The Building Inspection Department has reviewed the submittal from B.F.Y. LLC concerning the
warehousing pharmaceutical and food product. Based upon the information submitted this
facility shall be considered a Group S, Division 1 Occupancy with the following conditions:
1. The storage of materials shall not exceed those quantities as listed in Table 3-D and 3-E
of the 1994 Edition of the Uniform Building Code.
2. The Building Inspection Staff shall have access at any reasonable time to conduct an
inspection of the building. Material Safety Data Sheets and the quantities of materials
stored in this building shall be available to the staff at these times.
If the owner is unable to comply with these conditions, the facility will be reclassified to the
appropriate occupancy and the building brought into compliance with all of the requirements of
this new occupancy.

Enclosed is an application from B.F.Y. LLC for a Site Specific Development Plan for a Special Reyiew Permit
for a Delivery Company with Warehousing for Customers and Recreational Vehicle Storage. The parcel of
land is described as Lot A of RE-1727, located in part of the SW4 of the NNV4 of Section 5, T1 N, R67W of the
6th P.M., Weld County, Colorado. The location of the parcel of land for which this application has been
submitted is east and adjacent to Weld County Road f5, 1/4 mile south of Colorado State Highway 52.

Dear Kerri :
I have reviewed the submitted materials and before I can provide
detailed information with regards to fire protection requirements,
I need the following information:
1 . The drawing I received, marked USR-524 was difficult to read
with regards to the measurements of the building nearest what
is marked as the "existing access" . Verify the dimensions of
the building I believe to be marked "shop" . Figures added to
the drawing are 48' X 24" . Are these the correct figures?
2 . The drawing states "Existing building is closer to existing
chain link fence" , what is the exact distance?
3 . What type of building construction are the existing buildings
and what is the proposed construction type for the addition to
the warehouse?
4 . Fire Flow requirements and number of hydrants needed will be
determined based on items 1 through 3 .
5 . Nothing in the application reflects what will be stored in the
proposed warehouse . Fire Protection requirements for this
building will be determined based on this information. Has
the Building Official assigned an "occupancy classification"
to this building?

6 . The Fire District uses the Knox Company as the provider for
key boxes and padlocks which are used only for fire department
access to the premises . Knox Box models 3200 or 4400 are
satisfactory unless it' s determined that a storage cabinet
will be necessary for hazardous materials information. A
heavy duty padlock will be necessary for the gate access to
the proposed RV Storage lot . Applicant will need to complete
the Knox order form and attach payment and return to the Fire
District in order that an "authorized signature" can be
affixed to the application, which will then be mailed.
Applicant will need to notify the Fire District when
installation of the knox box is completed. (Fire Protection
Development Standards, Appendix IX) .

MOUNTAIN VIEW FIRE PROTECTION DISTRICT
LOCK BOX INFORMATION
SECTION I PURPOSE
1 . 1 The purpose of this procedure is to set a
standard within the authority of the Mountain
View Fire Protection District regarding
Lock Boxes.
SECTION II WHERE REQUIRED/TYPE REQUIRED
i2 . 1 Any building, except a one or two family dwelling
which has a local fire alarm or monitored fire
alarm system shall provide a lock box for fire
department access.
2 . 2 Any building, except a one or two family dwelling
which has a fire protection system, that when
activated sounds an alarm, whether local or
monitored shall provide a lock box for fire
department access.
1 2 . 3 All new or remodeled buildings .
2 . 4 All businesses falling under the requirement of
SARA Title III , UFC Sections 79 or 80 , will be
required to install and maintain a lock box
large enough to house the HMDS . Businesses
housing a sufficient quantity of hazardous
materials to represent a hazard to the public
or to firefighting, in the opinion of the Chief
or his designate, may be required to install such
a lock box.
a. This box will be located near the main
entrance, or at another location approved
by the Fire Marshal prior to installation .
The box must be visible and must have
the address numbers , and unit numbers , if
applicable, stenciled on the box . The
recommended height of installation is eight
feet above the grade.

approved for installation within the Mountain View
- Fire Protection District. The Fire District will
recommend the model for specific needs .
SECTION III CONTENTS
3 . 1 The lock box shall contain a current list of
emergency contacts to notify when the lock box
is opened. Such list shall include telephone
numbers.
3 .2 The lock box shall contain the appropriate keys
to allow fire district personnel access to the
building.
3 . 3 Each key shall be tagged indicating the area of

Dear Kerri :
This letter is in response to Fire Marshal William N .
Bailey ' s letter dated September 5 . 1996 . The following
responses match the numbers in Mr . Bailey ' s letter:
1 . The building in question measures 48 ' x 24 ' .
2 . The distance from the building in question and the road
side fence is 31 ' and the distance from this same
building and the fence that runs through the yard is
59 ' .
3 . The office building is wood frame and the warehouse
building is wood frame with steel siding .
4 . We are not sure of fire flow requirements but we under-
stand there are a couple of hydrants in close proximity
to the yard.
5 . In response to the actual storage of materials in the
warehouse , usually any materials that are stored only
stay in the warehouse a couple of days . These materials
are generally a pharmaceutical or food product . We do
not store any household hazardous waste . hazardous or
flammable materials .
6 . We are quite willing to purchase and install a Knox
box once we receive our USR. We would like more
information on these boxes including purchase costs .

