Box 758 Greeley, Colorado 80632 Re: County Mining Activities and Easements Owned by the Last Chance Ditch Company -� Dear Commissioners: As Secretary of the Last Chance Ditch Company, I am writing on behalf of the Company to inform you that Weld County mining activities immediately east of Interstate 25 and across from the Barbour Ponds state recreation area have blocked the Ditch Company's easement to drain water from the ditch to the St. Vrain River. (See attached Agreement granting the easement recorded with the Weld County Clerk and Recorder.) This easement is shown on the attached map. County mining activities, including the building up of the ditch banks, have obstructed the easement preventing all water from draining out of the ditch to the St. Vrain River. In order to resolve the County's encroachment on the easement, the Ditch Company proposes that the County construct a spillway from the ditch into one of the County's mining ponds. The Ditch Company has consulted with County Engineer, Drew Scheltinga, and Pit Supervisor, Mike Nelson, and both agreed this proposal is feasible and would help to solve the problem. If the Commissioners authorize this work, final details such as the location of the spillway still need to be determined.
