HomeMy WebLinkAbout961648.tiff RESOLUTION RE: CONSENT TO THE ENFORCEMENT BY THE FORT LUPTON FIRE PROTECTION DISTRICT OF THE 1994 UNIFORM FIRE CODE AND STANDARDS, WITH AMENDMENTS, WITHIN THE DISTRICT'S UNINCORPORATED PORTIONS OF WELD COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 32-1-1002(1)(d), C.R.S., provides that a fire code promulgated by a fire district may be enforced in the unincorporated portions of a county only with the consent of the board of county commissioners of such county, and WHEREAS, the Fort Lupton Fire Protection District ("the District") has presented an ordinance adopting and promising to enforce the 1994 Edition of the Uniform Fire Code and Standards, with certain amendments set forth in said ordinance, within the District's unincorporated portions of Weld County, and WHEREAS, after review, the Board deems it advisable to consent to the enforcement by the District of the 1994 Edition of the Uniform Fire Code and Standards, with certain amendments set forth in said ordinance, within the District's unincorporated portions of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that it hereby consents to the enforcement by the Fort Lupton Fire Protection District of the 1994 Edition of the Uniform Fire Code and Standards, with certain amendments as set forth in the attached ordinance and letter, within the District's unincorporated portions of Weld County. 961648 SD0002 e6.. ONE AND TWO FAMILY DWELLING CODE AND A NEW SECTION DEALING WITH FEES. SECTION 1. Chapter 18 of the Fort Lupton Municipal Code is hereby amended as follows: A new Section 18-7 is added as follows: • Section 18-7 Building Permit Fees. 1. All references to fees in any and all of the Codes adopted in Chapter 18 are hereby deleted with the exception of the special fees shown in Table A-1 of the Uniform Building Code. 2. All fees for all Codes contained in Chapter 18 shall be as shown on the Building Permit fee Schedule as adopted by Resolution by the City Council of the City of Fort Lupton and identified as " City of Fort Lupton Construction Permit Fee Schedule." Chapter 18 Article III of the Fort Lupton Municipal Code is hereby amended to add Sections 18-51a and 18-5 lb as follows: Section 18-51a. The 1995 Edition of The CABO One and Two Family Dwelling Code as published by The Council of American Building Officials 5203 Leesburg Pike, Falls Church, Virginia 22041, is hereby adopted in it's entirety. Section 18-516. All codes are adopted in their entirety, including Appendix, Standards and Evaluation Reports. Am 95-153 1 961648 SECTION 2. Section 18-52 And the Uniform Building Code adopted in 18-51 above is revised to read as follows. The Uniform Building Code shall be amended as follows: A. Work done under Section 106.2 1 and 2 shall require a building permit but the fees required for said permits shall be waived with the execptions of fences and accessory buildings for which there shall be.a fee. B. At Section 106.2 there shall be added the following: "12. Any repairs, remodeling or alterations such as siding, gutters or window replacement that do not effect the structural integrity of the building as determined by the Building Official whose decision shall be final. C. At Section 106.4.4 There shall be added the following: Expiration of permit shall take effect after six (6) continuous months passing without a required inspection being requested by the permit holder and approved by the Building Official. D. At Section 109.1 There shall be deleted the following: "Group R., Division 3 and." E. At Section 1806.1 There shall be deleted the following: "Treated wood." F. At Chapter 18 Foundations and Retaining Walls there shall be added a new section as follows: Section 1801.3 Radon Protection. The Model Standards and Techniques for the Control of Radon in New Residential Buildings as Published by The United States Environmental Protection Agency and ratified by the Council of American Building Officials are a part of this Code. A vapor barrior, sealed at all edges and at all overlapping seams ,with a minimum of four(4) inches of washed gravel either immediatly under the barior or immediatly over the barrier and a four(4) inch pipe extending from under slab through the roof shall be the required minimun standard for meeting the Federal Requirements. SECTION 3. Section 18-71 is amended to delete the reference to the International Conference of Building Officials and insert in it's place "The National fire Protection Association, Batterymarch Park, Quincy, Ma. 02269." Section 18-17 The reference to the International Conference of