Dear Monica: This letter is in response to the referral for the above noted application from the County on the above referenced project. As you may know, the Town has previously provided comments on this development. Generally, the Town has the following major comments on the noted application: 1. Del Camino Junction Business Park does not have an executed Annexation Agreement with the Town of Firestone. Such an Agreement is required by Section 4.3(b) of the Interim Coordinated Planning Agreement, as the property is within the Town's Urban Growth Boundary. That Boundary was specifically agreed upon in the IGA. The property is not within any growth boundary overlap area and can be served by the Town. Therefore, concerns over service and growth area disputes are not legitimate. In any event, the IGA does not give the County the discretion to waive the required agreement. County approval without an executed agreement would be a violation of the IGA. It would also authorize an unincorporated urban development on the east side of l- 25, which is clearly at odds with the goal of smart growth that the IGA is intended to achieve. 150 Buchanan P.O. The Application does not comply with the standards set forth in Weld County Ordinance No. 201 (September 9, 1998) also known as the South Weld County Land Use Plan, which was adopted by an intergovernmental agreement between Firestone, Weld County, et al. 3. The alignment of the arterial and the frontage road do not appear to coincide with the alignment and intersection previously agreed to by the Town, CDOT and the Landowners. It is Firestone's position that the County should withhold any approvals and processing of this application until the items stated above are properly addressed. The Del Camino Junction Business Park lies wholly within the Town of Firestone Urban Growth Boundary as described in the Interim Coordinated Planning Agreement, between Weld County and the Town of Firestone, et al. 2. The Del Camino Junction Business Park abuts the western boundary of the Del Camino Central development which is annexed into Firestone. 3. Pursuant to the Interim Coordinated Planning Agreement, the Town believes that the property owners of the Del Camino Junction Business Park must have an executed annexation agreement with Firestone, as a condition of any County approval. 5. Firestone has serious concerns on the compatibility of the proposed uses (e.g. industrial) and attendant development standards (e.g. signage) as stated in the application, with those of the properties in the area that are annexed and zoned within Firestone., 6. Firestone has concerns relative to the timing and funding of the construction of the noted major north-south transportation facilities. Please provide us with the date and time of the Planning Commission hearing on this matter so that we can be in attendance to further elaborate Firestone's position on the general items noted above and other technical issues associated with the application. The property named is within the boundaries of the Mountain View Fire Protection District and receives fire protection from the District. The Fire District does not object to the proposed subdivision and subsequent development, provided the development is able to meet the requirements of the Fire District. All applicable codes as they pertain to water supply, fire hydrant locations, street widths and designs, fire department access, and any other applicable fire code requirements as they pertain to building construction must be met. Based on my review, I have the following comments regarding the sketch plans submitted: • A minimum fire flow of 2,500 gallons per minute, measured at a residual pressure of 20 pounds per square inch, is required for a commercial/light industrial subdivision and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. Required fire flow may be reduced by changing building types of construction or by installing built-in fire protection, such as a fire sprinkler system meeting the requirements ofNFPA 13. • Construction plans for the utilities showing the location of fire hydrants, the size of water mains and available fire flows will need to be submitted to the Fire District for review and approval. It should be noted, the maximum spacing between fire hydrants on public streets and along fire apparatus access roads is 300 feet in commercial portions subdivisions. The installation fire hydrants, water mains and access roads is required to parallel construction and the storage of combustible materials on site. • Fire apparatus roads must be designed and maintained to support the imposed loads of fire apparatus (60,000 pounds) and must have a surface that provides all-weather driving capabilities. The developer needs to be made aware that all access roads must be approved before building construction may begin. If standard street signs are used, then the signs do not need to be submitted to the Fire District for approval. If non-standard street signs are used, the signs do need to be submitted to the Fire District for approval. • All buildings within the subdivision shall have a legible address that is clearly visible from