WELD COUNTY HEALTH DEPARTMENT IN RE: Terry D. Bird & Dorothy May Bird ) 9477 S.H. 392 ) CEASE AND DESIST ORDER Windsor CO 80550 Respondent THIS MATTER came before the Weld County Health Officer, John Pickle pursuant to C. R. S. , Section 25-1-613 and Section 25-1.617 AND Weld County Ordinance No. 56, on April 10, 1998. The Respondent was present, proper notice having been served on him more than forty-eight hours prior to the hearing. Testimony was presented by Gary Hague of Environmental Protection Service, and Vickie Miller, Code Enforcement Officer for Windsor. The Health Officer, upon considering the statements of witnesses, having considered the reports herein, and being otherwise advised in the premises, DOTH FIND AND ORDER: 1. That the Respondent Terry D. Bird was properly served with a Certified Letter, giving notice of this hearing and has been adequately advised of the condition which is the subject of this hearing and more than 48 hours prior to the hearing. 2. That the Respondent Terry D. Bird is an owner and the occupant of a parcel of land in the Town of Windsor described as: 207 Oak St, Windsor Colorado legal description, Lot 4, Block 12, Kems subdivision. 3. That the Respondent Terry D. Bird has previously appeared before the Health Officer and represented that the nuisance conditions would be removed from the subject property 4. That the Respondent Terry D. Bird has created and continues to allow to exist a regularly reoccurring condition which is a nuisance. In particular, the Respondent Terry D. Bird has maintained a collection of materials including but not limited to: Old snowmobiles, deteriorated lumber, severely damaged garage doors, scrap automobile parts, old rusted bed springs, brush, accumulated leaves and grass clippings, dead sod, old tires, chunks of concrete, lawn mowers, old carpeting, rusted hot water heaters, damaged air conditioners, and run down out buildings. 5. The materials are stored in a manner which: (A) Create rodent harborage due to the amount of material and its haphazard and unorganized fashion of storage. This provides rodents with ample protection from the elements and safety from any would be predators. Since this property borders a back alley way, any rodents would have access to garbage cans from 1 981012 surrounding homes in the area. Numerous garbage cans from these dwellings are present in this neighborhood. B) The materials are unstable and in danger of collapse due to their haphazard and unorganized fashion of storage and the shear volume of materials C) The tires and other materials collect natural precipitation and create a breeding ground for mosquitos flies gnats and other insects which then infest adjacent properties 5. The Respondent has previously exhibited a pattern and practice of removing materials from the subject property when cited for violations only to return the junk and it is therefore found that the likelihood of reoccurrence of a nuisance conditions is sufficient to require this order to remain in place indefinitely even if the nuisance is temporarly abated. 6. The Respondent has failed to secure or post the property so that access is open to the public and costitutes an attractive nuisance an a safety hazard to the public. 7. The Director of Environmental Health Services has determined and the Public Health Officer concurs, that the threat to the public, health safety or welfare is so iminent that the delay incident to holding the hearing before the Weld County Board of Public Health at its next regularly scheduled meeting would further endanger the public THEREFORE, IT IS ORDERED that the Respondent cease and desist from the use of the property at 207 Oak St, Windsor Colorado legal description, Lot 4, Block 12, Kems subdivision, Windsor, Colorado, unless and until the nuisance conditions are removed from the property. It is further ordered that the nuisance conditions be abated within 15 days of the date of this Order. CO O D. .o 3 g ❑ DX P. 0 o a C a a g' 8 a Thank you for using Return Receipt Service, Chronological Synopsis of 207 Oak Street, Windsor Colorado Terry Bird Nuisance • As Reported by Gary Hague, Environmental Protection Specialist For Lee Morrison,County Attorney Prepared on May 1, 1998 This synopsis will attempt to establish the perpetual lack of compliance with Section 25-1-613 of the Colorado Revised Statutes, which addresses nuisance issues, on the property located at 207 Oak Street, Windsor, Colorado, owned by Terry Bird. This statute specifically states: "Removal of nuisances. The board of health shall examine all nuisances, sources of filth, and causes of sickness, which in its opinion, may be injurious to the health of the inhabitants, within its town, city or county...., and it shall destroy, remove, or prevent the same as the case may require." Files maintained by the Weld County Health Department date back to July of 1994. Documentation by the Windsor Police Department considerably predate this time, going back to 1986. The following history from health department files illustrates the history of non- compliance. (Exhibit B) 7-6-1994- Health Department receives complaint from a neighbor concerning a nuisance condition and the presence of rats. Investigation on 7-8-1994 revealed excellent harborage potential, but no evidence of rats was observed. However, the investigation did determine that the property was in violation of the nuisance ordinance. Mr. Bird was verbally warned of this violation and advised to compliance procedures. 