• RESOLUTION RE: GRANT SIX-MONTH EXTENSION OF MOBILE HOME PERMIT#2116 - JAMES AND PAMELA ERTHAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on June 5, 1997, the Department of Planning Services staff, did grant the request of James and Pamela Erthal, 40907 Weld County Road 15, Fort Collins, Colorado 80524, for a Zoning Permit for a Mobile Home (ZPMH #2064) for temporary use during the construction of a residence, and WHEREAS, on the 3rd day of February, 1999, the Board of County Commissioners did consider the request of James and Pamela Erthal for a six-month extension to said temporary permit (ZPMH #2116), and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot B of Recorded Exemption #1723, located in part of the NE% of Section 7, Township 7 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall use the existing access to this parcel as no additional accesses shall be granted. 2. The mobile home shall be served by the existing septic system (Permit No. Sp-9700162) while it is located on to property. 3. Mobile Homes permitted as a temporary use during construction of a permanent dwelling shall be removed within thirty (30) days after the Certificate of Occupancy has been issued for the permanent dwelling. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of James and Pamela Erthal for a six-month extension of the Temporary Mobile Home Permit, ZPMH #2116, to be used during the construction of a residence on the above described parcel of land, which was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is, granted subject to the hereinabove listed conditions. Approximately 15 other categories remain to be inspected and approved. b. Section 43.21.2 - That Construction of the permanent DWELLING UNIT shall commence within ninety (90) days of the issuance of the TEMPORARY permit for the MOBILE HOME and shall be diligently pursued. The first inspection for the Single Family House was performed less that thirty (30) days after the issuance of the Building Permit. Inspections proceeded at a regular and adequate rate up until September of 1997 when there was a thirteen (13) month hiatus or lapse between inspection requests for Underground Plumbing (Item# 9) and Underground Electric (Item#8). In the current application Mr. Erthal indicates that the three principal workers on the construction of the home had difficulties this past year. The carpenter that was hired was dividing his work on the Erthal home with unrelated projects. James Erthal and his father had unexpected surgeries which curtailed their work performance and kept them from working on the home for a combined period of four months. The applicant asks for the extension of six (6) months and explains that this time will be sufficient to complete the project. c. Section 43.2.1.3 - The applicant shall demonstrate that adequate water and sewage disposal facilities are available. Septic Permit # SP-9700162 was approved by the Weld County Health Department on May 28, 1997. In a letter dated May 1, 1997 North Weld County Water District states that water service is presently provided to 40907 WCR 15. d. Section 43.2.1.4 -- That the TEMPORARY permit for occupancy of the MOBILE HOME shall be issued for a period of six (6) months. The permit may be renewed by the Department of Planning Services for two (2) additional six (6) month periods upon a determination by staff that construction of the permanent DWELLING UNIT is being pursued with diligence. At present, eighteen (18) months has elapsed since the original Zoning Permit for a Mobile Home was granted on June 10, 1997. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. Page 3 ggoi �(v The Department of Planning Services' staff has reviewed this request and approves this request for the following reasons: WILL WILL NOT x Be compatible with the Weld County Comprehensive Plan. Be compatible with the surrounding area. Be in harmony with the character of the neighborhood. Adversely affect the immediate area. x Be adequately served by water and sewage disposal facilities. x Adversely affect the general health, safety and welfare of the inhabitants of the area and the County. The applicant has submitted a petition in favor of the request. The petition contains the signatures of 75% of the surrounding property owners within 500 feet of the property where the mobile home is proposed to be located. The Department of Planning Services's staff recommendation for approval is conditional upon the following: 1. I am doing a lot of the work on both the house and also the shop building myself. At this time the shop building is almost finished and the house is almost closed in. The house has gone slower than we had hoped, due to delays with the carpenter we had hired to frame the house. Our project turned not to be a priority for him and he took much longer than promised to do the job. The framing is still not totally finished and I am trying to hire a new carpenter to finish. Also I have been slowed in completing the work that I am doing by an unexpected surgery in May which kept me from working for 6 weeks. Then in July my father had surgery for prostrate cancer and was unable to work for 2 months. He and I are partners in the cabinet shop, which will be moving to the shop building when it is finished. His surgery and mine put a bind on the shop schedule, which did not allow me to take time off that I had planed to work on the house. I expect that without major complications that a 6 month extension will allow us to complete the house construction. I thank you for your understanding in this matter.