the street fronting the property. Address numbers or letters shall contrast with their background. • Plans for all buildings to be built within the subdivision need to be submitted to the Fire District prior to the beginning of construction. All applicable fire codes, as they pertain to buildings and construction, must be met for each individual pad site. Final site plans for individual pads will need to be provided to the Fire District for review and approval as development proceeds. • Should the project be phased, phasing plans will need to be approved by the Fire District. The Fire District reserves the right to make further comments as development proceeds. Nothing in this review is intended to authorize or approve of any aspect of this project that does not comply with all applicable codes and standards. CONCERNS The concern is with the grass seed mix for the proposed detention ponds . The ponds that will be dryland could use the addition of a good dryland grass . I would suggest changing the mix to 25% Arriba western wheatgrass . This would add a hardy native sod former to the mix. The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Weld County Mixed Use Development (MUD) Planned Development Standards. Our requirements are as follows: 1. PUD Final Plan. Item 7.3.8: The applicant shall submit an Improvements Agreement According Policies Regarding Collateral for Improvements. A. Exhibit A, a primary cost estimate, was supplied and reviewed. All transportation items appear to be adequate for units and estimated costs except the unit item for WCR 24.5 shall be recalculated to verify correct tonnage. 2. WCR 24.5/Internal Roadway: The plat shall include both roadway cross section drawings (local employment/regional commercial and local residential) per MUD Figure 2.10. 3. Storm Water Drainage Plan: The drainage report needs to be signed and stamped by the same professional engineer who prepared the report. A. The outfall line crossing WCR 24.5 shall be extended beyond the ultimate cross section planned for this roadway. B. The applicant shall provide evidence of approval from CDOT for placement of the storm sewer outfall line adjacent to the 1-25 frontage road. C. A Subsurface Exploration Report prepared by Earth Engineering Consultants, Inc (November 1998)was included in the referral. 1) Gravel resource. The site is underlain by an undetermined thickness of sand and gravel, the quality of which was not assessed in the EEC report. House Bill 1041 requires that counties regulate, preserve, and plan for extraction of commercial mineral deposits. The resource beneath the subject property should be evaluated for the quality of gravel and the planning department should determine how the site fits into Weld County's master plan for mineral extraction. The extraction of quality gravel supersedes other development considerations. 2) Subsurface Drainage. Twelve borings (B-10 through B-21) were drilled over the subject property during the present investigation. These borings encountered subsurface water at depths ranging from 4 to 9 ft below ground level (bgl). The water is transmitted in a sand and gravel layer. There are piezometers on site but no groundwater monitoring data were provided. There is very little discussion of the groundwater problem in the Subsurface Report beyond saying that basements are not recommended. For foundations to be set below the frost line (2.5 ft bgl) dewatering equipment must be present on site for all construction. With the potential for groundwater rise when adjacent gravel operations cease, CGS agrees that subgrade construction is imprudent. However, if any subgrade construction is planned, it must be accompanied by an underdrain system that daylights or is accompanied to a sump pump. Del Camino Junction Park,p.2 3) Soil. The site is underlain by a thin layer of sandy clay that overlies a section of sand and gravel. The sandy gravel generally provides a suitable substrate for foundations and floors, and this is borne out by the hand penetrometer tests performed on select samples. The text of the EEC report states that swell-consolidation tests were performed on certain samples, but the results of these tests were not included in the report. One clay sample, collected from a depth of 10 ft in B-11, indicated much lower strength than the sand and gravel. In building envelopes where clay is present at foundation levels, strength and swell- consolidation tests should be performed so that footings may be appropriately sized. If clays at the foundation level or below are found to be moderately to highly expansive under in-situ conditions, this clay should be excavated and replaced with a structural fill. I agree with EEC that the pavement and flatwork areas may need additional earthwork preparation to eliminate the potential for frost heave. 