Building Officials is hereby deleted and the following shall be inserted in it's place, The National Fire Protection Association, Batterymarch Park, Quincy, Ma. 02269. SECTION 4. Chapter 18 Article V Mechanical Code is hereby revised as follows: in Section 19-91. Reference to the 1991 edition is revised to reference the 1994 edition. SECTION 5. Chapter 18 Article WI Fire Code is hereby revised as follows: in Section 18-131. Reference to the 1991 edition is revised to reference the 1994 edition. B. Article 1 Section 105 Permits, is hereby deleted. C. Appendix B-1 Life Safety requirements for Existing Hi-Rise Structures is hereby deleted with the exception of Tables A-1 and B-1. D. Appendix II-C Marinas, is hereby deleted. E. Appendix IV-B Christmas Trees, is hereby deleted. F. Appendix VI-B Model Citations, is hereby deleted. SECTION 6. Chapter 18 Article VIII Administrative Code is hereby revised as follows: in Section 18-161. Reference to the 1991 edition is revised to reference the 1994 edition. SECTION 7. Chapter 18 Article IX Abatement to Dangerous Buildings Code is hereby revised as follows: in Section 18-181. Reference to the 1991 edition is revised to reference the 1994 edition. SECTION 8. Chapter 18 Article X Housing Code is hereby revised as follows: in Section 18-201. Reference to the 1991 edition is revised to reference the 1994 edition. SECTION 9. Stoner, Lead Combination Inspector E� SUBJECT: Adoption of the 1994 Uniform Fire Code and Standards Fort Lupton Fire Protection District The Department of Building Inspection has reviewed the submittal from Fort Lupton Fire Protection District concerning the adoption of the 1994 Edition of the Uniform Fire Code and Standards. Barker Weld Count Attorney Y ' e DATE: August 23, 1996 RE: Request for Approval of Adoption of 1994 Uniform Fire COLORADO Code and Standards within Unincorporated Portions of Fort Lupton Fire Protection District Attached is a copy of the 1994 Edition of the Uniform Fire Code and Standards (as modified) which has been adopted in the Fort Lupton Fire Protection District("the District"). Also attached is a letter stating the District's request that the Board of County Commissioners approve the adoption of the modified fire code in the unincorporated portions of the District. As you may recall, § 32-1-1002(1)(d), C.R.S., requires the approval of the Board of County Commissioners before the District enforces the modified fire code in the unincorporated portions. A copy of that section is attached. I respectfully request that you provide a recommendation to the Board of County Commissioners regarding the District's request. It is my understanding that Weld County Ordinance No. 119-N becomes effective October 1, 1996. That Ordinance adopts the 1994 Edition of the Uniform Fire Code in Weld County. I would like to see that the Board approves the Fort Lupton request so that the modified fire code will become effective in the unincorporated portions of the District on or about October 1, 1996. I have spoken with Edwin D. Stoner, Lead Combination Inspector for the Weld County Department of Planning Services, about your request. He informs me that at the present time Weld County still has in effect the 1991 additions of the Uniform Building Code and the Uniform Fire Code. Last Fall I spoke with Mr. Stoner about a similar request from the Mountain View Fire Protection District. Mr. Stoner then supplied me with a Memorandum which details certain changes in a 1994 Uniform Fire Code which, if adopted in certain portions of Weld County, will create certain discrepancies between the County's versions of the Uniform Fire Code and the Uniform Building Code. Mr. Stoner then informed me that he planned on recommending to the Board of County Commissioners the adoption of the 1994 additions of the Uniform Building Code and the Uniform Fire Code sometime this spring. A copy of Mr. Stoner's Memorandum is enclosed. Mr. Stoner now informs me that the target date for the adoption of the 1994 Uniform Fire Code and 1994 Uniform Building Code is August 1, 1996. He recommends that the Board of County Commissioners refrain from adopting the 1994 Uniform Fire Code within the unincorporated areas of Weld County which lie within Fort Lupton Fire Protection District until after August 1, 1996. 1 will ask my paralegal to tickle this matter for late July, 1996, in order to complete this matter. Until then, however, I respectfully request that you inform me in writing as to whether or not the Fort Lupton Fire Protection District desires to have the entire 1994 Uniform Fire Code adopted 961.
