RE: APPROVE PARTIAL RELEASE OF DEED OF TRUST AND AUTHORIZE CHAIR TO
SIGN - MARY PAIZ AND JOSE ROYBAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and pursuant to Colorado statute and
previous official actions, sits ex-officio as the Weld County Housing Authority Board, and
WHEREAS, the Board has been presented with a Partial Release of Deed of Trust, to
release Lots 12 and 13, Block 80, Town of Hudson, Colorado, from a Deed of Trust executed by
Mary E. Paiz and Jose Roybal on December 23, 1997, in favor of the Weld County Housing
Authority Board, and
WHEREAS, said Deed of Trust was executed to act as collateral to secure a Promissory
Note in the amount of$25,555.00 executed by Ms. Paiz and Mr. Roybal on December 23, 1997,
in favor of the Weld County Housing Authority Board, with a remaining balance of$24,098.13 as
of December 31, 1998, and
WHEREAS, said Partial Release is being requested by Ms. Paiz and Mr. Roybal,
because they have sold said lots for the sum of$20,000.00, and of said sum, $13,049.42 shall
be paid to the Weld County Housing Authority, with the remainder of said Promissory Note
remaining in place, and
WHEREAS, after review, the Board deems it advisable to approve said Partial Release
of Deed of Trust.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Housing Authority Board, that the Partial Release of Deed of Trust,
to release Lots 12 and 13, Block 80, Town of Hudson, Colorado, from a Deed of Trust executed
by Mary E. Paiz and Jose Roybal on December 23, 1997, in favor of the Weld County Housing
Authority Board, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Weld County Housing Authority be,
and hereby is, directed to apply the proceeds received from the sale in the sum of$13,049.42 to
the remaining balance of said Promissory Note of$24,098.13 as of December 31, 1998.
BE IT FURTHER RESOLVED by the Board that it hereby affirms and declares that the
sale of said Lots 12 and 13, Block 80, Town of Hudson, shall not trigger the "due and payable"
clause set forth in Paragraph 1, Part B of said Promissory Note, and the remaining terms and
conditions set forth in said Promissory Note shall remain in effect regardless of the approval of
the Partial Release and acceptance of$13,049.42 set forth herein.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said Partial Release of Deed of Trust.

KNOW ALL MEN, that the above referenced Grantor(s), conveyed certain real property
described in the above referenced Deed of Trust, to the above referenced Public Trustee, in the
State of Colorado to be held in trust to secure the payment of the indebtedness referred to therein.
WHEREAS,the indebtedness secured by the Deed of Trust has been fully or partially paid and/or
the purpose of the Deed of Trust has been fully satisfied as set forth in the written request of the current
owner and holder of the said indebtedness.
NOW THEREFORB, at the written request of the legal holder of the said indebted-
ness, and in consideration of the premises and the payment of the statutory sum, receipt of which is
