Sub: Request for quadrant size changes to the two Parcels affected in the
Case # 1815, to bring them to two equal Acre Lots of 2.5 and 2.5.
As was stated on the Staff Summerythe original request was for a 3 & 2.5 Ac
split. We realized that due to Easements, the Lots would not be as they survey in full. , he
Surveyor Was attempting to maintain as common' an access to the properties as possi e,
and therefore, used the existing drive access to the Lot B property as a dividing point.:'
After the Contractor reviewed the parcel split prior to construction, he brought to my,I�
attention the size discrepancy from , the original request - I'm not sure how the Final survey,
missed the Original request by a half acre, but since this is a Family split, and Mom an
Dad own the total 5 acres, as the recipient of the New parcel as a gift, it would not b fair
for the New to be larger than the original. I would be much appreciative if this could 1pe
corrected without redoing the process all over again.

STAFF RECOMMENDATION:
- Staff has concerns that this proposal is not consistent with orderly and
efficient Development. Staff has concerns that this lot is already 75 acres
less than the minimum lot size requirement in the Ag zone which is 80 cres.
When allowing such a small parcel to be split, staff has concerns th t this
recorded exemption will set a precedent in the area for future re rded
exemptions. Staff also has concerns that neither lot is served by acublic
water source or a public sewer source.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way es to cause no material Injury to existing water rights. The twice of the
permit does not assure the applicant that no Injury will occur to another vested water right or erect a another
owner of a vested water tight from seeking relief In a civil court action.
2) 'The construction of this well shall be In compliance with the Water Well Construction Rules 2 CCR 2. unless
approval of a variance has been granted by the state Board of Examiners of Water Well and Pump
Installation Contractors In accordance with Rule 18.
3) Approved pursuant to CRS 37-92.602(3)(b)(ION) as the only well on a residential site of s acres pea as pan
of the SE1/4 of the SE1/4 Section 24, Township 1 North, Range 66 West d the 6th P.M., more Identified
as Weld County exemption 1471-24-4-RE1816, approved December 18, 1995.
4) The use of ground water from this well is tingled led to ordinary household purposes inside a single fam dwelling.
The ground water shall not be used for Irrigation or other purposes. 4
5) The total depth of the well shall not exceed 85 feet or the first confining clay/shale series, whichever first,
which corresponds to the base of the alkNial aquifer.
6) The maximum pumping rate shall not exceed 18 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal sy em of the
non -evaporative type where the water is returned to the same stream system in which the well Is ed.
8) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note: To insure a maximum productive INe of this well, perforated casing should be set throw the entire
producing interval of the approved zone or aquHer indicated above. Al R 94
