The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. Submit evidence to the Department of Planning Services that any existing septic system(s) meets all
requirements of the Weld County Health Department. The Environmental Protection Services Division of
the Weld County Health Department was unable to locate a septic permit for the septic system located at
6638 Weld County Road 38. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required
septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into
compliance with current I.S.D.S. regulations. ff,2269a

B. The applicant shall submit a sketch of the existing septic system in relation to the proposed lot line to the
Weld County Health Department. The applicant shall submit evidence of Health Department approval to
the Department of Planning Services.
C. The applicant shall utilize the existing residential access point. No additional accesses shall be granted.
D. All approved accesses shall be clearly shown on the plat.
E. The applicant shall attempt to address the requirements of the RE-5J School District as stated in a referral
response received 9/15/1998.
F. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
'fees.

l.a. Domestic Water: Lot A of RE 437 presently has Little Thompson Water.
Lot B of RE 1491 has proposed water from Little Thompson Water District via
the attached letter from the District' s Engineer.
l.b. Irrigation Water: Lot A has no irrigation water. Lot B will continue
to have access to 3 .5 shares of the Highland Ditch Company along with access
to the Little Gem Reservoir that has a capacity of 70 acre feet of water. The
80 acres to be split from lot B will have access to 1.5 shares of the Highland
Ditch Company.
2. Sewage Disposal: Lot A presently has a Septic System. Lot B has no
improvements and will utilize a septic system in the future.
3. Property Usage: Presently, Lot A consists of approximately 2 acres and is
currently used by the tenant farmer as his residence and has a large machine
shed for shop and storage and disturbs no prime farm ground. Lot B consists
of approximately 272 acres and is prime farm ground with an existing machine
shed which sits adjacent to Lot A.
4 & 5. Proposed Usage: Lot A will be amended to square up the property and
include approximately 1 more acre to include the machine shed presently
included in Lot B to accommodate more farm equipment storage. Lot B will be
decreased in size to approximately 192 acres and will continue to be farmed.
The 80 acre split from Lot B will continue to be farmed. This split has no
impact on the prime agricultural acres currently farmed. The amendments are
necessary to accommodate three buyers for the property. Lot A is to be
purchased by Greg and Anna Spaur who currently farm approximately 800 acres
and will be used by them in their farming operation. Frank And Alyson Canepa
will purchase Lot B and will use it as a future site of their personal
residence and it will be farmed by the Spaurs. Canepa intends to add a center
pivot sprinkler to improve the irrigation of the property. The 80 acres split
is to be purchased by Mark and Deborah Schell who currently own and reside on
the 160 acres to the southeast of the 80. The 80 will be farmed by the Spaurs
and will fit in with the Schell property as irrigation waste water from the 80
will be transferred to the storage pond on the Schell 160 for use in the
center pivot on their home place.
6 . Unique Physical Characteristics: none.
7. There are no proposed structures to be built in the near future. Canepa is
going to locate his personal residence in a low productive area of the farm
outside the center pivot path and will meet all requirements of Weld County.
8 . Conservation Easement: none are planned at this time.
9. Building Envelope: none are planned at this time.
10. Weld County Comprehensive Plan: The properties will continue to be farmed.

11. Existing Surrounding Uses: All adjacent land uses are made up of farming
and large single family parcels. This ensures that the existing uses with
this proposal are comparable with the existing adjacent land uses in the area
due to the fact they are the same.
12 . District Intent: This proposal is located within the Agricultural Zone
District . The WCZO allows for agricultural activities along with single
family residential sites, which is consistent with this site.
13 . Efficient and Orderly Development: This proposal is consistent with the
efficient and orderly development in that nothing will change as far as
health, safety and welfare of the residents of the County. Access will remain
the same as well as all public services such as utilities and public
protection agencies.

Environmental Protection Services has reviewed this proposal; the following conditions are recommended
to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s) and shall be installed
according to the Weld County Individual Sewage Disposal Regulations.
2. The Environmental Protection Services Division of the Weld County Health Department was
unable to locate a septic permit for the septic system located at 6638 WCR 38, on the smaller parcel of
this application. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the
required septic permit(s). In the event the system(s) is found to be inadequate, the system(s)
must be brought into compliance with current I.S.D.S. regulations.
3. The applicant shall submit a sketch of the existing septic system in relation to the proposed
lot line.