7-27-1994- Mr. Bird is sent a letter informing him of the violations due to superficial progress. The letter granted 15 days of extra time for Mr. Bird to correct the problem. 8-15-1994- Follow up inspection as per letter dated 7-27-1994 revealed minor progress. Mr. Bird stated that if he was given an extension he would comply. A one week extension was granted. 8-22-1994- Follow up inspection to the date 8-15-1994 again revealed minor progress. Excessive amounts of dilapidated material remained. Mr. Bird is given another week to comply. 8-31-1994- Reinspection of the property reveals modest progress. Mr. Bird was informed that due to the lack of compliance a Health Officer hearing will be conducted. 9-6-1994- A letter is sent to Mr. Bird informing him of the Health Officer hearing date on 9-14- 1994. 9-14-1994- Prior to the hearing scheduled on this day, a follow up inspection was conducted to determine compliance. It was determined that minimal progress, if any had been achieved. 9-14-1994- The hearing is conducted before Weld County Health Officer, John Pickle. Mr. Pickle informs Mr. Bird that he must come into compliance or face further legal action by the department. Mr. Bird states that he will comply. A follow up inspection conducted after the hearing determined that Mr. Bird had achieved compliance. 1995-No incidents or complaints were recorded during this year. 4-29-1996- Health Department receives another complaint from a different neighbor concerning rats. 5-8-1996- Investigation reveals that the property is again in violation of the nuisance ordinance. It is determined that the property poses an excellent harborage and habitat for rodents. Upon inspection of the premise, no evidence of rats could be found. Mr. Bird again removes just enough dilapidated material to comply with ordinance. 1-14-97- Mr. Bird is brought before City of Windsor Municipal Court for violations of the city's nuisance ordinance. He is found guilty by the court and is fined. 3-25-1998 Health Department is informed by the City of Windsor that Mr. Bird has again fallen out of compliance. 3-27-1998- Inspection of the property reveals that excessive amounts of dilapidated material has again been accumulated. Several photographs were taken of the property. (Exhibit photographs A, D, E, & G) 3-30-1998- Same as above on 3-27-1998 with more photographs. 4-1-1998- Mr. Bird is again informed that a Health Officer hearing is scheduled on April 10, 1998. 4-3-1998 Follow up inspection reveals minor progress. Excessive amounts of junk and dilapidated material remain. 4-10-98 The Health Officer Hearing results in a cease and desist order against Mr. Bird for perpetual lack of compliance with nuisance ordinances. (Exhibit F) 4-20-98 Mr. Bird appeals the cease and desist order. The appeal results in the case coming before the Board of Weld County Commissioners. Scheduled date is May 6, 1998. (Exhibit C) 4-23-98 A visit is conducted at 207 Oak Street and 9477 Highway 392 properties with John Pickle, Director Weld County Health Department, Sharyn Frazer, Weld County Planning & Zoning Office, and Gary Hague, Weld County Health Department. Both properties were found to of compliance. Ms. Frazer informs John Pickle that the Planning & Zoning office will take regulatory action against Mr. Bird at his Highway 392 property. 4-27-98 A follow up inspection 207 Oak Street reveals the flowing: 1) Barbed wire underneath the last section of gate on the south side of the property provides a safety hazard in the event a small curious child should try to crawl under the gate. (Exhibit A photograph 1) 2) The wooden fence on the east side of the property is danger of collapse, due to deteriorated condition and lack of maintenance. 3) The chain link fence on the east side of the property can be easily climbed over by a curious child. 4) A section of wire fence along the east side of the property has sharp and pointed projections protruding from it. These projections are at approximately eye and face of level of the average adult. A tree has grown up through one of the squares in the fence due to years of neglect. 5) Large amounts of old lumber with protruding rusty nails still remain on the property. Rusty nails are excellent vehicles of Clostridium tetani, the agent of tetanus. 