RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ELMER LUNDVALL AND FLACK OUTDOOR ADVERTISING FOR
VIOLATION OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Elmer Lundvall and Flack Outdoor Advertising, VI #9600009, are allegedly in
violation of the Weld County Building Code and Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violations have
not been corrected, and
WHEREAS, on the 9th day of April, 1996, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violations, and
WHEREAS, Elmer Lundvall and Flack Outdoor Advertising were not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to delay referral of said
violations to the Weld County Attorney's Office for a period of thirty days to allow adequate time
for the property owner and lessee to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
within thirty days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violations still exists on May 9, 1996, the Weld County Attorney be,
and hereby is, authorized to proceed with legal action against Elmer Lundvall and Flack Outdoor
Advertising to remedy the violation of the Weld County Building Code and Zoning Ordinances, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.

Dear Mr. Flack,
Thank you for your letter dated March 5, 1996 explaining your position concerning the
installation of the two signs. The Weld County Building Code Ordinance states that if
construction is not commenced within 120 days of the date of issuance of a permit, the Building
Official has the right to expire those permits.
There were three building permits issued for signs located in Section 18 with the following
inspections conducted for those signs:

As you can see from the above inspection dates there was an adequate period allowed for the
installation of the above signs prior to the expiration of the permit. When a permit is expired it
is departmental policy that the property owner and in this case Root Outdoor Advertising be
notified of this action.

In the Weld County Building Code Ordinance prohibits the transfer of a permit from the original
permittee to subsequent purchasers. Any purchaser of any structure issued a permit under the
Building Code shall apply for a new permit upon his purchase of the subject property.
Therefore there was not a valid permit for the construction and installation of the subject signs.
In order to be in compliance with the Weld County Building Code Ordinance and Zoning
Ordinance the appropriate permits need to be acquired and the signs spaced a minimum of 500
feet apart.

McMullen also sent me a notice with regard to this matter.
/explained to her that we have Weld County building permits as well as Colorado Stale
Highway permits authorizing us to build the structures in question per a 300 foot
spacing. This spacing was the requirement at the time these permits were issued(see
enclosed copies!
The tone of my discussion with Ms. McMullen indicated that the matter was resolved,
and f considered it so upon completion of the discussion. This company feels that
these are legal builds, and that no laws were violated in either their construction or
installation.

Dear Elmer E. Lundvall:
It has come to the attention of the Department of Planning Services' staff that the uses on your
property described above (Hwy. 34 and Weld County Road 58)may not be in compliance with
the Weld County Zoning Ordinance sections 42.2.1,42.2.3.6 and the Weld County Building
Ordinance section 30. The potential noncompliance with the zoning ordinance is two signs with
insufficient spacing between them. Signs placed after October 27, 1992 are required to have a
minimum of 500 feet between them. The signs at this location are.spaced 304 and 400 feet apart.
To bring the property into compliance with the Weld County Zoning Ordinance the signs need to
be spaced 500 feet apart.
To bring the property into compliance with the Weld County Building Ordinance building
permits must be applied for and issued by the Weld County Building Inspection Department for
the signs. Please call me within five working days of the date of this letter to review the
concerns with me.

l am in receipt of your letter dated February 28, 1996. On January 12, 1996, Ms. Susan
McMullen also sent me a notice with regard to this matter.
I explained to her that we have Weld County building permits as well as Colorado State
Highway permits authorizing us to build the structures in question per a 300 foot
spacing. This spacing was the requirement at the time these permits were issued(see
enclosed copies).
The tone of my discussion with Ms.McMullen indicated that the matter was resolved
and I considered ltso upon completion of the discussion. This company feels that
these are legal builds, and that no laws were violated in either their construction or
installation.

It has come to the attention of the Department of Planning Services' staff that the uses on your
property described above (Hwy. 34 and Weld County Road 58) may not be in compliance with
the Weld County Zoning Ordinance sections 42.2.1,42.2.3.6 and the Weld County Building
Ordinance section 30. The potential noncompliance with the zoning ordinance is two signs with
insufficient spacing between them. Signs placed after October 27, 1992 are required to have a
minimum of 500 feet between them. The signs at this location are spaced 304 and 400 feet apart.
To bring the property into compliance with the Weld County Zoning Ordinance the signs need to
be spaced 500 feet apart.
To bring the property into compliance with the Weld County Building Ordinance building
permits must be applied for and issued by the Weld County Building Inspection Department for