Thank you for referring case numbers 2nd AmRE-1491 and 3rd AmRE-4377 to the School
District. The projected student impact upon the Johnstown-Milliken School District of these
developed sites appears to be minimal as presented. Any students living in these areas, as
indicated on the documents would attend Milliken Elementary School, Letford Elementary School,
Milliken Middle School and Roosevelt High School under the present school organization plan.
However, due to potential growth in these schools, these developments in addition to the other
existing developments in the district will have a considerable effect on the district.
Additionally, bus transportation would be required thus causing adjusments in the routes and
schedule.
The district is on record as not opposing growth, so long as the growth is planned and is
manageable from a student enrollment stand point. As there are other approved developments in
these attendance areas which will, together with this proposal, have a significant cumulative
impact on these schools.
As the volume of developments increases, with no alleviation of the existing overcrowded
conditions, it becomes increasingly difficult to provide the same quality education for these new
students that is provided students in other areas. Therefore, the District opposes these
developments because it adds to the enrollment of already overcrowded schools. The district
would reconsider this proposal if the developer would participate in a separate voluntary
agreement to help mitigate these developments' impacts on the schools. This agreement would
address the dedication of land or the payment of fees in-lieu of land based on these developments'
impact.

Thank you for referring case number RE-437 to the School District. stated in my previous
letter the projected student impact upon the Johnstown-Milliken School District of this
recorded exemption appears to be minimal as presented. Any students living in this area, as
indicated on the document, would attend Milliken Elementary School, Letford Elementary School,
Milliken Middle School and Roosevelt High School under the present school organization plan.
Mr. Greg Spaur has contacted me to address the concerns of the school district. As of this date
the Towns of Berthoud, Johnstown and Milliken have not formally passed the resolution and
ordinance describing the land dedication or cash in lieu of land dedication for education . Mr.
Spaur did request that as soon as all three towns have passed such an ordinance and resolution,
that he would meet with the district to assist in solutions to this predicament. At this time the
district does not oppose the conditions set forth in the recorded exemption.

The two requests are located in Weld County/South of WCR 38 and west of WCR 15. There are
272 acres that will be split into three parcels for three separate owners; Greg Spur, Frank Canepa
and Mark Schell. All owners will farm (he properties. Mr Cauepa plans to add a center pivot to
improve the irrigation of the property. Lot B with 192 acres will continue to have access to 3.5
. shares of the Highland Ditch Company with access to the Little Gem Reservoir.
Soils found on site:
Otero sandy loan, 5-9%slopes - permeability is rapid, available water capacity is moderate,
surface runoff is medium to rapid and the erosion hazard is low. They have slight limitations fro
septic tanks. It has excellent potential for urban and recreational development.
Theda n:tit/own, 3-5% slopes - permeability and available water capacity are moderate, surface
runoff medium to rapid and the erosion hazard is moderate. Underlying shale is a limiting feature
of this soil. Neither septic tank absorption fields or sewage lagoons function properly. There is a
very high shrink-swell potential.
Wiley-Colby complex, 1-3% slopes - permeability is moderately slow, available water capacity is
high, erosion hazard and surface runoff is moderate. The Wiley soil has fair potential for
development. It has slow permeability and moderate shrink-swell potential. The Colby soil has
good potential for development.
I would suggest a specific site review before any development.

Dear Jim;
This letter is in response to your request that the Little
Thompson Water District provide a water commitment for the proposed
Recorded Exemption, described as follows:
N 2, SEC 6, T3N, R67W -- Weld County
The request is for 1 standard 5/8" X 3/4" residential water
taps. We will commit to provide service to this proposed lot with
the following conditions :
1. The District has implemented a "system impact" fee for
all lots to be added to our system. The fee is $1, 050 . 00
per lot and is due and payable upon acceptance of the
main line extension.
2 . All improvements to District facilities required to
provide service will be the financial responsibility of
the developer in accordance with District Rules and
Regulations. All improvements must conform to District
Specifications .
3 . We currently have a 6" Dia. line along WCR 38 West of WCR
13 with additional capacity available. You will need to do a
main line extension to provide service to the proposed
Recorded Exemption. The line extension will need to extend
from the existing 6" along WCR 38 to your proposed lot B.
This commitment will expire one year from the date of this
letter if the tap has not been purchased and installed by that
date. The current fee for the domestic 5/8" X 3/4" tap is $5, 700 . 00
These fees area subject to change without notice. If you have
