A (AGRICULTURAL) ZONE DISTRICT - KATHRYN WALLING AND J. HAMMERS
A public hearing was conducted on November 27, 1996, at 10:00 a.m., with the following present:

Commissioner Constance L. Harbert- EXCUSED
Commissioner W. H. Webster
Also present:

Planning Department representative, Todd Hodges
The following business was transacted:
I hereby certify that pursuant to a notice dated November 6, 1996, and duly published
November 14, 1996, in the South Weld Sun, a public hearing was conducted to consider the
request of Kathryn Walling and J. Hammers for a Site Specific Development Plan and Special
Review Permit for a dog training school and hobby kennel (maximum 20 dogs) in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Chair Pro-Tern Baxter explained there are only three Commissioners present and all three
votes are required for approval. Jeff Hammers, applicant, stated he would like to proceed today.
Todd Hodges, Planning Department representative, presented a brief summary of the proposal
indicating a maximum of 20 dogs will be allowed, all of which the applicants own. Mr. Hodges
noted the 2.09-acre site is near Ranch Eggs Subdivision and the majority of the surrounding
property is agricultural production. He stated the only facility proposed to be built is a potential bath
house. Mr. Hodges then entered the favorable recommendation of the Planning Commission into
the record as written. Mr. Hammers requested the Board's approval and stated they have lived on
the site for about eight years, with no complaints or problems. He confirmed his intent to comply
with all regulations. Mr. Hodges explained the use is existing and approval of this Permit will
correct the violation. He confirmed no concerns have been received from surrounding property
owners. Responding to the Board, Mr. Hammers stated they raise Skye Terriers and reiterated
they are eager to comply with all Conditions of Approval and Development Standards. He indicated
they would like to add a public restroom facility and noted they currently use a porta-potty. Mr.
Hammers explained the one-room school house is used for five to ten people, one to two hours at
a time. No public testimony was offered concerning this matter. Commissioner Hall moved to
approve the request of Kathryn Walling and J. Hammers for a Site Specific Development Plan and
Special Review Permit for a dog training school and hobby kennel (maximum 20 dogs) in the
A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record. The motion was seconded by Commissioner Webster, and it carried unanimously.