4) Drainage. A drainage plan must be prepared that discusses the management of onsite flows and discharge from the proposed detention ponds. The calculations should determine whether the sizing of the ponds, as shown on the landscape plan, is adequate. The drainage plan should be prepared before the next phase of development. In summary, the concerns at the site are whether the site should be considered as a gravel resource; if not, the impact of shallow groundwater on commercial development must be mitigated. The comments listed above on these issues should be considered in development of the site. In addition, a drainage plan must be prepared. The application has satisfactorily addressed water and sewer service. Water will be provided by the Central Weld County Water District sewer will be provided by the St. Vrain Sanitation District. As you are aware, the specific uses of the development are currently not known. We will review each use as they are presented in the Site Plan Review process. However, we recommend that the following general conditions be part of any approval and apply to all future uses on the site: 1. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as measured according to 25-12-102, Colorado Revised Statutes. Our staff observed that there are several gravel mining operations and a dairy in the vicinity of this proposed development. We also observed several rural-type homes near the proposed development. Many of these homes have livestock that include but may not be limited to cows and horses. In addition, we also observed open agricultural fields in the vicinity of the site, some of which may be used as biosolids application sites. It is our opinion that any future property owner should be made aware that these agricultural uses exist and that they may be exposed to noise, dust, flies, odors, etc. in excess of the common urban experience. It shall be the responsibility of the Permittee to verify the location of the existing utilities and notify all utility owners or operators of any work that might involve utilities within the State Highway right-of-way. Removal, adjustment, or relocation of an existing utility requires the Permittee to obtain a utility permit . Any work necessary to protect existing permitted utilities, such as an encasement, will be the responsibility of the Permittee . Any damage or disruption to any utilities during the construction shall be the Permittee ' s responsibility and shall be repaired or replaced at no cost to the Department . 19 . When it is necessary to remove any highway right-of-way fence, the posts on either side of the access entrance shall be securely braced with approved end posts and in conformance with the Department ' s M-607-1 standard, before the fence is cut, to prevent slacking of the remaining fence . All posts and wire removed shall be returned to the Department at 20 . Construction traffic control devices, when not in use, shall be removed or turned away from traffic . 22 . Prior to final pavement marking, the Permittee shall contact Ray Terrones at (970) 353-9991 in order to review striping layout and to coordinate schedules for striping by the Permittee and inspection by CDOT. No pavement marking shall be applied without the required plan review and authorization. PERMITTEE SHALL PROVIDE LAYOUT TO CDOT STRIPING INSPECTION PERSONNEL. 23 . Once the Notice to Proceed is obtained the access shall be completed in an expeditious and safe manner and shall be finished within 45 days from initiation of construction within State Highway right-of-way. 24 . All required access construction shall be completed prior to the herein authorized use of this access . The application has satisfactorily addressed water and sewer service. Water will be provided by the Central Weld County Water District sewer will be provided by the St. Vrain Sanitation District. As you are aware, the specific uses of the development are currently not known. We will review each use as they are presented in the Site Plan Review process. However, we recommend that the following general conditions be part of any approval and apply to all future uses on the site: 1. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site.. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. The maximum permissible noise level shall not exceed the commercial limit of 6O db(A), as measured according to 25-12-102, Colorado Revised Statutes. Our staff observed that there are several gravel mining operations and a dairy in the vicinity of this proposed development. We also observed several rural-type homes near the proposed development. Many of these homes have livestock that include but may not be limited to cows and horses. In addition, we also observed open agricultural fields in the vicinity of the site, some of which may be used as blosolids application sites. It is our opinion that any future property owner should be made aware that these agricultural uses exist and that they may be exposed to noise, dust, flies, odors, etc, in excess of the common urban experience. As you are aware The Villa is no longer pursuing the pre-parole project, however the plat note remains. The Villa is now making application to develop a business park on this property. Since a Law enforcement authority is not a usual requirement of a business development, I would request that the plat note be removed. A law enforcement authority has advantages, and may be something we should talk about in the future for the entire M.U.D.
