Subject: USR-1069 and question of non -conforming use on property described as Lots A and B of RE -
1119, located in the E/2, SW/4 of Section 4, T5N, R64W and a portion of property located in the NW/4
of Section 9, T5N, R64W of the 6th P.M., Weld County, Colorado.
Dear Mr. Lind:
Thank you for your letter of December 28, 1994. Department of Planning Services' staff reviewed your
letter along with the file for USR-1069, the file for RE -I119, and the Weld County Zoning Ordinance.
Staff determined that the potential for establishing a non -conforming use on the property, as described
above, ceased at the time that RE -1119 was approved. Staff based this determination on the fact that the
use of the property greatly increased with the reduction of acreage at the time of RE -1119. The feeding
operation previously existed on an eighty (80) acre parcel but was reduced to a nine (9) acre parcel at the
time of RE -1119, thus greatly increasing the uses on the property. Section 73.1.1 of the Weld County
Zoning Ordinance states: No such non -conforming use shall be enlarged or increased, nor extended to
occupy a greater area of land than was occupied at the effective date of adoption or amendment of this
Ordinance without first having received a Special Review Permit pursuant to the procedure established
in Section 24.
The operation of a feedlot with densities that exceed the maximum animal units allowed per acre in the
A (Agricultural) zone would require the submittal, review, approval, and all conditions met of a Use by
Special Review application as provided for in Section 31.4.2 of the Weld County Zoning Ordinance.

70 Non -Conforming Lots, Uses, and Structures
71 Intent. Within the zoning districts established by this Ordinance
or amendments thereto, there exist LOTS, STRUCTURES. USES of land
or STRUCTURES, and characteristics of USE which were lawful before
zoning regulations were passed or amended, but which would be
prohibited, regulated, or restricted under the terms of this
Ordinance or future amendment. It is the intent of this Ordinance
to permit these non -conformities to continue until they are
removed or abandoned, but not to encourage their survival. It is
further the intent of this Ordinance that non -conformities shall
not be enlarged upon, expanded or extended, nor be used as
justification for adding other STRUCTURES or USES prohibited
elsewhere in the same zoning district. Non- conforming USES are
declared by this Ordinance to be incompatible with permitted USES
in the zoning districts involved.
72 Non -Conforming Lots. In any district in which SINGLE FAMILY
DWELLINGS are permitted, a SINGLE FAMILY DWELLING and customary
accessory STRUCTURES may be erected on any single LEGAL LOT,
notwithstanding limitations imposed by other provisions of this
Ordinance. This provision shall apply even though such LOT fails
to -meet -the -requirements for LOT area that'are applicable.:--in_the '__ __`
zoning district, provided that Bulk_ Requirements other thanthose
-'which :apply' -to LOT:area shall be met. Variance of Bulk":',
Requirements shall be obtained only through action of the Board Of
Adjustment.
Non -Conforming Uses of Land. Where at the time of passage of this
Ordinance, or of passage of future. amendments of this Ordinance,
a lawful USE of land exists which would not be permitted by the
regulations imposed by this Ordinance or future amendment, the USE
may be continued so long as it remains otherwise lawful provided
the following conditions are met:
73.1 Extension or expansion.
73.1.1 No such non -conforming USE shall be enlarged or
increased, nor extended to occupy a greater area
of land than was occupied at the effective date of
adoption or amendment of this Ordinance without
first having received a Special Review Permit
pursuant to the procedure established in Section
24.

73.3 Abandonment. If any such non -conforming USE of land ceases for
any reason for a period of more than six (6) months, any -
subsequent USE of such LOT or parcel shall conform to the
regulations specified by this Ordinance for the zoning district in
which such LOT or parcel is located.
74 Non -Conforming Structures. Where a lawful STRUCTURE exists at the
effective date of adoption or amendment of this Ordinance that
could not be be built under the terms of this Ordinance by reason,
of restrictions on area, LOT coverage, height, its location on the
LOT, or other requirements concerning the STRUCTURE, such
STRUCTURE may continue to exist so long as it remains otherwise
lawful, subject to the following provisions:

