DISTRICT COURT, WELD COUNTY, COLORADO Civil Action No. 82-CV-153 ORDER AUTHORIZING NOVEMBER 5, 1996, ELECTION FOR BOARD OF DIRECTORS IN THE MATTER OF THE ORGANIZATION OF EAST EATON WATER AND SANITATION DISTRICT IN WELD COUNTY, COLORADO THIS MATTER came before the Court upon Motion submitted by the Board of Directors ("the District Board") of the East Eaton Water and Sanitation District ("the District"). The Court, being fully informed in the premises, makes the following Findings of Fact and Order: FINDINGS OF FACT 1. That the District was legally organized by Order of this Court, dated June 25, 1982. Said Order designated and appointed the first five members of the District Board. 2. That as of July 30, 1996, the District Board had no members by virtue of the District's failure to properly elect members to the District Board. 3. That by Resolution dated August 7, 1996, the Board of County Commissioners of Weld County, Colorado, appointed five members to the District Board, pursuant to the provisions of§ 32-1-905(2.5), C.R.S. Those Directors currently on said Board include the following: Abelino Archibeque, Evelyn Reyes, Antonia Rosalez, Tommy Rosalez, and Loyola Gomez. 4. That at a special meeting on August 26, 1996, the District Board called for a special election to elect permanent Directors to the District Board, with said election to be held on November 5, 1996. 5. That pursuant to provisions of§ 32-1-905(2.5) and § 32-1-305.5(1), C.R.S., it appears that this Court is required to authorize said election by Order upon Motion being made by the District Board. 6. That nomination petitions have been received from the five current Directors listed above, and all of said nomination petitions have been certified by the Weld County Clerk Page 1 961696 and Recorder's Office to be complete in accordance with requirements of§ 32-1-305.5(4), C.R.S. ORDER Based upon the above Findings of Fact, the Court DOTH ORDER: A. That a special election, as that term is defined in § 32-1-103(21), C.R.S., take place on November 5, 1996, for the election of the five Directors to the District Board. B. That Evelyn Reyes is hereby designated as the District's "Designated Election Official", pursuant to the requirements of§ 32-1-305.5(1), C.R.S. C. That the five Director positions shall include three positions at four year terms and two positions at two year terms. Barker, Weld County Attorney, hereby moves for an Order authorizing a November 5, 1996, election for all of the directors positions on the Board, pursuant to the provisions of§§ 32-1-905(2.5), C.R.S., and 32-1-305.5(1), C.R.S., and as grounds therefore, states: 1. That the District was legally organized by Order of this Court in the above captioned case on June 25, 1982. The first District Board was designated and appointed pursuant to said Order, with said District Board consisting of five director positions. A copy of said Order is attached hereto as "Exhibit A." 2. That the District comprises a small area on the east side of Eaton, Colorado, which area is described in a January 25, 1982, Resolution of the Board of County Commissioners of Weld County, Colorado. A copy of said Resolution is attached hereto as "Exhibit B." A map showing the area is attached hereto as "Exhibit C." 3. That as explained in a letter dated July 30, 1996, from Lucia Smead on behalf of the State of Colorado Division of Local Government, the District has in the past failed to properly elect Directors to the District Board. As of July 30, 1996, the District Board had no members. A copy of Ms. Smead's letter is attached hereto as "Exhibit D." 4. That by Resolution dated August 7, 1996, the Board of County Commissioners of Weld County appointed five members to the District Board, pursuant to the provisions of§ 32-1- 905(2.5), C.R.S. Those Directors so appointed are all "eligible electors" as that term is defined in § 32-1-103(5)(a), C.R.S. They include the following persons: Abelino Archibeque, Evelyn Reyes, Antonia Rosalez, Tommy Rosalez, and Loyola Gomez. That in accordance with the provisions of§ 32-1-905(2.5), C.R.S., the District Board held a special meeting on August 26, 1996, to discuss issues regarding the District Board election. An election for all five Director positions was called for November 5, 1996. Evelyn Reyes was appointed to be the District's "Designated Election Official." A motion was passed to have the District President sign an Intergovernmental Agreement with Weld County, Colorado, to have the Weld County Clerk and Recorder conduct the District's November 5, 1996 election (approved by the Board of County Commissioners on September 4, 1996). The ballot was set to have three of the Board positions be elected for four year terms and two positions for two year terms. Minutes for the District Board's August 26, 1996, special meeting are contained in a September 5, 1996, letter from Don Sandavol, State of Colorado Department of Local Affairs. A copy of Mr. Sandoval's letter is attached hereto as "Exhibit F." 6. That § 32-1-905(2.5), C.R.S., requires the Board which is appointed pursuant to that section ". . . call a special election within six months after their appointment, which special election is to be held in accordance with the provisions of§ 32-1-305.5 and Articles 1 to 13 of Title I, C.R.S.; except that the question of the organization shall not be presented at the election." Section 32-1-305.5(1), C.R.S., refers to an Order "authorizing the election" from the Court. Therefore, it appears that pursuant said statutes, there is a necessity for the Court to issue an Order authorizing the November 5, 1996, election. 7. That the Weld County Clerk and Recorder's Office has received nomination petitions for the election of the five Directors listed in paragraph 4 above. Attached hereto as "Exhibit G" is a Certification of Nominations for Election to the Board signed by Kathy Seiler, Elections Supervisor. According to Ms. Seiler's Certification, all of the nomination forms received are complete according to the requirements of§ 32-1-305.5(4), C.R.S. Said Certification also states the terms to which each of those persons so nominated seek to be elected. 8. That pursuant to § 32-1-103(21), C.R.S., a"special election" as that term is used in § 32-1-905(2.5), C.R.S., may be held on the first Tuesday after the first Monday in November of even-numbered years. WHEREFORE, the Board of Directors of the East Eaton Water and Sanitation District respectfully requests that the Court issue an Order authorizing a November 5, 1996, election of all five directors to.the Board, for those terms which are set forth in "Exhibit G", and designate and appoint Evelyn Reyes as the District's "Designated Election Official". Additionally, the Board requests that such Order be considered and ruled upon by the Court "ex-parte", because the process for obtaining such an Order as set forth in Parts 8 and 9, Article 1 of Title 32, C.R.S., does not appear to require any hearing before the Court after notice.
