The maximum funding level from this account has been set at$240,560 and this project authorization is subject to the following conditions: A. The approved maximum funding limit on any project cannot exceed 80 percent of the actual project costs B. The approved maximum funding limit will not be increased to cover increased costs or cost overruns. C. No state funds will be paid for any costs,including engineering costs,unless and until actual construction on the project is started. D. A"Certification of Intent to Proceed"(enclosed)must be submitted to this office within 45 days of the date of this letter. (See step 5 on page 2 of the enclosed Colorado Department of Highways"Procedural Directive No. 43.1"). Counties are encouraged to draw down funds as quickly as possible and as each stage is reached in construction(i.e.50 percent,40 percent,10 percent). The Legislature's Joint Budget Committee has made it clear that previous and current grantees are under strict obligation to spend these funds as quickly as possible or risk losing them altogether. Such amount shall be payable from the Colorado Department of Transportation County Bridge Fund 730; FURTHER,the approved maximum finding limit shall not exceed 80 percent of the actual project costs. This approved maximum funding limit will not be increased to cover increased costs or cost overruns. No funds from the State Special Bridge Accounts for Municipalities and Counties shall be paid for any costs incurred by the local entity,including engineering costs,unless and until construction of the project has commenced. FURTHER,the State Transportation Commission delegates to the Executive Director of the Colorado De- partment of Transportation,or his designee,the approval of the documents necessary to release these County Bridge funds as necessary for this project. AUTHORITY House Bill 1090, 1981 Session of the Colorado General Assembly, 43-4-205(6)(a), and (7)(a), C.R.S. 1973, as amended; and Highway Commission Resolutions 1188D of 3/18/82, and 1212D of 6/17/82 (Attachments l & 2) . APPLICABILITY Colorado State Treasurer, all Divisions of the Department of Highways, and the Special Highway Committee of Colorado Counties Inc. and Colorado Municipal League. DEFINITIONS 1. Special Bridge Account: Sixteen percent of proceeds of additional state motor fuel tax directed by H.B. 1090 to be divided among state, counties and municipalities. The allocation will be based on the percentage of total cost need of deficient bridges with a sufficiency bridge inventory p rating of to rogramof the Federal Highway Administration administered with steredby the Colorado Department of Highways. 2. Special Highway Committee. The Colorado State Highway Commission, in its resolution 1188-D, on March 18, 1982, authorized the Special Highway Committee, consisting of eight representatives (four representing the counties and four representing the municipalities) to recommend local bridge projects to the Highway Commission for funding from the Special Bridge Account as established by H.B. 1090. Representatives of the Colorado Department of Highways' Staff. Traffic and Safety Projects Branch and Staff Bridge Design Branch serve as technical advisors to the committee. PROCEDURES Special Bridge Account Shares. The Highway Commission annually, on or before March 31 , by resolution, will notify the State Treasurer of the percentage distri- bution of funds in the Special Bridge Account. Funds from the account will be allocated to the State Department of Highways, the Counties, and the Municipalities in accordance with the percentage needs as developed by the federal bridge inventory. The funds allocated for the year ending June 30, 1982 are based on the percentage of total cost need as of October 1, 1981 . The funds allocated for the following years ending each June 30 will be based on the percentage of total cost need as of January 1 of the previous year. The Colorado State Treasurer's Office will allocate monthly •c to the State Department of Highways in accordance with the percentages authorized by the State Highway Commission receipts from the percentage of motor fuel tax assigned by law to the Special Bridge Account. The Department of Highways will maintain separate accounts for the shares for counties and municipalities. The State share will go into the State Highway Fund. Interest earned on such accounts will be credited to such accounts. Accounts in the Department of Highways are numbered FMS 00001-105 for municipalities, and FMS 00001-106 for counties. Administration. Administration of the special bridge accounts will be accomplished by the State Department of Highways, Division of Administration, Accounting Branch. The cost of administration shall be shared one-third each by the State, Counties, and Municipalities up to one-half of one percent of their allocation from the special bridge account not to exceed $30,000 a year, paid annually in July and based upon services provided in the prior fiscal year. Process for Allocating Special Bridge Money to Counties and Municipalities. 1. The applicants submit an application for funding to the Special Highway Committee. 2. The Special Highway Committee reviews the applications and submits specific project recommendations to the Highway Commission. Specific project recom- mendations will include the maximum recommended amount of state funding for each project, not to exceed eighty percent of the total project cost. 3: The Highway Commission approves specific projects to be funded and the maximum amount of state funding for each project. 4. The Special Highway Committee notifies the local entity of the Highway Commission's approval of the project. 5. Within forty-five days after receipt of the notification of project approval , the local entity certifies to the Special Highway Committee that it intends to proceed with the project and that it has, or will have by a specific date, the, required local matching funds. A design engineer's preliminary cost estimate and a specific construction schedule, including a start date and projected project close out date, shall accompany the Certification of Intent to Proceed unless good cause is shown for delayed transmittal. Upon the failure of any applicant to provide this certification and engineer's documentation, or the appearance of disproportionate cost in the documentation, the Special High- way Committee may recommend that the Highway Commission remove its approval for funding of the project. 6. The initial portion of state funds will be released after the local entity submits a Certification of Project Start to the Special Highway Committee or its designated representative(s) (CML and CCI Special Highway Committee staff persons). The Committee or its designated representative notifies in writing the State Department of Highways' Executive Director of the receipt of the Certification and the Executive Director or his designated representative releases fifty percent of the state funds authorized for the project. The second portion of state funds will be released after the entity certifies to the Special Highway Committee or its designated representative(s) that forty percent of the project is complete. The Committee or its designated representative notifies in writing the State Department of Highways ' Executive Director of the receipt of the Certification and the Executive Director or his designated representative releases an additional forty percent of state funds authorized for the project. 8. The remaining portion of state funds will be released after the local entity certifies to the Special Highway Committee or its designated representative(s) that the project is complete, the entity has contributed a cash match, which is, at a minimum, twenty percent of the total project cost, and that it has advertised for and has made final payment to the contractor. The committee or designated representative notifies in writing the State Department of • Highways' Executive Director of the receipt of the Certification and the Executive Director or his designated representative releases the last ten percent of the state funds committed to the project. 9. Any approved project may be withdrawn prior to the commencement of construction upon notification by the applicant to the Highway Commission through the Special Highway Committee. Preliminary and Construction Engineering. It is the responsibility of the local entity to provide preliminary and construction engineering estimates, design, and supervision. If the local entity requests that the Department of Highways provide such services, the costs will be billed to the local entity. Preliminary engineer- ing and design costs incurred are an obligation of the local entity whether or not the project proceeds to construction. Upon Certification of Project Start by the local entity, preliminary engineering and design costs will be included in the project cost, together with construction engineering and supervision. Costs for such services should be no more than twenty percent of the total project cost. The Action Plan process of the Colorado Department of Highways need not be followed for such local bridge projects. Unless Federal funds are involved, the bridge renovation would of have to meet Federal standards for design .unless the local entity specifi this.