74.1 Repair and Restoration. Should such nonconforming STRUCTURE or
non -conforming portion of a STRUCTURE be destroyed by any means to
an extent more than fifty percent (50:) of its replacement cost at
time of destruction, it shall not be restored except in
conformance with the provisions of this Ordinance. Ordinary
repairs the value of which do not exceed fifty percent (50:) of
replacement cost of the STRUCTURE may be permitted.
74.2 Expansion or enlargement. No such non -conforming STRUCTURE or
non -conforming portion of a STRUCTURE may be expanded, enlarged or
altered in a way which increases its non -conformity, except that
those STRUCTURE(S) that are non -conforming by reason of non-
compliance with existing SETBACK requirements may be expanded or
enlarged so long as such expansion or enlargement does not further
diminish the non -conforming SETBACK. No expansion or enlargement
of STRUCTURE(S) shall be allowed within an existing right-of-way.
74.3 Substitution of STRUCTURES. Should such non- conforming STRUCTURE
be moved for any reason, for any distance whatever, it shall
thereafter conform to the regulations for the zoning district in
which it is located after it is moved.
74.4 Existing Building Permits. To avoid undue hardship,_ nothing in
this Ordinance shall be deemed to;require a change`in the plans or
construction of any STRUCTURE onwhich actual construction was."

amendment of this Ordinance and upon which actual construction has
been carried on diligently. Actual construction is hereby defined
to include the placing of construction materials in permanent
position and fastened in a permanent manner. Where excavation or
demolition or removal of an existing STRUCTURE has begun
preparatory to construction, such excavation, demolition or
removal shall be deemed to be actual construction provided a
building permit for the new STRUCTURE- has:beenissued .and the,
preparatory work is carried on diligently.
75 Non -Conforming Uses of Structures. If a lawful USE of a STRUCTURE
or ST".UCTURE and premises in combination exists on the effective
date of adoption or amendment of this Ordinance that would not be
allowed in the zoning district under the terms of this Ordinance,
the USE of such STRUCTURE or STRUCTURE and premises may be
continued so long as it remains otherwise lawful, subject to the
following provisions:

not permitted by this Ordinance in the zoning district in which it
is located which is destroyed by any means to an extent greater

destruction shall not be restored except to gain conformance with
all provisions of this Ordinance. The non -conforming USE may not
be re-established after restoration. Ordinary repairs, the value
of which do not exceed fifty percent (50:) of replacement cost of
the STRUCTURE may be permitted.
75.2 Expansion or Enlargement

any parts of a STRUCTURE which were manifestly
arranged or designed for such USE at the time of
adoption or amendment of this Ordinance, but no
such USE shall be extended to occupy any land
outside such STRUCTURE without first having
received a Special Review Permit pursuant to the
procedures established in Section 24.
A non -conforming USE shall not be extended or
enlarged after adoption or amendment of this
Ordinance by erection or attachment of additional
SIGNS intended to be seen off the premises, or by
the addition of .other USES. which would be
prohibited in the zoning district. involved.
No such non -conforming USE shall be moved in whole
or in part to any portion of the LOT or parcel
other than that occupied by such USE on the
effective date of adoption or amendment of this
Ordinance.
75.3 Substitution of USES
75.3.1 A non -conforming USE may, as a Use by Special
Review, .be.changed to another USE which does not
conform to the USES allowed in the zoning.

75.3.2 Whenever a non -conforming USE is replaced by a
permitted USE the non -conforming USE may not be
re-established. The permitted USE shall
thereafter conform to the provisions of this
Ordinance.
75.4 Abandonment. When a non -conforming USE of a STRUCTURE or
STRUCTURE and premises is discontinued or abandoned for any reason
for a period of more than one (1) year. any subsequent USE of such
STRUCTURE or STRUCTURE and premises shall conform to the
regulations specified by this Ordinance for the zoning district in
which such STRUCTURE or STRUCTURE and premises is located.

76 Uses Allowed by Special Review Permit are not Non -Conforming Uses.
76.1 Any USE which lawfully exists at the time of adoption of this
Zoning Ordinance and, as a result of an amendment to the map of
the Zoning Ordinance (pursuant to Section 21). which would require
a Special Review Permit in the zone district in which it is
located under the provisions of this Zoning Ordinance shall not be
deemed a non -conforming use, but shall, without further action, be
considered as having received a Special Review Permit and may be
continued with all rights and privileges under the provisions of
this Zoning Ordinance. The Planning Commission -may-authorize
development standards for any such Special Review Permit to insure
continuity of the operation and continuity of any prior conditions
to which the operation may have been subject. However, no such
USE may be expanded, or enlarged without first obtaining a Special
Review Permit in accordance with the requirements of this Zoning
Ordinance.

