HomeMy WebLinkAbout950595.tiffpg2432B39 RESOLUTION RE: APPROVE VACATION OF RECORDED EXEMPTION #631 - CECIL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated September 12, 1983, the Board did approve Recorded Exemption #631, creating parcels of .64 acres and .56 acres, more or less, and WHEREAS, said property is located in the NW 1/4, SW 1/4 of Section 36, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described as Lots A and B of Recorded Exemption #631, and WHEREAS, the Board has received a request from Vernon Cecil, 3455 F Street, Greeley, Colorado 80631, to vacate said Recorded Exemption #631, which was recorded September 19, 1983, at Book 1007, Reception #01940782, in the records of the Weld County Clerk and Recorder, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Recorded Exemption #631 be, and hereby is, vacated. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 29th day of March, A.D., 1995. RE- 631 split the property into two parcels of .64 acres and .56 acres, more or less. The present property owner, Vernon Cecil, in his March 25, 1995, letter, is now requesting that the recorded exemption be vacated. The applicant stated in his letter that he is wishing to expand his business through the two designated lots. By vacating the lot line and creating one lot the applicant will be able to proceed with the expansion. The planning staff request that the Board accept this request and vacate RE -631. The applicant shall record a new deed with the Weld County Clerk and Recorder to show the property as one. The applicant shall provide the Department of Planning Services with a copy of this deed within 30 days of approval. Respectfully submitted, Shani L. This property is divided into two parcels --- Lot A & Lot B and was owned by separate parties when the improvements were built. We now own both lots. The two properties are separated only by a common fire wall. One of the existing tenants would like to expand his operation. To facilitate this we need to put an opening between the two units. The applicant shall submit a mylar plat to the Department of Planning Services Office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C.(4) of the Weld County Subdivision Regulations. The plat shall be submitted within 90 days from the date of approval by the Board. 2. The recorded plat shall show a reservation of an additional twenty (20) feet of right-of-way north of the centerline of "F" Street. The total right-of-way north of "F" Street shall be fifty (50) feet as requested by the Greeley Planning Commission in a letter dated August 26, 1983. 3. The proposed Lot A and Lot 8 shall have one common access easement as requested by the Greeley Planning Commission in a letter dated August 26, 1983. The common access easement shall be shown on the recorded plat. WHEREAS, the Board deems it advisable to approve the Corrected Resolution to include the two conditions which were omitted from the original Resolution. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1.
