Your letter states that Martin Exploration consents to the limitation of the special use allowed by Special Use Permit USR:524 to the area known as "Lot A" of Recorded Exemption RE -1727, which is more particularly described as follows: Beginning at a point 1408.16 feet South 89°46'25" East from the Northwest Corner of Section 5, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado; thence, south 585.68 feet; thence, east 360.18 feet; thence, north 585.68 feet; thence, west 360.18 feet to the point of beginning, containing 4.4385 acres, more or less. You represented in the hearing on Monday, May 15, 1995 for Recorded Exemption RE -1727 that the use allowed pursuant to USR:524 does not necessitate the use of the property known as "Lot B" of RE -1727. As a result, Martin Exploration is comfortable with limitation of the use to the area known as Lot A Please be advised that the Weld County Department of Planning Services does not consider your consent to the limitation of the use of Special Use Permit USR:524 to the area of Lot A of Recorded Exemption RE -1727 to be a substantial change requiring an amendment under the provisions of the Weld County Zoning Ordinance, Section 24.4.2, or constitute a material deviation as referred to in Development Standard 11 of USR:524. The Department will keep your letter, along with a copy of this letter and a copy of the plat for Recorded Exemption RE -1727, in the file for Special Use Permit USR:524. The issue raised at the meeting related to the fact the original Special Use Permit was granted on the entire 10 acre parcel. Mr. Barker has informed me that a formal ammendment to the original Special Use Permit reducing the permitted use from the entire 10 aore parcel to Lot A of the proposed exemption may not be required provided Martin Exploration agrees to limit the permited special use to Lot A of the proposed exemption. Let this letter serve as Martin Exploration's Consent to limit the special use to the proposed Lot A of USR 524 recorded exemption RE -1727 and more particularly described as follows: Beginning at a point 1408.16'South 89 46'25"E. from the Northwest Corner of Section 5, Township 1, North Range 67 West, thence due South 585.68', thence due East 360.18', thence due North 585.65', thence due West 360.18' to the point of beginning, containing 4.4385 acres more or less. With respect to the need for a formal ammendment to the Special Use Permit USR: 524, Martin Exploration does not believe the division into Lot A and B and the limitation of the permitted special use to Lot A is a substantial change requiring an ammendment under the provisions of the Weld County Zoning Ordinance Sec. 24.4.2, or constitutes a material deviation as referred to in Development Standard 11 of the Special Use Permit USR: 524. Mr. Barker also asked whether or not a wooden fence had been constructed around Lot A in compliance with Standard 6 of the Special Use Permit. Martin Exploration built and has maintained the fence around Lot A since the Special Use Permit was granted in 1982. Please respond to let us know if what we have stated in this letter is correct and sufficient. The permit was approved and recorded in 1982 for an oil field service business for the storage of completion rigs, tubing, rods, valves, fittings, small equipment and equipment trailers on a 10.006 acre parcel. I find no development standard in the Special Review permit stating that the land use as described above and in the application materials is not transferable to another land owner. As I mentioned in our conversation, please inform any potential buyers of the parcel that any amendments to the operation as stated will require a review by the Department of Planning Services. If the staff determines that the change(s) or improvement(s) constitutes a major deviation from the original intent of the permit, the operator will be required to apply for an amendment to the Special Review permit.
