RESOLUTION
RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JOHN AND JUDITH HILLMAN FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, John and Judith Hillman, VI #9700163, is allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of March, 1998, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, John Hillman, subject property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until May 11, 1998, to allow adequate time for the property owner to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against John and Judith Hillman to remedy the violation of the
Weld County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until May 11, 1998, to
allow adequate time for the property owner to bring the subject property into compliance.

owner to contact the Department of Planning Services.
September 24, 1997 Five day letter sent.
September 30, 1997 Telephone conversation with John Hillman. Applications for the appropriate permits
sent to the property owner.
October 1, 1997 Progress inspection of the property. Property is still in violation. Julie Chester talked
with Mr. Hillman and he told her he would make a decision by Monday, October 6,
1997, as to whether he would acquire the appropriate permits or go through the
violation process.
October 6, 1997 Telephone conversation with John Hillman. He will come into the office today to
apply for permits.
January 5, 1998 Progress inspection of the property. Property is still in violation.
January 6, 1998 Thirty day letter sent.
February 2, 1998 Memo from Dave Sprague, Lead Inspector. In a telephone conversation with Dave
Sprague Mr. Hillman said he has sold the mobile home and is waiting for the buyer to
locate a lot to park it on.
February 26, 1998 Progress inspection of the property. Property is still in violation.
February 26, 1998 Letter sent to the property owners scheduling a violation hearing before the Board of
County Commissioners on March 10, 1998.
The mobile home is still located on the property, therefore is a violation of Sections 31.2, 31.2.1, 31.2 and 43
of the Weld County Zoning Ordinance. To bring the property into compliance the mobile home must be
removed from the property or the appropriate permits would need to be applied for and approved.
The Department of Planning Services also recommends that the County Attorney authorize legal action against
any other persons occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The uses on the above described property are being considered as a zoning violation of Sections 31.2,

The violation can be corrected by removing the mobile home from the property or obtaining the appropriate

It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation- You have 30 (Thirty) days from

ITEMS DISCUSSED: Mr. Hillman was inquiring on how to bring the property into compliance. I told him the
violation process and also that if he wanted to leave the mobile home on the property what permits would be
required. He said that he is trying to sell the mobile home and did not think it would be there long. He did not
think that he should have to pay so much money for the zoning and building permits when it is just temporary.
I told him he could go through the violation process and try to sell it during that time. He wasn't sure what he •
should do. I suggested to him that I could go ahead and send the applications for the appropriate permits and
he could think it over about what he wants to do. I told him that I needed to hear from him by Monday,
October 6, 1997 on what route he wanted to take. I did send the applications for a zoning and building permit
and some other information on 9/30/97.
