WHEREAS, the Board of Trustees of the Town of Erie, Colorado, held a public hearing on the 23rd of July 1998, pursuant to the published notice, on the petition of Charles and Cheryl Hepp and James W. Hepp, Executor of the Emma G. Hepp Trust, for the annexation of the following real property; to wit: A part of the Southwest '/4 of Section 27 and Part of the Northwest 'A of Section 34, Township One (1) North, Range Sixty-eight (68) West of the Sixth Principal Meridian, County of Weld, State of Colorado. NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ERIE, COLORADO, AS FOLLOWS: Section 1. Findings of Fact. a. The applicant's petition is in substantial compliance with subsection (1) of§ 31-12- 107, C.R.S.. It contains the required allegations, the dated signatures of 100% of the landowners of the property requested to be annexed, the required affidavit of circulation, the required legal description of the area to be annexed, and the required annexation boundary map. As a petition of the owners of 100% of the property to be annexed, it is eligible for annexation by ordinance as provided by C.R.S. § 31-12-107 (1) (g). This finding was made and duly adopted by the Erie Board of Trustees in Resolution No. 96-19, adopted on June 13, 1996. b. With respect to compliance with C.R.S. § 31-12-104, the Board of Trustees makes the following findings of fact: 1. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the annexing municipality. 2. A community of interest no longer exists between the area proposed to be annexed and the annexing municipality by reason of the Intergovernmental Agreement between the City of Broomfield and the Town of Erie. WHEREAS, a petition for Annexation has been filed by Leroy J. Baker, Dorothy Ann Lauer, Paul Baker, Jr., Alexander Michael Baker and Mary Elizabeth Scholte, heirs of Mary Baker, for the annexation to the Town of the following described real property; to wit: A part of the South '/2 of the Southwest 1/2 of Section 22 Township 1 North, Range 68 West of the 6th P.M., County of Weld, State of Colorado, being more particularly described in Exhibit A. The above described property is hereby annexed to and included within the town limits of the Town of Erie. Section 2. Three-mile Annexation Plan. The "Three Mile Annexation Plan" as adopted is hereby amended to the extent necessary to incorporate the above described property and to update said Plan thereby. Section 3. The Mayor and Town Clerk are authorized and directed to complete all the necessary procedures required for annexation of said property to the Town including filing the required certified copies of the annexation ordinance and a map of the area to be annexed containing a legal description of such area with the Weld County Clerk and Recorder. Section 4. Zoning of the Property. The property shall be zoned Rural Preservation 3 (RP-3), as requested in the petition for annexation. Said zoning shall be accomplished by separate ordinance whose effective date shall be not sooner than the effective date of this annexation ordinance. Section 5. Effective Date. This ordinance shall become effective thirty (30) days after publication, or upon the affixation of signatures on the annexation map and this annexation ordinance and the recording of the same, whichever occurs later. Section 6. Validity. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining sections of the Ordinance. The Board of Trustees hereby declares that it would have passed the ordinance including each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that one or more parts, sections, subsections, sentence, clauses or phrases be declared invalid. Section 7. Necessity. In the opinion of the Board of Trustees of the Town of Erie, this ordinance is necessary for the immediate preservation and protection of the health, safety, welfare and property of the inhabitants and owners of property in the Town of Erie. Section 8. Certification.
