The Board of County Commissioners of Weld County, Colorado, met in regular
session in full conformity with the laws of the State of Colorado at the regular
place of meeting in the Weld County Centennial Center, Greeley, Colorado,
December 11, 1996, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Barbara J. Kirkmeyer, Chair
Commissioner George E. Baxter, Pro-Tem
Commissioner Dale K. Hall
Commissioner Constance L. Harbert
Commissioner W. H. Webster
Also present:
County Attorney, Bruce T. Barker

Finance and Administration Director, Don Warden
MINUTES: Commissioner Webster moved to approve the minutes of the Board of County
Commissioners meeting of December 9, 1996, as printed. Commissioner Hall
seconded the motion, and it carried unanimously.
CERTIFICATION
OF HEARINGS: Commissioner Baxter moved to approve the hearing conducted on December 9,
1996, as follows: 1) 1997 Final Budget Hearing. Commissioner Harbert
seconded the motion, which carried unanimously.
ADDITIONS: Emergency Ordinance 193-A was added as item #4 under New Business.
CONSENT AGENDA: Commissioner Hall moved to approve the consent agenda as printed.
Commissioner Webster seconded the motion, and it carried unanimously.
PRESENTATIONS: 1996 INDIVIDUAL SAFETY AWARD - FRED RUTHERFORD: Chair Kirkmeyer
read the certificate into the record, and Judy Griego, Director of Social Services,
made the presentation to Mr. Rutherford.
EMPLOYEE RECOGNITION - TEN AND TWENTY YEAR PINS: Each
Commissioner, assisted by the appropriate department head, presented ten and
twenty year pins to employees as listed on the attached.

PUBLIC INPUT: No public input was offered.
WARRANTS: Don Warden, Director of Finance and Administration, presented the following
warrants for approval by the Board:
All Funds $ 974,024.12
Commissioner Hall moved to approve the warrants as presented by Mr. Warden.
Commissioner Harbert seconded the motion, which carried unanimously.
BIDS: There were no bids to present.
BUSINESS:
NEW: CONSIDER CONTRACT FOR VICTIM ASSISTANCE PROGRAM BETWEEN
DISTRICT ATTORNEY'S OFFICE AND VICTIM ASSISTANCE AND LAW
ENFORCEMENT BOARD AND AUTHORIZE CHAIR TO SIGN: Nancy Haffner,
District Attorney's office, reviewed the VALE contract to be signed and noted
there are no changes from this year's contract. Commissioner Baxter moved to
approve said contract and authorize the Chair to sign. Seconded by
Commissioner Hall, the motion carried unanimously.
CONSIDER CONTRACT FOR CANCER PREVENTION OUTREACH BETWEEN
HEALTH DEPARTMENT AND COLORADO DEPARTMENT OF PUBLIC
HEALTH AND ENVIRONMENT AND AUTHORIZE CHAIR TO SIGN: John
Pickle, Health Department Director, reviewed said contract which includes
outreach activities to recruit low-income women over the age of 50 for breast and
cervical cancer screening services. The amount will not exceed $10,279 for the
period of January 1, 1997, through July 15, 1997. Commissioner Webster moved
to approve said contract and authorize the Chair to sign. The motion, which was
seconded by Commissioner Baxter, carried unanimously.
CONSIDER LICENSE AGREEMENT TO MAINTAIN STRUCTURES WITHIN
WELD COUNTY ROAD RIGHT-OF-WAY WITH FRANCIS R. NICHOLS AND
AUTHORIZE CHAIR TO SIGN: Bruce Barker, County Attorney, explained this
agreement is pursuant to a Recorded Exemption being handled through the
Department of Planning Services. Mr. Nichols owns a shed he is using as a
chicken coop, half of which protrudes into the Weld County Road 43 right-of-way.
Terms of the agreement allow Mr. Nichols to maintain the shed as it is, with no
additions. In response to Chair Kirkmeyer's question, Mr. Barker said the term
"install and maintain" is one most often used by the Board for similar situations.
Commissioner Hall moved to delete the words "install and," approve the
agreement, and authorize the Chair to sign. Commissioner Harbert seconded the
motion, which carried unanimously.

CONSIDER EMERGENCY ORDINANCE NO. 193-A, IN THE MATTER OF
REPEALING AND REENACTING ORDINANCE NO. 193 REGARDING SETTING
THE MILL LEVY FOR THE ANNUAL APPROPRIATION FOR WELD COUNTY,
COLORADO, FOR FISCAL YEAR 1997: Mr. Warden stated the Assessor
notified him of a change in the Assessed Value which was made after approval
of the budget on December 9, 1996. The effect is a slight change to the Mill
Levy, therefore, Ordinance 193-A needs to be considered by the Board. Mr.
Warden read Ordinance 193-A into the record. There being no public testimony,
Commissioner Baxter moved to approve said Ordinance on an emergency basis.
The motion was seconded by Commissioner Hall, and carried unanimously.
RESOLUTIONS AND
ORDINANCES: The resolutions were presented and signed as listed on the consent agenda.
Ordinance 193-A was approved on an emergency basis.
Let the minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:30 a.m.
