HomeMy WebLinkAbout951096.tiffRESOLUTION RE: APPROVE ENTRY BY WELD COUNTY VEGETATION MANAGEMENT SPECIALIST UPON VARIOUS LANDS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on either May 10, 15, 16, or 18, 1995, the Weld County Vegetation Management Specialist mailed notices to various landowners within Weld County advising them that lands owned or occupied by them contain Canada thistle, musk thistle, leafy spurge, and/or Russian knapweeds, noxious weeds, and WHEREAS, said notices stated that said noxious weeds must be controlled or eradicated within ten days from the date of said notices and gave recommendations as to what methods are to be used for such control or eradication, and WHEREAS, a copy of said list, containing the legal descriptions of the lands and the names of those landowners who have failed to comply with said recommendations, is attached hereto and incorporated herein by reference, and WHEREAS, the County Vegetation Management Specialist has requested that the Board approve his entry upon lands, as set forth in the abovementioned list, to affect the control or eradication of noxious weeds, and WHEREAS, at its meeting of May 31, 1995, the Board did Find as follows: 1. That those landowners mentioned on the list are the owners of said land within a pest control district. 2. That Canada thistle, musk thistle, leafy spurge, and/or Russian knapweeds, noxious weeds, are found upon said lands. 3. That said landowners received appropriate notice and such notice specified the best available means for control or eradication of said noxious weeds. 4. That said landowners have not complied with the requirements as stated by the County Vegetation Management Specialist. 951096 EX0017 ea , P ce; ) ENTRY UPON LANDS PAGE 2 WHEREAS, pursuant to said Findings, the Board deems it advisable to approve the entry by the Weld County Vegetation Management Specialist upon said lands described in the list attached hereto, to affect the control or eradication of the abovementioned noxious weeds. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Board does hereby approve the entry by the Weld County Vegetation Management Specialist upon various lands as set forth in the list attached hereto to affect the control or eradication of Canada thistle, musk thistle, leafy spurge, and/or Russian knapweeds, noxious weeds. BOX 758 GREELEY, COLORADO 80632 PHONE: (970) 356-4000 EXT. 3750 FAX: (970) 352-2868 Dear Mr. and Mrs. Holton: Under provision of the Pest Control Districts Law (35-5-108(1) C.R.S.), this letter is to serve as notice that the presence of noxious weeds has been observed on property which is owned, leased, -and/or occupied by you and located in the 1/4 of Section 6 and 7 , Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado. The property is designated in the Weld County Assessors Office as parcel(s) number(s) 147106000039 and 147107000020 This property is located in the Platte Valley Pest Control District. The noxious weeds present on the property include; leafy spurge (Euphorbia esula ) Because these weeds are nearing bloom stage, they must be controlled and kept from going to seed. Presently, the best methods of control are: 1) to mow as necessary throughout the year to keep the weeds from going to seed (3-5 times) and then spray with herbicides in the fall, 2) to mow throughout the season to keep the plants from going to seed, 3) to spray with herbicides up to the early flower stage. Section 35-5-108,(1)C.R.S. requires you to control the weeds by using at least one of these methods. Please be advised that if you do not control or eradicate these weeds by May 25. 1995 will ask the Board of County Commissioners of Weld County for permission to enter the property to use one of these methods of control or eradication at your expense, as provided in Section 35-5-108 (2,3) C.R.S.
