Re: Concerns about Legal Notices published in the Ft. Lupton Press

Dear Mr. Hall and Commissioners,
In response to your February 23, 1999 letter I would like to address your concerns which were
outlined regarding legal notices in the Fort Lupton Press.
There is a very basic reason that we believed, and still believe, that the legal notice for Ms.
Harper dated Jan. 23, 1999 should be subject to the Colorado Statuatory rate set forth in C.R.S.
24-70-101. The billing for this notice was sent to Ms. Harper to be paid by Ms. Harper for a
notice placed for Ms. Harper. Weld County's only involvement in Ms. Harper's notice was the
forwarding of this notice to us.
We obviously do not have a contract with Ms. Harper regarding legal notices.
The fact that this legal notice was forwarded to us by Weld County does not change the fact of
whose notice this was; the responsibility of payment and placement for the notice rests with the
private party, Ms. Harper. Collection of this debt from Ms. Harper also rests with us and
therefore we believe such private party notices are subject to C.R.S. 24-70-101 and not covered by
our contract with Weld County.
If the County wishes to submit these notices as its own notice and pay directly for such notices,
then we will acknowledge responsibility per our contract. Mr. Barker indicated that this is how
these matters will be handled in the future.
On the second point regarding the error in the February 6, 1999 issue we acknowledge the error
and have taken steps to prevent this in the future. We published both a Brighton and Ft. Lupton
edition on this date and the plate changes which usually direct certain pages into each edition
was not made by our printer in Longmont. The person clipping the notices believed the notices
were in both papers and inadvertently clipped out of the wrong paper.
We publish hundreds of legal notices each month for dozens of governmental entities. In this case
we made an error and realize the problems these types of errors can cause. Obviously, steps
must always be taken to minimize these types of mistakes.

A major error last year occured when Weld County sent us an incorrect disk and a multi-page
legal notice had to be re-run. We hope that the board's intolerance of our errors will extend itself
into an intolerance of all errors.
I hope this letter more fully explains our view of this situation. We hope to continue to work with
Weld County government. But, I must also be candid and admit that the loss of private party
legal notice revenues such as Ms. Harper's will adversely affect our and other publications'
ability in the future to bid Weld County legal notices at the 75% discount currently enjoyed.

RE: Newspaper Publication Contract with the Board of County Commissioners of Weld County,
Colorado
Dear Mr. Gogerty:
The Board of County Commissioners of Weld County, Colorado, has been advised by staff of two
disturbing issues regarding the newspaper publication contract between the Board and the Fort
Lupton Press. The Board desires to bring these issues to your attention, with directions as to one of
the issues and expectations as to the other.
The first issue is the price charged to at least one planning applicant for legal publication. The case
involves Megan Harper. A copy of your invoice to Ms. Harper, dated January 23, 1999, is enclosed.
Also enclosed is a copy of the Affidavit of Publication from the Fort Lupton Press showing that the
legal notice was published on January 23, 1999. As you may recall, the newspaper publication
contract states that the rate to be charged is $1.40 per inch of legal notice. The notice regarding Ms.
Harpers application was ten inches and, therefore, in accordance with the contract should have been
$14.00. Instead, the Fort Lupton Press, through MetroWest Publishing, charged Ms. Harper the sum
of$64.18. You were asked by Bruce T. Barker, Weld County Attorney, and Deputy Clerk to the
Board Carol Harding to explain the rationale for the increased invoice amount. You stated that you
did not believe that the Harper hearing legal notice was placed pursuant to the contract. Rather, you
stated that it is your position the Fort Lupton Press has the right to charge planning applicants the full
statutory rate, pursuant to authorization set forth in C.R.S. § 24-70-101. You took this position even
though the Harper notice was sent to you by Deputy Clerk to the Board Ester Gesick in an "e-mail"
on January 20, 1999. A copy of Ms. Gesick's e-mail message to the newspaper is enclosed.
In your conversation with Mr. Barker you stated that Publishing has been billing
applicants these rates for the past year. The current contract with the Fort Lupton Press began
November 1, 1998. The previous contract was with the Platteville Herald. Apparently, both
newspapers have charged the applicants far more than that which they agreed to pursuant to the
newspaper publication contracts.

Be advised that upon your receipt of this letter, the Fort Lupton Press and MetroWest Publishing are
directed to cease billing planning applicants directly for legal notices placed by Weld County. Rather,
all invoices for such legal notices shall be sent to Weld County. Only that rate which you agreed to
the contract will be paid. The Board considers your charging increased rates to planning applicants
to be contrary to the terms of the contract.
The second issue concerns your failure to properly publish at least two notices of planning hearings.
Enclosed are two Affidavits of Publication, dated February 6, 1999. In both affidavits, A. Winkler
Riesel, Publisher, swore and affirmed that the notices were published on February 6, 1999, in the Fort
Lupton Press. In reality, neither notice was published in the Fort Lupton Press on that date. In your
conversation with Ms. Harding you acknowledged that the notices were published in a different
newspaper even though the affidavits stated otherwise. The failure to properly publish these notices
required continuances of the hearings from February 17, 1999,to March 8, 1999. Both continuances
inconvenienced the persons who were the subjects of the hearings and staff. Particularly disturbing is
that although the Affidavits of Publication stated the publications occurred in the proper newspaper,
such was not the case. The errors were not detected until Ms. Harding reviewed the Fort Lupton
Press to see if the publications were included. The Board expects that these types of mistakes will
not occur again and that Weld County will be able to rely upon the Affidavits of Publication without
exception.
In conclusion, the Board of County Commissioners directs the Fort Lupton Press and MetroWest
Publishing to send all invoices for legal notices placed by Weld County to the Clerk to the Board of
County Commissioners at 915 Tenth Street, P.O. Box 758, Greeley, Colorado 80632. Such invoices
will be paid in accordance with the rates set forth in the contract between the Board and the Fort
Lupton Press, dated October 6, 1998. Secondly,the Board will not tolerate errors in publication and
the submittal of inaccurate Affidavits of Publication. Any further errors of the type described herein
will be considered grounds for termination of the contract and reimbursement for any consequential
costs and/or damages caused by such errors.