The purpose of this letter is to advise you that our firm has
been retained by John Wardlaw for representation at the County
Commissioner's hearing concerning the above -referenced USR. Please
contact this office with proposed dates for the hearing„so that we•
ea.,r
can clear those dates on our calendar.
The further purpose of this letter is to respond to your
letter dated August 24, 1994 which concerns the above -referenced
Use by Special Review and an earlier request to establish a non-
conforming use. We have reviewed your letter of August 24, 1994
and, we must frankly admit that we are confused.
Referring to Recorded Exemption 1119, you indicate that there
was no indication of a feed lot on the property and no information
was submitted about a feed lot. Also, a field check did not
indicate the existence of a feed lot, and the Weld County Assessor
did not indicate a feed lot located on this property until 1991.
You further requested submission of any additional information and,
for whatever reason, the Wardlaws did not submit this information.
This then resulted in the USR application, and it is necessary that
we respond to your letter of August 24, 1994 to explain the purpose
of the USR application.
First, enclosed please find a copy of a letter dated -September,
30, 1994 concerning your reference to the records of the Weld
County Assessor. This letter speaks for itself and I would note
that even the Assessor comments that it is clear that the
structures have been in place for at least 10 to 15 years. The
fact that the Assessor's records did not contain a reference that

the property was a feed lot cannot, and should not, be used by the
Planning Department to make any decision.
Second, our office has been provided a copy of the hand -drawn
map that was submitted as part of the request by Farm Credit
Service (then Federal Land Bank) for the Recorded Exemption. The
diagram provided to us shows both the proposed Lot A and proposed
Lot B as well as a numbered code system. The map provided to us
shows at number "5" the fact that corrals existed on the property,
and additionally shows at number "7" the feed yard facilities. For
your convenience, I have enclosed a copy of the map submitted with
the RE application.
Next, I have enclosed a copy of an aerial photograph taken
during June of 1982 which shows the subject property including all
of the corrals. The copy we have enclosed is merely a copy machine
copy of a photograph and does not show adequate detail; however,
you should feel free to contact this office to inspect the
photograph in our possession. I would add that the Weld County
Assessor's office has a similar 1982 photograph and a simple
inspection of that photograph reveals the existence of the feed lot
as early as 1982.
Please find a copy of a June 27, 1988 advertisement from the
"Fence Posts" newspaper and a real estate brochure. You will
notice that it talks about a nice feed lot and 900 feet of feed
bunks. Obviously, any type of field inspection should have shown
the existence of a feed lot on site.
Next, I am providing to you selected pages from an appraisal
dated March 8, 1988. The copies provided are the cover page and
pages 10, 11, 12, plat mat page, and photograph (Pgs. 16, 17 and
18). This appraisal report makes reference to the substantial feed
lot improvements located upon the property, the number of pens, the
size of the pens, the scale and feed yard operations, and
photographs of those structures. I would also call to your
attention the fact that this appraisal describes the pens and
facilities to be in fair to good condition.

Needless to say, there is absolutely no doubt that this
property is a non -conforming use. The statements start as early as
1949 and go through the present time means that there has been no
abandonment of the facilities and no discontinuance of the use.
Under the Weld County Zoning Resolution, this property is,
obviously, a non -conforming use, is "grandfathered" for the feeding

of livestock up to 2,000 head, and there is some question as to
whether or not the USR is even necessary. Based upon the evidence
presented to you, I would request that the staff re-evaluate and
make a final determination that the existing property and facility
is a non -conforming use.
It is my opinion that the only purpose of the USR application
is to amend the size of Lot A of RE -1119 and to allow the
construction of four additional pens upon the new included acreage.
The number of cattle will not increase as the applicant has agreed
to limit the number of its historical maximum of 2,000 head. As
there is no change in the number of cattle to be placed on feed,
there is no doubt that this USR application should be approved,
even though it should not be necessary.
Finally, as to the USR application, we want you to know in
advance that Condition G and Development Standard 14 are not
acceptable. It is necessary that this condition and development
standard be removed at the time of the County Commissioner hearing.
In the event that the condition and development standard are not
removed, the applicant will then deem it necessary to withdraw the
USR application and continue to operate under the existing non-
conforming use.

