COLORADO, BY THE BOARD OF COUNTY COMMISSIONERS FOR ITS RESPECTDE
INTERESTS , the Lessee , and the CITY OF GREELEY, A MUNICIPAL CORPORA-
TION , the Lessor, WITNESSETH:
WHEREAS , the Lessee has petitioned the Lessor for suffic «,
ground to build a County Library building; and
WHEREAS , the Lessor owns certain real estate hereinafter
described which is suitable for the building of a County Libraiy
Building; and,
WHEREAS , the Lessee has offered to lease the property herein-
after described to improve the same for a library building site and
to build the necessary building on said property; and
WHEREAS , there is no other property, icr the opinion of the
Lessor and Lessee , available for the County Library Building; and
WHEREAS , the parties hereto have mutually agreed upon the
rent, terms and conditions for which the property hereinafter
described shall be leased for a County Library Building purposes .
NOW THEREFORE, in consideration of mutual promises , covenants ,
agreements herein contained and the payment of the rent of One Dollar.
annually, Lessor hereby leases unto Lessee , the following premises ,
situate in the County of Weld, State of Colorado, to-wit:
Beginning at a point west of the east line of section
Thirteen (13) , Township Five (S) North, Range Sixty-six
(66) West of the Sixth (6th) Principal Meridian, said
point being 2004 feet south and 50 feet west of the
Northeast corner of said section thirteen (13) ; thence
West 300 feet , thence North parallel to the East line
of said Section 13, a distance of 300 feet, thence
East 300 feet, thence South parallel to the East
line of said section 13 , a distance of 300 feet to a
point of beginning .
To have and to hold the same from the 22nd day of
DECEMBER , 1959 , to and until the 22nd day of DECEMBER
1984, subject to the provision for earlier termination hereof by
Lessor , at and for a rental to be determined as hereinafter
specified .
It is mutually agreed and understood, as follows:
1 . That the Lessee shall use the premises for a County Library
Building only .
2 . That the Lessee shall do and perform all acts necessary
to build and maintain the area for a County Library . That the
exterior of the building shall be of red brick similar to that used
on Fire Station #2 and Training Tower in immediate vicinity and that
the location of the building on said demised property shall be first
approved by the Lessor . That all plans for said building shall be
according to the building code of Greeley , Colorado .
3 . That the Lessee shall protect and save Lessor harmless
from any claims or demands whatsoever by reason of any accidents which
may occur upon the demised property, and shall keep and maintain in
full force and effect sufficient liability insurance for this purpose
wherein the City of Greeley and the County are named insured .
4 . Lessee may not assign this lease or any of its interest herein .
5 . In the event that Lessee fails to use said demised premises
for County library purposes during the term of this lease or sub-
sequent renewal terms of this lease , then Lessor may cancel the entire
lease , and Lessee shall , upon said cancellation, return the property
to the Lessor.
6 . It is hereby agreed that this lease may be renewed for
successive twenty-five year terms without notice , subject however ,

to the provisions for cancellation as provided in paragraph 5 of
this lease .
IN WITNESS WHEREOF , the Board of County Commissioners , by
and through its Chairman , has caused this lease to be subscribed
and attested by the Clerk to said Board and said Lessor by and
through its Mayor has caused its corporate name to be hereunder
