RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST ROBERT AND NOREEN SIMS FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Robert and Noreen Sims, VI #9700128, are allegedly in violation of the
Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of October, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, subject property owners were represented by Curtis Stednitz at said
hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until October 24, 1997, to allow adequate time for the occupants
currently living in the unpermitted camper on the subject property to vacate the premises; and
until January 13, 1998, to allow adequate time for the property owners to complete screening of
the noncommercial junkyard located on said property and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Robert and Noreen Sims to remedy the violation of the
Weld County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for the abovestated delays of action upon such referral to
allow adequate time for the property owners to bring the subject property into compliance.

Ordinance. To bring the property into compliance the campers or tents cannot be used for any
overnight or temporary housing and the noncommercial junkyard must be removed from the
property or stored within a screened area so that it is not visible to any adjacent property or public
right of way.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

As requested, an inspection was conducted on September 3, 1997, of the property located at 15810 Dale
Avenue, Aristocrat Ranchettes Subdivision in Weld County by Troy Swain of the Weld County Health
Department's Environmental Protection Division. The following observations were made:
According to the property owner, Noreen Sims only one of the campers is being lived in. Two people are
living in the camper closest to the residence. They are sleeping and hanging out in the camper for privacy.
There was no water connection to the campers and sewage/liquid wastes were not being discharged.
According to Mrs. Sims all meals are prepared and served in the home and the family members living in the
camper use the home to take showers and to use the toilet.
A file search was conducted for this property's septic permit. There were no signs of failure at the time of
the above inspection. The Individual Sewage Disposal System was installed April 18, 1986 (permit #
G860130) for a 3 bedroom house trailer.
Based on the above inspection findings this situation does not pose a threat to public health and/or the
environment at this time, however the Environmental Protection Division will work closely with Planning
to monitor the situation. If you have any questions regarding this matter, please feel free to contact me at

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.2.1, 31.2.16, 31.3.9 and 43 of the Weld County Zoning Ordinance. This is not a use allowed by right
in the Agricultural zone district.
The violation can be corrected by not using the camper for any temporary or overnight housing. No
utilities may be connected to the camper being used as a residence. All derelict vehicles and any other
items considered part of a noncommercial junkyard must be stored within a screened area or removed
from the property. If screening is to be used to conceal the noncommercial junkyard a detailed screening
plan must be submitted to and approved by the Department of Planning Services prior to installation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from August 19,1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