6) Not one of the out buildings have any locking doors and the windows are not boarded shut to prevent entry by curious children. (Exhibit A photographs 1-8) 7) Evidence of"shuffling" is evident. An old garden tiller, old carpeting, and old lumber have moved or "shuffled' about the property to give the impression that it has been removed. Addendum During this time frame the items and material that constitute the nuisance are of questionable value. Lists compiled by the City of Windsor and the Weld County Health Department include but are not limited to the following: Old snowmobiles, deteriorated lumber, severely damaged garage doors, scrap automobile parts, old , rusted bed springs, brush, accumulated leaves and grass clippings, dead sod, old tires, chunks of concrete, lawn mowers, old carpeting, rusted hot water heaters, damaged air conditioners, and run down out buildings. This property is in plain view of the public and during investigations neighbors have complained numerous times that the decrepit condition of the property annoys them, severely affects their property value and strains their quality of life. The complaints from neighbors concerning rats have thus far never been proven. However, due to the nocturnal nature of rodents, the excessive amount of material stored in the out buildings (which severely restricts a thorough search) and the ever present danger of injury from collapse of the dilapidated structure of the out buildings as well as the piles of material itself, efforts to determine actual rodent presence are hindered. For the record,the nuisance condition does provide an excellent harborage due to the amount of material and its haphazard and unorganized fashion of storage. This provides rodents with ample protection from the elements and safety from any would be predators. Since this property borders a back alley way, any rodents would have access to garbage cans from surrounding homes in the area. Numerous garbage cans from these dwellings are present in this neighborhood. The presence of large numbers of old tires and other vessels that collect water constitute a breeding ground for mosquitos and other disease carrying insects. The property is not posted or adequately secured against trespassers. The gate along the south side of the property does not close completely, thus allowing easy access for curious children. Mr. Bird has unequivocally stated numerous times over the years that he has uses for all this material. Examples include but are not limited to the following: 1. He has stated to me that he will make a green house out of the old coffin cooler stored in the back yard. This was four years ago, and this device has not moved since. 2. Mr. Bird has also told me that he would make a fence out of all the old bed springs. Again, this was four years ago, and the bed springs have not been used. Mr. Bird's reasons for storing all this material range from using it to build or cobble something together, that he does not have enough time complete his projects due to a hectic work schedule, and a meager budget and income. However, it may be pondered that if there exists any sincerity in these reasons, significant progress would have been made. When Mr. Bird is under regulatory pressure for compliance, it appears that he merely moves or"shuffles"the material around the property to give the impression that a substantial amount of work is being done. Mr. Bird also has a history of non-compliance with Weld County's non-commercial junk yard ordinance. MICHAELS \\\\\CO CHIEF OF POLICE \\\\C0L0�� April 09, 1998 Department of Health C/O Mr. Gary Hague 1517-16th Ave. Ct Greeley, Co. 80631 Dear Mr. Hague, After doing an intensive search of Mr. Terry Birds past history of Nuisance violations I found incidents that date back to June of 1986. The descriptions of the property in each of the incidents prove that the 207 Oak Street has not only been a nuisance but follow a pattern that exists each time that Mr. Bird faces impending regulatory action. In June of 1986 there is reference to : wood, and metal piles that a warning was issued for. June 7th, 1986 there was an inoperable vehicle and nuisance summons issued . On June 10th 1986 a supplement states that weeds had been mowed however there was still an inoperable vehicle , an appliance with a lid on it had been brought and left in the yard and the lumber was still in the yard. There was trailers that sat in the drive on the same date. On June 17th there were weeds noted over 3 feet tall, and the supplement states that there had been no progress made June 23rd a tall metal swing set bar was placed on one of the trailers. Weeds 5 to 6 ft tall were noted. Another cooking range had been added in the yard prior to the June 23rd inspection. The lumber and iron scraps were restacked. On August 26th there was another supplement. The supplement notes 5ft weeds, a Rambler that was wrecked and the plates expired. Piles of lumber piled against the shed in the middle of the lot. metal framing, wire fencing, pipe, wood debris. Wood doors and more lumber. August 28th it is noted that the rambler was removed and no other work accomplished. October I 0th,there is a supplement that refers to relocation of lumber. October 21 1986 report # 86-10-178 mentions 5 ft weeds, vehicle parts, a pick-up bed trailer filled, tires, bed springs, rusting metal, lumber, fencing wire, a cooking stove, tires, and foam padding. more wood house doors . In all the reports that accompany this letter it states either little progress, no progress, items moved around or added items to the yard. The Nuisance that exists is not a temporary problem, however it is an on going nuisance that has been in existence for up to, a period of 12 year . THIS BLOCKS THE VIEW FROM THE ALLEY OF THE VIOLATIONS INSIDE THE YARD. AS OF THE SAME DATE, THE VIOLATIONS IN THE ALLEY HAVE BEEN CORRECTED. 