Upon your request to research the data regarding the cattle feeding facilities on the John Wardlaw
property I have found the following.
The property currently belongs to Mr. John Wardlaw and is located in the east half of the
southwest quarter of section four, township five, range 64 and contains approximately nine acres
of land. Also included on the property are various structures including two residences, a grain bin
facility with leg and several utility sheds and corrals. The assessors office did reappraise the
property in 1991 and at that time changed some abstract codes to clarify the property as feed lot
and its primary use clarified for that purpose. However, the change in abstract code only was
done to satisfy the State Department of Taxation and in no way was because of a change in the
properties use.
As far back as I could find maps and records the improvements have existed upon this location.
Prior to 1987 the property belonged to Mr. Reuben Sitzman and the nine acres with
improvements were all part of a larger farm parcel containing approximately 80 acres. At this
point in time the parcel number was 0963-04-0-00-007 and the pin number was 4083186. When
Mr. John Wardlaw purchased the nine acres and improvements the parcel was split off and redone
with schedule number 0963-04-0-00-076 and pin number 0031489 for 1988. Whether the
improvements were in use and if so, how many cattle were in the corals is not something I can
answer. We have no record of these types of things and therefore it would be impossible to
determine and answer on that subject.
In fact, I can only assume that the homes and other structures were in use in the past 10-15 years
based upon the fact they were on the tax rolls and there were no appeals found to show
otherwise.

I trust this is of some help as to the existence of the improvements on the property in the past,
however as previously stated, their use and condition are not something which I can comment
upon since I have not seen them in person.

mile south of Gi ll , Colorado or approximately 6 mile east of Greelv,
Colorado. Parcel #2 is located_1 mile east of Parcel *1. The appraiser
considered the property as one unit jr most instances in this report.
Because of varying client interest, the writer was requested to estimate
market value or, the one total unit as well as separating the
improvements and approximately 9 acres out from Parcel #1 and estimating
market value on these separately.
There is a total of 6 units of Big Thompson '.-Dater with this
property that is valued separately from the land 1- this report. There
is a market for this water in this area and it commonly sells separate
from the land. Therefore, irrigated land value estimates in this
appraisal did not consider this Big T water.
Parcel #1 containing approximately 193 total acres is divided by
paved Hiahwal., #253. The tract on- the north side of the highway contains
a total of 97 acres of which approximately 75 acres is irrigated and

It is my opinion that the highest and best use .of the appraised

RELEASE OF SURFACE DAMAGES
KNOW ALL MEN BY THESE PRESENTS, That we, REUBEN SITZMAN
and LYDIA SITZMAN, hereby release Wichita Industries, Inc., 1801
California Street, Suite 4500, Denver, Colorado 80202, its
contractors and subcontractors, and the agents, servants,
employees and workmen of any of them, together with its or their
heirs, executors, administrators, successors and assigns, from
any and all actions, causes of action, claims and -demands what-
soever for, arising out of or resulting from operations upon the
land described below, and on Exhibit "A", and carried on, by or
in behalf of the said Wichita Industries, Inc., in connection
with the drilling, completion, equipping and operating of the
Sitzman Well #1 located in the SEI/4SW1/4 of Section 4, Township 5
North, Range 64 West, Weld County, Colorado.
This Release of Surface Damages covers and relates to
damages to the surface caused by the aforesaid operations as
follows:
Drilling and completion of Sitzman Well #1 on SEI/4SW1/4 of
said Section 4, damages at site and on access road located
on said,map attached -hereto, marked Exhibit "A", and ...made -_
a-partj_hereof-by reference. -The damages also -cover the tank -"
battery'site, separator, pipeline from well andaccessory
_equipment to Sitzman Well #1. Lessee agrees to plug the well.'
when abandoned according to requirements of Colorado Oil and `-
Gas Commission and remove all equipment from the well site
when same is vacated.
