RESOLUTION
RE: APPROVE VACATION OF RECORDED EXEMPTION #631 - CECIL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated September 12, 1983, the Board did approve Recorded
Exemption #631, creating parcels of .64 acres and .56 acres, more or less, and
WHEREAS, said property is located in the NW 1/4, SW 1/4 of Section 36, Township 6
North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described
as Lots A and B of Recorded Exemption #631, and
WHEREAS, the Board has received a request from Vernon Cecil, 3455 F Street, Greeley,
Colorado 80631, to vacate said Recorded Exemption #631, which was recorded September 19,
1983, at Book 1007, Reception #01940782, in the records of the Weld County Clerk and Recorder,
and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Recorded Exemption #631 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by the
following vote on the 29th day of March, A.D., 1995.

Subject: Vacation of RE -631 being part of the NW4, SW4 of Section 36, T6N, R66W of the 6th P.M., Weld
County, Colorado
Dear Commissioners:
On September 12, 1983, the Board of County Commissioners approved a recorded exemption on a piece of
property located in the NW4, SW4 of Section 36, T6N, R66W of the 6th P.M., Weld County, Colorado. RE-
631 split the property into two parcels of .64 acres and .56 acres, more or less. The present property owner,
Vernon Cecil, in his March 25, 1995, letter, is now requesting that the recorded exemption be vacated. The
applicant stated in his letter that he is wishing to expand his business through the two designated lots. By
vacating the lot line and creating one lot the applicant will be able to proceed with the expansion.
The planning staff request that the Board accept this request and vacate RE -631. The applicant shall record
a new deed with the Weld County Clerk and Recorder to show the property as one. The applicant shall
provide the Department of Planning Services with a copy of this deed within 30 days of approval.

To Whom It May Concern:
We own the property at 3455 F Street. This property is divided into two parcels --- Lot
A & Lot B and was owned by separate parties when the improvements were built. We
now own both lots. The two properties are separated only by a common fire wall. One
of the existing tenants would like to expand his operation. To facilitate this we need to
put an opening between the two units. We will cross through the two designated lots.
We need to vacate the lot line and create one lot. We would like to proceed with this as
soon as possible.

RE: APPROVAL OF CORRECTED RESOLUTION CONCERNING RECORDED EXEMPTION
NO. 631 - PLATTE VALLEY INVESTMENT COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners did approve Re-
corded
Exemption No. 631 for Platte Valley Investment Company, k,
and
WHEREAS, on the original Resolution for the approval of said
Recorded Exemption No. 631 two of the conditions were inadvertently
omitted, and
WHEREAS, the conditions required for approval of said Recorded
Exemption No. 631 should read as follows:
1. The applicant shall submit a mylar plat to the Department
of Planning Services Office to be recorded in the office
of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C.(4)
of the Weld County Subdivision Regulations. The plat
shall be submitted within 90 days from the date of approval
by the Board.
2. The recorded plat shall show a reservation of an additional
twenty (20) feet of right-of-way north of the centerline
of "F" Street. The total right-of-way north of "F" Street
shall be fifty (50) feet as requested by the Greeley
Planning Commission in a letter dated August 26, 1983.
3. The proposed Lot A and Lot 8 shall have one common access
easement as requested by the Greeley Planning Commission
in a letter dated August 26, 1983. The common access
easement shall be shown on the recorded plat.
WHEREAS, the Board deems it advisable to approve the Corrected
Resolution to include the two conditions which were omitted from
the original Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Corrected Resolution
to include the conditions, concerning Recorded Exemption No. 631
for Platte Valley Investment Company be, and hereby is, approved.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Platte Valley Investment Company for a recorded exemption.
The parcel of land on which this request is being made is described as
part of the Northwest 1/4, Southwest 1/4, Section 36, Township 6 North,
Range 66 west of the 6th P.M., Weld County, Colorado.
The property is located just north of Greeley, east of 35th Avenue and
north of "F" Street. The property contains approximately 1.2 acres of

Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:

Regulations as follows:

- The 1.2 acres, more or less, under consideration will be
compatible with surrounding land uses and future development
of the area.
The proposal is consistent with the intent of the district
in which the use is located.
The proposal was reviewed by the City of Greeley and was found
to comply with their long-range Comprehensive Plan.
The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land division
complies with the Weld County Comprehensive Plan, therefore,
the proposed use is consistent with efficient and orderly
development.
The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The City of Greeley presently provides both water and sewer
service.
- The proposed lots are not part of a recorded exemption within
the last five (5) years.
The two lots proposed will have adequate access from "F" Street.
The Department of Planning Services Staff's recommendation for approval is