5-31-96 : I WAS FINALLY ABLE TO CATCH SOMEONE AT HOME AT THE PORTH RESIDENCE AT 201 OAK ST. THIS FAMILY HAS A CHAIN LINK FENCE AND A BALCONY WHICH AFFORD A FAIRLY CLEAR VIEW OF THE BACK YARD AT 207 OAK ST. I OBTAINED PERMISSION (WRITTEN) FROM MRS. PORTH TO VIEW AND PHOTOGRAPH MR. BIRDS PROPERTY. SEVERAL PHOTOS WERE TAKEN OF THE YARD. IT APPEARS THAT MR. BIRD HAS DONE SOME WORK AT REMOVING DEBRIS . MRS. PORTH REPORTED THAT SHE HAD SEEN THE CURRENT RENTERS OF. THE ADDRESS CLEANING UP THE YARD AS WELL. THERE STILL REMAIN, HOWEVER SEVERAL VIOLATIONS. THE PART OF THE YARD CLOSEST TO THE HOUSE IS MOSTLY CLEAR, WITH A FEW PIECES OF OLD LUMBER REMAINING. THE REAR OF THE PROPERTY STILL HAS SEVERAL CHAIN LINK GATES, MORE LUMBER, SECTIONS OF FENCING, AND SOME ITEMS I COULD NOT IDENTIFY. THE SHED AT THE REAR OF THE PROPERTY IS STILL SURROUNDED BY ITEMS AS FAR AS I CAN SEE FROM THE PORTH PROPERTY. PHOTOS SHOULD HELP TO IDENTIFY THESE THINGS . The investigation was in response to complaints received by the City of Windsor and the Weld County Health Department. The complaints alleged that the property was not maintained and presented a nuisance condition including possible rodent harborage. In addition, the complainant stated that rats had been observed on this property. The investigation revealed excessive debris stored on site which could harbor rodents. The debris consisted of, but is not limited to the following: old automobile components, (chassis, frames, engine parts, batteries), various building materials, (lumber, pipe, doors, cinder blocks), furniture and appliances, dilapidated shed that is heavily damaged, many old tires and pieces of scrap iron and several cut branches. These conditions provide an excellent habitat for rodent harborage. It is the opinion of the Weld County Health Department that this site constitutes a nuisance condition as described in Section 25-1-613, C. R. S. This was the day before Mr. Bird put up the new fence blocking public view of the back yard. I have not heard from Mr. Bird at this point. I went back and looked at my file, and we gave Terry 10 days from receipt of the certified letter I sent on May 6th. I received the card back saying that he had accepted the letter on the 17th of May. If the yard is not brought up to standard by the 27th, I will issue a citation for the violations that are left. I was advised by Chief Michaels that we should proceed in this manner (viewing the yard from the Porth's house) . I will let you know what happens from here. Upon arrival I spoke to Bill Foster who said earlier he heard his neighbor' s dog barking and went to see why it was barking. When he got there he saw a big rat in Bird' s property at 207 Oak. He got a bb gun and killed the rat. He said he wanted to complain because the property at 207 is a nuisance and health hazard. I went to 207 and spoke to T. Bird who was present. I advised him of the complaint. I went with him into the backyard of the property and found the dead rat. I also noticed tall weeds, in violation of the WMC. I also saw "tons" of junk and trash which Bird said his ex-tenants had eft behind. I told him I would forward the case to Ordinance Officer for follow—up. I have several pictures included with this report that show proof that the lot and out buildings/sheds on the 207 Oak street premises are very unimproved and should by the Ordinance sections and definitions mentioned above as a Nuisance the public. After reading the Uniforn Housing Codes Book in the Nuisance section on page 401 Chapter 4 under Definitions sentence 2 that states : Any attractive nuisance which may prove detrimental to children whether in a building, on the premises of a building, or on an un occupied lot. This includes any abandoned wells, shafts, basements or excavations; abandoned refrigerators and motor vehicles; or any unsound fences or structures; or any lumber, trash, fences, debris or vegetation which may prove a hazard for inquisitive minors . I decided that there might be violations that the building inspectors office might be interested in. I asked for permission to contact the Building Inspectors office from Chief Michaels and he did give me permission to contact the Building inspector. I called and left a message with their office and got a return phone call from Russ Weber. We went to the the area of 207 Oak st Address and after I pointed out the OFFICER/BADGE DATE APPROVED BY WINDSOR POLICE DEPARTMENT CASE-NUMBER INCIDENT REPORT 98-0704 NARRATIVE Shed near the rear or the most southern placed shed on the property and the carpet laying against the east side of the house where it is believed that there is a hole next to the foundation to access the plumming of the house that it is believed that has been under the car- pet for at least one year. The neighbor Isabel Porth and the nett/ Hague from the Health department both advised me that there is an existing hole that was dug to have access to the plumbing of the