DENVER 2 EXECUTIVE DIRECTOR TO: All Nursing Home Administrators and other interested parties FROM: Colorado State Department of Public Health In order to clarify the policies of the Colorado State Department of Public Health regarding 1960 licensing of nursing homes, the following are the official policies of the Department. 1. For the purposes of the 1960 licensing period, the deadline date of December 15, 1959 for filing applications with the Department will be waived. 2. For the purpose of the 1960 licensing period, the statement made in point 1 of the instructions regarding "required approvals" before the application is submitted should be understood to mean that any notation made by the official making the inspection is sufficient, regardless of whether the notation indicates approval or disapproval. 3. Each application will be considered individually to determine whether or not inspections were made in accordance with the Building Exits Code, 1957 Edition. 4. In those instances where inspections were made and applications were certified in accordance with the Building Exits Code, 1957 Edition, 1960 nursing home licenses will be issued. 5. In those instances where inspections were not made in accordance with the Building Exits Code, 1957 Edition, even though the ap- plications are signed, by local officials, and where the applica- tions are not signed by local officials, action will be withheld by the Colorado State Department of Public Health, pending determinations of what is required in the individual nursing home and the length of time necessary for correction. 6. Up to six months has been determined as reasonable for the initial grace period, therefore, a space of time not to exceed six months may be granted to the individual nursing home to determine what is to be done, make necessary plans for correction and to initiate a work schedule. 590097 - 2 - 7. During the grace period, inspections may be made to determine progress of corrections. The results of these inspections will then determine what course should be followed in either granting an additional period of time or to initiate final action upon the application for the 1960 nursing home license. 8. The Colorado State Department of Public Health shall follow the provisions of Chap. 37, 1959 Session Laws (House Bill 212) and will consider the 1959 nursing home license as remaining in full force and effect, under the provisions contained therein, until final action is taken upon the 1960 Nursing Home License Application. The enactment of an amendment to CRS '53,'66-1-7, 1959 Session Laws (House Bill 357), has created the need for certain changes to be made in the 1960 nursing home licensing program and, in turn, unavoidable delays. However, the Colorado State Department of Public Health shall continue to work with the nursing homes during the coming years in the interest of patient safety and health. It is sincerely hoped that if there are any questions or clarifications con- cerning these policies or their application to a specific nursing home they will be discussed with personnel of your local health department.
