RE: DENY MOBILE HOME PERMIT #1956 - COONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 10th
day of April, 1995, considered the request of Heather Coons, P. O. Box 791, Frederick, Colorado
80530, for a mobile home to be used as a principal dwelling, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 172, Block F of Evans Addition, being in Section 30, Township 2
North, Range 67 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard the testimony, does not
vote to grant said request, and, therefore, the request should be denied for the following reasons:
1. When used as a principal dwelling unit, the proposed mobile home will be
incompatible with the surrounding area and will not be in harmony with the character
of the neighborhood. The surrounding area includes stick -built, mobile and
manufactured homes which are neatly kept. The applicant's proposed mobile home
is to be used as a rental with the addition of minimal improvements and
landscaping. Various neighbors and surrounding property owners have expressed
opposition to this request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Heather Coons for permission to place a mobile home to be
used as a principal dwelling on the above described parcel of land, does not gather sufficient
number of votes by Board members for approval, and, therefore, said request be, and hereby is,
deemed denied for the hereinabove listed reasons.

Subject: ZPMH-1956 Zoning permit for a mobile home to be used as a principal dwelling unit, located on

Dear Commissioners:
This request for a zoning permit for a mobile home to be used as a principal dwelling unit was submitted by
Heather Coons. The parcel of land for which this request is located is Lot 172, Block F of Evans Addition,
located in Section 30, T2N, R67W of the 6th P.M., Weld County, Colorado. The property is located east of
and adjacent to Dunmire Street and approximately 200' north of Fox Avenue. The applicant did not obtain
70% of surrounding property owner signatures.
This request is to allow a mobile home to be used as a principal dwelling unit. Weld County Zoning
Ordinance 43.2.6.1.1 states that mobile homes may be permitted in the A (Agricultural) Zone District as a
principal dwelling subject to compatibility with the surrounding area, harmony with the character of the
neighborhood and its effects upon the immediate area. Ordinance 43.2.6.1.2 also states that the use must be
compatible with the Weld County Comprehensive Plan. The intent of the Comprehensive Plan is to establish
residential area which reflect a particular life style choice, including dwelling unity type, density,
environmental setting, and convenience levels. It is the determination of the Department of Planning Staff
that this request does not meet these intents. The surrounding neighborhood includes stick built, mobile and
manufactured homes which are neatly keep. The proposed mobile home does not adhere to the existing
homes in this neighborhood. Staff has received eight post cards and a petition with fifteen signatures from
surrounding neighbors and property owners in opposition of this request. A referral was received from Tri-
Area Planning Commission recommending denial of this application.

The applicant is applying for this zoning permit to resolve a zoning violation, VI -2163, which was
issued January 17, 1995, for placing a mobile home on a piece of property without property zoning
and building permits. The applicant, in a letter dated August 30, 1994, requested information on
how to place a mobile home on a piece of property. A letter, dated September 28, 1994, from the
Department of Planning Services', specifically stated that a zoning permit and building permit would
be required before placing a mobile home on the property.

secure the mobile home until occupancy is obtained.

Tri-Area Planning unanimously recommends rejection of the
above captioned application. There are three mobile homes
near this location, one of which is unoccupied and in
complete disrepair. Within the area, there are only five.
The latest addition was a factory built home.
Since the majority of residences are conventional houses,
and since there are no adequate covenants within the area
covering mobile homes, future development in an orderly
fashion would be inhibited by continuing to encourage mobile
homes.
This area is "sandwiched" between Firestone and Frederick
and its quality is of great concern regarding future
requirements.

We we were informed there is going
a permit to put a trailer in Evanston .
We are writing this letter to urge you not to let this happen.
This trailer is not in very good shape. In fact it was brought over
here from a trailer park in Frederick. That they had removed from
there, because of such an eye sore. These people not only brought
in this trailer in without getting a permit first as is the law. They
also brought a trailer in South of that on a couple houses down
on the left side of the block. It is between two broken down homes
and it is green. They never applied for a permit for this one either.
They are however getting away with dumping it there.
Please help us to get our neighborhood in better shape by not
letting these things happen . Before it gets out of hand. These trailers
have been here since before Christmas . We have a pretty strong
feeling they will rent these out to people who won't help our
neighborhood grow in a very healthy way.
This area needs some attention from our government before
someone gets hurt. Or anything can happen when it starts attracting
not so nice normal people.
There are some people who are trying to clean up there
property to fix it up so it looks nice and clean. This is such a let
down.

don't care what it looks like they just want to get rid of there
garbage . Believe there is garbage dumps behind some of these
homes. Here are some signatures of the property owners who
urge you not to let these people have this permit and want these
appalling trailers out of here.

The uses on the above described property are being considered as a zoning violation of Section 31.2, and
31.2.16 of the Weld County Zoning Ordinance.
A mobile home located on the property without the appropriate zoning permits.
To correct the violation the appropriate zoning permit must be applied for and approved or the mobile
home must be removed from the property. A additional investigation fee of one half the price of the
mobile home zoning permit fee will be added because a violation was issued.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
February 17, 1995, to correct this zoning violation. Failure to do so will result in this office scheduling
the violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's office for legal action.
