Box 100 Panel Affected: 0001 D Erie, Colorado 80516 Effective Date of This Revision: MAY 24 1996 102-1-A-C Dear Mayor Smith: This is in response to a request for a revision to the effective Flood Insurance Study (FIS) and National Flood Insurance Program (NFIP) map for your community. Specifically, this responds to a letter dated April 4, 1996, from Mr. David P. Krickbaum, P.E., Project Manager, WRC Engineering, Inc., regarding the effective FIS report and Flood Insurance Rate Map (FIRM) for the Town of Erie, Colorado. Mr. Krickbaum requested that the Federal Emergency Management Agency (FEMA) revise the effective FIRM to show the effects of the construction of levees and channelization along Coal Creek from approximately 3,600 feet downstream of the Union Pacific Railroad (UPRR) to approximately 600 feet upstream of the UPRR. All data required to complete our review of this request were submitted with Mr. Krickbaum's April 4 letter. Because this Letter of Map Revision (LOMR) shows the effects of a publicly sponsored flood- control project that reduces flooding to existing development, fees were not assessed for the review. We have completed our review of the submitted data and the flood data shown on the effective FIRM, and have revised the FIRM to modify the elevations, tloodplain and floodway boundary delineations, and zone designations of a flood having a I-percent chance of being equaled or exceeded in any given year (base flood) along Coal Creek from approximately 5,700 feet downstream of the UPRR to the UPRR, at the corporate limits of the Town of Erie. As a result of this project, the base flood and floodway are contained within the channel from approximately 2,750 feet downstream of the UPRR to the UPRR. The flooding associated with the West Line Overflow through the Town has been eliminated. The width of the Special Flood Hazard Area (SFHA), the area inundated by the base flood, decreased along the entire revised reach. The maximum decrease in SFHA width, approximately 1,300 feet, occurred approximately 1,000 feet downstream of the UPRR. The base flood elevations (BFEs)decreased along the revised reach. The maximum decrease in BFE, approximately 2.2 feet, occurred approximately 600 feet downstream of the UPRR. The results of an interior drainage analysis show that local runoff from the Town will pond in a low area along Lower Boulder Ditch. That ponded area is bounded to the west by Holbrook Street, to the south by Cheesman Street, and to the east by Kattel Street. b°\0 °1°lb\°I69 CC ; PL cru ) 4�C�c'4) 961018 2 The modifications are shown on the enclosed annotated copies of FIRM Panel 0001 D, Profile Panel 01P, and the Floodway Data Table for Coal Creek. This LOMR hereby revises this panel of the effective FIRM and the Flood Profile and Floodway Data Table in the FIS report. both dated September 28, 1990. A copy of this notification is enclosed. Any request for reconsideration must be based on scientific or technical data. In addition, a notice of changes will be published in the Federal Register. Because this LOMR will not be printed and distributed to primary users, such as local insurance agents and mortgage lenders, your community will serve as a repository for these new data. We encourage you to disseminate the information reflected by this LOMR throughout the community, so that interested persons, such as property owners, local insurance agents, and mortgage lenders, may benefit from the information. We also encourage you to prepare a related article for publication in your community's local newspaper. This article should describe the assistance that officials of your community will give to interested persons by providing these data and interpreting the NFIP maps. Based on the modifications described above, the existing structures at 280 Evans Street, 365 Evans Street, 795 Briggs Street, 123 Cheesman Street, and 750 Pierce Street as shown on the topographic work map entitled "Figure 4 - Sheet 6A of 6," prepared by WRC Engineering, Inc., dated May 1995, would not be inundated by the base flood and are outside the SFHA. The structures are in Zone X (shaded), an area of moderate flooding outside the SFHA. If any current flood insurance policy issued under the NFIP covers a structure on this property and that policy was required by the mortgage company in conjunction with Federal flood insurance requirements, then flood insurance coverage is no longer required under the NFIP. Accordingly, if a lender imposed the flood insurance requirement, that lender will have to determine whether or not to continue that requirement. The lender may determine, as a business decision, that it wishes to continue the flood insurance requirement in order to protect its collateral security on the loan. If the lender decides to release the borrower from the flood insurance requirement, and the insured decides to cancel the policy and seek a refund for the current policy year, the insured must obtain a written waiver of the flood insurance requirement from the lender to provide to the property insurance agent or company that is servicing their policy. The agent or company will then process the refund request for the insured. 