a 24 hour period.
A traffic signal has been identified where WCR 8 intersects with US Highway 85 for a future interchange. There are
existing accel-decel lanes at this location. Please contact Tess Jones or Gloria Hice-Idler at the Colorado Department
of Transportation for any additional requirements.
There are two county bridges identified within the designated haul route, 8/23A(Lupton Bottom)and 8/25A(South Platte
River). Both bridges are on our bridge inventory program and neither has a weight restriction limit. The applicant shall
haul only legal limits on this route.
REQUIREMENTS:
Road Maintenance and Improvements Agreement: The applicant shall enter into a Road Maintenance and
Improvements Agreement with the Weld County Public Works Department to upgrade and pave WCR 8 between the
main entrance and the existing asphalt adjacent to US Highway 85. This will be designated as the haul route. The
pavement shall be 24 feet wide with six-foot gravel shoulders. The asphalt shall be four inches deep with eight inches
of Class 6 aggregate base course matching the existing asphalt grades. An additional two-inch overlay of hot
bituminous pavement shall be placed over the remaining portion of WCR 8. The two bridge peak areas shall not
receive additional asphalt.
Site Access Approach:The applicant shall extend or replace the existing cross culvert at the entrance to WCR 8. The
site access approach shall be elevated to provide adequate sight distance to the east.
Storm Water Drainage: The applicant states that the storm water drainage shall be held in detention ponds prior to
discharging into the South Platte system. This will require a State Discharge Permit.
Internal Roads: The internal road system shall be treated with chemical stabilization to control dust.
Setback: As per the ordinance, Weld County Public Works is recommending the minimum 20-foot setback for an
agricultural zone adjacent to property lines. The applicant has identified a 10-foot setback.

Environmental Protection Services has reviewed this proposal for an Open Cut Gravel Mining Operation. The
following conditions are recommended to be part of any approval:
1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that:protects
against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled,stored,and disposed in a manner that controls fugitive dust,blowing
debris, and other potential nuisance conditions.
4) The maximum permissible noise level shall not exceed the industrial limit of 80 db(A)as measured
according to 25-12-102, Colorado Revised Statutes.
5) Adequate toilet facilities shall be provided for the employees.
6) If applicable, a NPDES Permit shall be obtained from the Water Quality Control Division of the
Colorado Department of Health for any proposed discharge into State Waterways.
7) An Air Pollution Emission Notice(A.P.E.N.)and Emissions Permit application must be submitted to
the Air Pollution Control Division,Colorado Department of Health and Environment for emissions of
criteria,hazardous or odorous air pollutants. Sources of such emissions include but are not limited to
the following: sandblasting operations, mining, spray paint booths, dry cleaners, haul road traffic,
composting,boilers and incinerators.
8) A dust abatement plan shall be submitted to the W.C.Health Department for approval prior to operation.
The facility shall have sufficient equipment available to implement the dust control as required by the
W. C. Health Department.
9) The applicant shall remove,handle,and stockpile overburden, soil, sand and gravel from the facility
area in a manner that will prevent nuisance conditions.
10) The facility shall utilize bottled water for employees.
11) The application materials indicate an existing septic system shall be utilized. The Environmental
Health Services Division was unable to locate a septic permit for the septic system serving the existing
structure. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review describing the systems ability
to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and Environment. In the event the

system is found to be inadequately sized or constructed the system shall be brought into compliance with
current Regulations.
12) Portable toilets may be utilized on the site which are temporary locations of the working face,for up to
six months.
13) The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals
and Geology.

Dear Mrs. Lockman:
Staff has reviewed the referral for an open cut gravel mining operation (case USR-1243).
The City of Brighton growth/referral area extends as far north as Weld County Road 8. Staff has
prepared several informational responses to the proposed gravel mine, as well as, technical
comments relating to traffic and roadway improvements related to this project.
The proposed gravel mine appears to do away with several acres of both wildlife habitat
and wetland areas along the east half of the property, including a significant stand of trees. The
mining project should be considered on the west half of the property only, with the east side
remaining for continued existing uses.
The site access should include paved acceleration and deceleration lanes, if required by
County traffic engineers. Cost sharing for roadway improvements should be based on the weight
of vehicles utilizing the site, not the number of vehicles or trucks taking access to the property.
Improvements to the acceleration and deceleration lanes at Highway 85 and Weld County Road 8
should be installed prior to commencing operations at this site. This intersection is planned for
signalization in 5 to 20 years, according to the latest CDOT Highway 85 corridor study. Left turn
north bound truck traffic from WCR 8 should not be allowed without a signal in place at this
intersection. I have included the latest description of this intersection as provided by CDOT for
your review.
Finally, the continued increase in truck traffic on Highway 85 has increased traffic
congestion, promoted greater deterioration of the road surface and increased access dangers. If
the site is allowed to be mined, the reclamation plan should be implemented with an agreement
that transportation improvements be identified and installed, according to County and CDOT
standards.

to the east away from the intersection before signalization can occur.
Ult:mately, this access will be upgraded to a grade-separated interchange given
the availability of funding and approval of the Department and the local
authority. Before signalization, interim intersection improvements may be
necessary to address capacity and safety concerns.
• CR 6.25 (MP 238.34): An existing public road access on the east side of
US 85.This access currently functions as a full movement, unsignalized
intersection. The intersection will be modified to a RIRO access when
improvements are made on CR 27 at CR 6.25 and at adjacent intersections to
accommodate turns by large trucks. The access will be closed when an
interchange at CR 6 (MP 238.08) is built.
• MP 238.34 (west): An existing rural access with median opening. The access
will be modified to RIRO access at the same time CR 6.25 (MP 238.34) on the
east side is modified to a RIRO access. This access will be closed once a new
frontage road between CR 2 and CR 8 is constructed.
• CR 8 (MP 239.06): An existing public road access on both sides of US 85. This
access currently functions as a full movement, unsignalized intersection. In the
interim, the intersection will be modified to a 3/4 access when improvements
are made on CR 27 at all public road intersections between CR 2 and CR 8 to
accommodate turns by large trucks. See PRU - Scenario 1 . Ultimately, this
access will be upgraded to a grade-separated interchange given the availability
of funding and approval of the Department and the local authority. Before
tmodification to a 3/4 access, intersection improvements may also be necessary
~ to address capacity and safety concerns.
• MP 239.42 (east): Existing rural access with median opening. See RA. Access
will be closed when an interchange is built at CR 8 (MP 239.06).