house. The hole was not filled in but there was the carpet placed over the hole. This is not known as fact however kccausethere is reason to believe that the hole has never been covered Building Inspector Russ Weber stated that he wished to have access to the property to further investigate for damage to the house and to do an intense search to make sure that there is no violations . I typed a permission to gain access to the property at 207 Oak Street after knocking on the door and asking the tenant for permission to look around the premises . The Tenant declined saying that the property was not hers and she'd prefer that I contact Terry Bird. I attempted to catch terry at a Chestnut Street house that I knew that he was working at. Terry was not there. I then went to the address on Highway 392 that Terry resides and there was no answer. I went back to the Hwy 392 address the next day in tthe morning of 03-26-98 hoping to contact Terry, there was no answer again. I went back in the late afternoon once again to attempt contact and there was no answer at the door, however there was a vehicle in the driveway that had not previously been in the driveway (a smaller dk blue vehicle) . I then called and left a message for Mr. Bird to contact me at the Police Department with his wife just before my shift ended. Mrs . I thought that it would be a good idea to go into work early on 03-27-98 to attempt contact once again with Mr. Bird. On the way to my vehicle from the Police Department I noticed Mr Bird In the South parking area of the Park Building. I went over to Mr.Bird and started to speak to Mr. Bird. I asked Mr. Bird if he would sign a permission statement so that I and the Building Inspector could gain access to the 207 Oak Street premises . Mr Bird did not sign the statement that accompanies this report. Mr. Bird did stated that he would allow each of us, the Building inspector and I on the premises at his convenience and at seperate times . I was then told not to visit, call or send any mail to his house at the 9477 HWY 392 because it upsets his wife. I asked Mr.Bird where I could send the 10 day letter that I legally have to send to him. He did not answer me . Terry then advised me that he believes that I do my job too zealously. He advised that at that time he had to leave because I "pissed" him off and he couldn ' t continue our conversation. I did advise that i still had to send him a 10 day letter before our conversation ended. Because I did not get the 10 day letter finished in time to send it out with the mail from the Police Department I asked Dispatcher Sylvia to have the letter stamped I then took the letter to the post office and mailed it with the 9477 HWY 392 address on the envelope . A copy of the letter is also with this report and was written and mailed on 03-27-98 . The list that was sent with the letter asks that all tree trimmings, broken branches hanging from trees, brush, twigs and leaves be remove from the premises . That Mr. Bird Repair / or store the inoperable vehicles and update the plates on the Vehicle in the driveway, a white chevy truck OFFICER/BADGE DATE APPROVED BY WINDSOR POLICE DEPARTMENT CASE-NUMBER INCIDENT REPORT 98-0704 NARRATIVE with Colorado Lisence Plate# 1JS444 . The Chevy truck in the driveway will not run and it is very evident because the radiator is missing and because the grill is also off you can see that the radiator is not in the vehicle. The flat bed truck a 1935 ford truck is also in question of being inoperable because the vehicle has not been moved from the spot that Mr. Bird had a tow truck driver put it since about the 5th month of 1997 . The ordinance that these vehicles are in violation of is Article III Abandoned and Inoperable Vehicles Section 8-41 (2 ) and in the case that the vehicles are inoperable the violation falls into 8-41 ( 3 ) no vehicle shall be deemed inoperable under this section if said vehicle is stored in a fully enclosed garage or simuilar structure on private property. Both Vehicles sit in full view of the public and are suspected of not being able to move under their own power, and one of them fail to display current plates . I also requested that Terry remove all rejected matter, all debris, and rubbish from the premises . Rid the property of all junk and any worthless matter or material and remove all damaged merchandise. The pictures that are with this report show items that. . have either sat idle (without being moved) for several months to years appear to be worn out, A tree that has grown up through a vehicle tire . items that appear weathered and very used and damaged. 03-30-98 I went over to the 207 Oak Street address to take pictures of the current statis of the property. I odserved that an apparent attempt of relocating and removal of a minute portion of the debris . This behavior always manifests itself when Mr. Bird faces impending regulatory action. OFFICER/BADGE DATE APPROVED BY WINDSOR POLICE DEPARTMENT CASE-NUMBER INCIDENT REPORT NARRATIVE Examples of this behavior include but are not limited to the following 1 )The carpet that was on the east side of the house has been relocated to an area south of the house now exposing the foundation to the elements, which reveals the plumbing, the undercarriage of the house, and possible attraction for curious adolesence to enter. 