RESOLUTION
RE: APPROVE MINOR RESUBDIVISION - STROHAUER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of
January, 1995, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of James Strohauer, 1605 11th Avenue, Greeley, Colorado 80631, for Minor
Resubdivision to vacate that portion of Russell Avenue on the north side of Lots 9, 10, and 11,
Block 38, Barnesville, Weld County, Colorado, as further described on the Petition to Vacate
attached hereto and incorporated herein by reference, and
WHEREAS, James Strohauer, applicant, was present, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 8.2.5 of the Weld County Subdivision Ordinance including
specifically:
a. The right-of-way has not been used for its intended purpose since the
recording of the approved plat.
b. Seventy (70) percent of the landowners adjacent to the proposed right-
of-way vacation have waived any objection to the vacation by signing a
petition.
c. The vacation would be compatible with the surrounding area and uses, be
consistent with efficient and orderly development, is consistent with the
Weld County Comprehensive Plan, and would not deprive any parcel of
adequate access to a public road or street right-of-way.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of James Strohauer Minor Resubdivision #368 on the
hereinabove described parcel of land be, and hereby is, granted.

Dear Commissioners:
The attached application and submitted materials are concerning a request made by James Strohauer.
The request is to vacate the portion of Russel Avenue on the north side of Lots 9, 10, and 11, Block 38,
Town of Barnsville. The property is located north and adjacent to Weld County Road 68 and
approximately 1/4 mile west of Weld County Road 63.
Based upon the submitted application materials and other relevant information regarding this request, the
Department of Planning Service's staff recommends approval of this request.
This determination was based on the following:
The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
The right-of-way has not been used for its intended purpose since the recording of the
approved plat.
Seventy (70) percent of the landowners adjacent to the proposed right-of-way
vacation have waived any objection to the vacation by signing a petition.
The vacation would be compatible with the surrounding area and uses, be consistent
with efficient and orderly development, is consistent with the Weld County
Comprehensive Plan, and would not deprive any parcel of adequate access to a
public road or street right-of-way.

To the north of Russell Avenue is the Weld County Highway 392
right of way. On the South of Russell Avenue is our lots being
lot numbers 9, 10, and 11. On the east of our property is lot
number 8. To the west is Weld County Road number 611.

We were not aware of the Russell Avenue being on the south side of
the south row fence; therefore when we placed the location we chose
to set our home we thought we were doing everything right.
We had the pads poured and the septic system put in accordance to
the specifications of the permit. We also had the well dug to
specifications. The trailer has been set, and welded to the frame.
As the loan company was preparing for the closing they sent out a
surveyor, and he came back with the report our trailer and septic
system was in Russell Avenue. We are asking that a minor resub-
division be done to allow us to vacate the right of way known as
Russell Avenue so that our trailer home might remain where it has
been set and that our septic system might remain where it has
been put in.

2. The absorption bed shall be a minimum of 720 square feet. The existing
unsuitable clay layer (from 1.5 feet to 6.0 feet) shall be removed and re-
placed with soil having a percolation rate of not greater than 10 minutes per
inch. See attached computations.
3. The new absorption field and septic tank shall be constructed and installed
in accordance with Weld County Health Department regulations.
4. No traffic shall be permitted on the new absorption field after construction.
