RESOLUTION
RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DALE ROSEMAN FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Dale Roseman, VI #9700221, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of August, 1998, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Dale Roseman, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until October 9, 1998, to allow adequate time for the property owner to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Dale Roseman to remedy the violation of the Weld County Zoning
Ordinance, and any other persons occupying the properties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until October 9, 1998, to allow adequate time for
the property owner to bring the subject property into compliance.

CASE SUMMARY
December 23, 1997 Initial compliant received. Approximately 20-25 vehicles and possible operation of a
commercial business located on the property.
December 29, 1997 Site inspection conducted. Approximately 20-25 vehicles on the property and the
appearance of a commercial business. There have been previous violations for Dale
Roseman, but at a different address (Aristocrat Ranchettes). To bring the property into
compliance a special review permit must be obtained to run a commercial operation
in the agricultural zone district.
December 29, 1997 Five day contact letter sent.
January 6, 1998 Telephone call received by the Department of Planning Services from Dale Roseman.
He stated he came into the department and talked with someone regarding the special
review permit. He will submit a screening plan and understood he could not run a
commercial business until the USR has been applied for and approved.
February 6, 1998 Facsimile received by the Department of Planning Services delineating the proposed
screening plan. Todd Hodges, Current Planner II, approved the proposed plan.
March 12, 1998 Telephone call from an anonymous caller stating that Dale Roseman was advertising
vehicles for sale.
March 19, 1998 Site inspection conducted. It does not appear that signs are posted for vehicles sales.
The fencing has been started, however, not much progress has occurred.
June 16, 1998 Progress inspection conducted. Signs were on a few vehicles advertising them for sale.
I will send a thirty day letter.
June 16, 1998 Photographs were taken.
June 19, 1998 Thirty day letter sent.
July 24, 1998 Letter sent scheduling Mr. Roseman to appear before the Board of County
Commissioners Violation Hearings on August 11, 1998.

August 3, 1998 Telephone called left on Sharyn Frazer's voice mail from Dale Roseman wanting
clarification as to what the violation hearing is about. I returned the call, however, no
one answered and there was no voice mail available.
The noncommercial junkyard (20-25 derelict vehicles) still exists on the property with only partial screening in
place. Reports of the operation of a commercial business (car sales) are still occurring. To bring the violation into
compliance, the screening needs to be completed, and a Special Review permit would need to be applied for and
approved to continue operation of the vehicle sales.
The Department of Planning Services recommends that the County Attorney authorize legal action against any
other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting
in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled a
meeting with the Board of County Commissioners on August 11, 1998, at 10:00 a.m. to consider the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, first floor,
Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that

Dear Mr. Roseman:
The uses on the above described property are being considered as a zoning violation of Sections 31.2, 31.4 and
31.3.9 of the Weld County Zoning Ordinance. The operation of a commercial business (vehicles for sale) and
the appearance of a noncommercial junkyard are not uses allowed in the A (Agricultural) zone district.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from June 19, 1998,
to correct this zoning violation. Failure to do so will result in this office scheduling the violation before the Board
of County Commissioners to consider whether to refer the violation to the County Attorney's Office for legal
action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be of any

interest, claim and demand whatsoever of the grantor, either in law or equity, of in
and to the above bargained premises, with the hereditament■ and appurtenances.