2 ) the large White and orange coffin cooler that has been in the yard since at least august of 1994 . 3 ) the rim that sits on the delapitated storage shed in the most southern section of the back yard. 4) the white stove that sits near the rear of the house. the items above are part of photographic evidence that has been accumulated in both the past and present photographs . Both the Building inspector and Gary Hague have been notified of the existing nuisance at the 207 Oak st address . S. , Section 25-1-613 and Section 25-1-617 AND Weld County Ordinance No. 56, on April 10, 1998. The Respondent was present, proper notice having been served on him more than forty- eight hours prior to the hearing. Testimony was presented by Gary Hague of Environmental Protection Service, and Vickie Miller, Code Enforcement Officer for Windsor. The Health Officer, upon considering the statements of witnesses, having considered the reports herein, and being otherwise advised in the premises, DOTH FIND AND ORDER: 1. That the Respondent Terry D. Bird was properly served with a Certified Letter, giving notice of this hearing and has been adequately advised of the condition which is the subject of this hearing and more than 48 hours prior to the hearing. 2. That the Respondent Terry D. Bird is an owner and the occupant of a parcel of land in the Town of Windsor described as: 207 Oak St, Windsor Colorado legal description, Lot 4, Block 12, Kerns subdivision. 3. That the Respondent Terry D. Bird has previously appeared before the Health Officer and represented that the nuisance conditions would be removed from the subject property 4. That the Respondent Terry D. Bird has created and continues to allow to exist a regularly reoccurring condition which is a nuisance. In particular, the Respondent Terry D. Bird has maintained a collection of materials including but not limited to: Old snowmobiles, deteriorated lumber, severely damaged garage doors, scrap automobile parts, old rusted bed springs, brush, accumulated leaves and grass clippings, dead sod, old tires, chunks of concrete, lawn mowers, old carpeting, rusted hot water heaters, damaged air conditioners, and run down out buildings. 5. The materials are stored in a manner which: 1 Signed 4-10-98 (A) Create rodent harborage due to the amount of material and its haphazard and unorganized fashion of storage. This provides rodents with ample protection from the elements and safety from any would be predators. Since this property borders a back alley way, any rodents would have access to garbage cans from surrounding homes in the area. Numerous garbage cans from these dwellings are present in this neighborhood. B) The materials are unstable and in danger of collapse due to their haphazard and unorganized fashion of storage and the shear volume of materials C) The tires and other materials collect natural precipitation and create a breeding ground for mosquitos flies gnats and other insects which then infest adjacent properties 5. The Respondent has previously exhibited a pattern and practice of removing materials from the subject property when cited for violations only to return the junk and it is therefore found that the likelihood of reoccurrence of a nuisance conditions is sufficient to require this order to remain in place indefinitely even if the nuisance is temporarly abated. 6. The Respondent has failed to secure or post the property so that access is open to the public and costitutes an attractive nuisance an a safety hazard to the public. 7. The Director of Environmental Health Services has determined and the Public Health Officer concurs, that the threat to the public, health safety or welfare is so iminent that the delay incident to holding the hearing before the Weld County Board of Public Health at its next regularly scheduled meeting would further endanger the public THEREFORE, IT IS ORDERED that the Respondent cease and desist from the use of the property at 207 Oak St, Windsor Colorado legal description, Lot 4, Block 12, Kerns subdivision, Windsor, Colorado, unless and until the nuisance conditions are removed from the property. It is further ordered that the nuisance conditions be abated within 15 days of the date of this Order. IT IS FURTHER ORDERED, that this order remain in effect unless ordered vacated by the Director of Weld County Department of Health even if temporarily abated due to the history of recurrence. This appeal triggers a hearing pursuant to the General Procedures for Adjudicatory Hearings ("Procedures") which hearing date should be set by the Board at its meeting of April 20, 1998. The authority for the appeal is found at Article III § 3-8 of the Home Rule Charter and Ordinance 56. The Procedures provide for new presentation of evidence by the Health Department and Mr. Bird not simply a review of the record of the evidence. Mr. Bird needs to be mailed certified notice of the hearing at least 10 days prior or served with a notice at least 7 days prior.