RE: R.L. Heil letter to you dated Sept. 24, 1996
Dear Kerri :
Thank you for sending a copy of the above letter. I have enclosed
a Knox Company application form for the purchase of the Knox Box.
Models 3200 or 4400 would satisfy the requirements of the fire
district . Applicant needs to complete the application, attach
payment in the form of a check to the Knox Company, and return both
to my office . I will affix an authorized signature and mail the
items to the Knox Company. The key box and hardware will be
shipped directly to the applicants address . After installation,
applicant needs to arrange with my office, a time for staff to
obtain access keys to the office and warehouse buildings, which
will then be placed in the key box, at which time the key box will
be secured and ready for fire department use when necessary.
This afternoon I did drive Weld County Road 15, South from Highway
52 and could not locate a fire hydrant along this roadway. If
there is a hydrant serving this area, the fire district has no
record of it . Mr. Heil needs to confirm his information with
regards to two hydrants being available to serve the property. If
this can' t be done, Mr. Heil needs to pursue the installation of a
fire hydrant after site determination is approved by the fire
district . A fire flow of 1, 500 gallons per minute at 20 pounds per
square in needs to be available to this site . Mr. Heil needs to
provide the fire district with a letter from the Central-Weld Water
District indicating that the fire flow is available .
Also, please advise Mr. Heil that the above ground fuel tank
located in the South West corner of the property needs to be
removed. The Uniform Fire Code adopted by the Fire District does
not allow this type of fuel storage tank.

this location, can you confirm that an Occupancy Permit has been
issued. Also, can you provide me with the occupancy classification
of the buildings as determined by your Chief Building Official?

RE: Plan Reviews for Fire Protection Requirements
Dear Pat:
Some issues have surfaced that I wanted to visit with you about and
hopefully you can assist.
The first is a referral received from the Planning Department on
September 9, 1995 regarding USR-1130 (B.F.y. LLC) . It's tay
understanding that they purchased existing buildings, one an office
and another to be used as a warehouse. My response to the referral
included some questions I needed answers on and another item dealt
with fire hydrant requirements_ It wasn't until I returned a phone
r11 to one of the. business owners, that I realized they were
already occupying the buildings, without the fire district's
requirements in place_
My second concern surfaced today, when I was told of two projects
in the county that the fire district wasn't aware of. The first in
a new storage unit complex under construction on Weld County Road
3, just North of Colorado Highway 7_- The party mentioning it to me
thought a company by the name of Lyle Construction may be the
owner. This project is going in without the fire district's
opportunity to evaluate fire protection requirements. The second
one that was brought to my attention is located East of I-25 on
Weld County Road 38 and use to be known as Country View Day Care.
I was told that the building is undergoing remodeling for the
purpose of apartment rentals- Again, the fire district hasn't been
advised of this project.
I hope that you'll look into the above, and let me know whether
building permits were issued and how the notification process can
be improved. Thanks so much for your assistance in this matter!

The Weld County Public Works Department has reviewed this proposed; the following comments
are recommended to be a part of any approval:
1. WCR 15 is being upgraded and paved. This funding for construction has been acquired
through a grant applied for by the County and the Town of Dacono.
2. The applicant needs to place a 15" CMP x 30'minimum culvert at the entrance. Please refer
to Appendix B, Road Access, Sheet No. 1, Commercial Access Standards for culvert
installation and turning radiuses under Ordinance 180 of the Weld County Public Works
Department policies. Please see attached sheet.
3. The operator will be responsible for dust control on site. The following dust control agents
are approved for use by the Weld County Health Department:

b. Magnesium chloride

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the, commercial limit
of 60 db(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. The existing septic system shall be reviewed by a Colorado Regulated
Professional Engineer. The review shall consist of observation of the
system and a technical review in order to determine if the system is
adequately sized and constructed to handle the proposed hydraulic load.
The review shall be submitted to the Environmental Protection Service
Division of the Weld County Health Department. In the event the system is
not found to be adequate, the system shall be repaired or enlarged in
accordance with Weld County I.S.D.S. Regulations.