3 Even though these structures are not included in an SFHA, they could be inundated by a flooding event of greater magnitude than the base tlood. In fact, more than 25 percent of all losses in the NFIP occur to structures located outside the SFHA in Zones B, C, or X. More than 25 percent of all policies purchased under the NFIP protect structures located in these zones. This clearly illustrates that there is a risk of flooding in non-SFHAs. That risk is just not as great as the flood risk to structures located in SFHAs. To offer flood insurance protection to owners of such structures, the NFIP offers two types of flood insurance. Property owners should discuss their individual flood risk situation and insurance needs with their insurance agent or company before making a final decision regarding flood insurance coverage. The revisions are effective as of the date of this letter; however, within 90 days of the second publication in the Longmont Daily Times-Call, a citizen may request that FEMA reconsider the determination made by this LOMR. Any request for reconsideration must be based on scientific or technical data. All interested parties are on notice that,until the 90-day period elapses, the determination to modify the BFEs presented in this LOMR may itself be modified. Due to present funding constraints, we must limit the number of physical map revisions processed. Consequently, we will not republish the FIRM and FIS report for your community to reflect the modifications described in this LOMR at this time. However, when changes to FIRM Panel 0001 D and the FIS report for your community warrant a physical revision and republication in the future, we will incorporate the modifications described in this LOMR at that time. The floodway is provided to your community as a tool to regulate tloodplain development. Therefore, the floodway modifications described in this letter, while acceptable to FEMA, must also be acceptable to your community and adopted by appropriate community action, as specified in Paragraph 60.3(d) of the NFIP regulations. A separate LOMR was issued on the same date as this LOMR to describe the effects of this project on the unincorporated areas of Weld County, Colorado. This response to Mr. Krickbaum's request is based on minimum floodplain management criteria established under the NFIP. Your community is responsible for approving all tloodplain development, including this request, and for ensuring that necessary permits required by Federal or State law have been received. With knowledge of local conditions and in the interest of safety, State and community officials may set higher standards for construction, or may limit development in floodplain areas. If the State of Colorado or your community has adopted more restrictive or comprehensive floodplain management criteria, these criteria take precedence. The basis of this LOMR is, in whole or in part, a channel-modification/culvert project. NFIP regulations, as cited in Paragraph 60.3(b)(7), require that communities assure that the flood-carrying capacity within the altered or relocated portion of any watercourse is maintained. This provision is incorporated into your community's existing floodplain management regulations. Consequently, the ultimate responsibility for maintenance of the channel modification/culvert rests with your community. The map panel as listed above and as revised by this letter will be used for all flood insurance policies and renewals issued for your community. 4 This determination has been made pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93-234) and is in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, Public Law 90-448), 42 U.S.C. 4001- 4128, and 44 CFR Part 65. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management regulations that meet or exceed minimum NFIP criteria. These criteria are the minimum and do not supersede any State or local requirements of a more stringent nature. This includes adoption of the effective FIRM to which the regulations apply and the modifications described in this LOMR. Our records show that your community has met this requirement. A Consultation Coordination Officer (CCO) has been designated to assist your community. The CCO will be the primary liaison between your community and FEMA. CHANGES ARE MADE IN DETERMINATIONS OF BASE FLOOD ELEVATIONS FOR THE TOWN OF ERIE, BOULDER AND WELD COUNTIES, COLORADO, UNDER THE NATIONAL FLOOD INSURANCE PROGRAM On September 28, 1990, the Federal Emergency Management Agency (FEMA) identified Special Flood Hazard Areas (SFHAs) in the Town of Erie, Boulder and Weld Counties, Colorado, through issuance of a Flood Insurance Rate Map (FIRM). The Mitigation Directorate has determined that modification of the elevations of the flood having a 1-percent chance of being equaled or exceeded in any given year (base flood) for certain locations in the Town of Erie is appropriate. The modified base flood elevations (BFEs) revise the FEMA FIRM for the community. The changes are being made pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public Law 93-234) and are in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, Public Law 90-448), 42 U.S.C. 4001- 4128, and 44 CFR Part 65. A hydraulic analysis was performed to incorporate the effects of construction of levees and channelization along Coal Creek, and has resulted in a revised delineation of the regulatory floodway, a reduction in SFHA, and lower BFEs from approximately 4,700 feet downstream of Perry Street to Perry Street, which is approximately 450 feet downstream of the Union Pacific Railroad (UPRR). The aforementioned channelized portion of Coal Creek contains the base flood. For the community to participate in the National Flood Insurance Program (NFIP), the community must use the modified BFEs to administer the floodplain management measures of the NFIP. These modified BFEs will also be used to calculate the appropriate flood insurance premium rates for new buildings and their contents and for the second layer of insurance on existing buildings and contents. Upon the second publication of notice of these changes in this newspaper, any person has 90 days in which he or she can request, through the Chief Executive Officer of the community,that the Mitigation Directorate reconsider the determination. Any request for reconsideration must be based on knowledge of changed conditions or new scientific or technical data. All interested parties are on notice that until the 90-day period elapses, the Mitigation Directorate's determination to modify the BFEs may itself be changed.
