Environmental Protection Services has reviewed this proposal for a bed and breakfast facility.
We have discussed this with representatives of the Consumer Protection Division of the
Colorado Department of Health and Environment They have indicated that bed&breakfasts are
not subject to regulation as a food service. We also reviewed Colorado Revised Statute
25-4-1601 (14)which defines a retail food establishment and this appears to be consistent.
The following conditions are recommended to be part of any approval:
1) All liquid and solid wastes shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris,and other potential nuisance conditions.
4) Pugitive dust shall be controlled on this site.
5) The maximum permissible noise level shall not exceed the residential limit of 55 db(A)
as measured according to 25-12-102, Colorado Revised Statutes.
6) Adequate toilet facilities shall be provided for the guests and employees.
7) The septic system(SP-9800505 ) shall be installed according to the Weld County
Individual Sewage Disposal Regulations_
8) An individual sewage disposal system shall be required for the proposed three cabins.
The septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.
9) The facility shall be maintained in compliance with the Weld County Bed and
Breakfast Guidelines.
10) Due to the transient nature of this facility, the facility shall test the on-site water source
for bacteria total colifonn annually. Our Department has conducted this test on January
28, 1999 and the water was acceptable. In the event any bacteria total coliform is
detected then treatment procedures shall be required. In the event more that twenty-five
(25)people are served daily by the on-site water source, the water system shall comply
with the requirements for a non-community water system as defined in the Primary
Drinking Water Regulations(5 CCR 1003-I).

12) The applicant shall remove,handle,and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed
to exist or deteriorate to a condition that facilitates excessive odors,flies, insect pests,
or pollutant runoff. The manure storage site shall have a water-tight surface which
does not permit seepage or percolation of manure pollutants into the ground.

SUBJECT: USR-1213; Gary Neill
The Weld County Public Works Department has reviewed this proposal. This project falls
primarily under the purview of the Weld County Use by Special Review Permit. Our
requirements are as follows:
1. WCR 141: WCR 141 is designated on the Transportation Plan Map as a local gravel
road which requires 60 feet of right-of-way at full build out. There is presently 60 feet
of right-of-way. This road is maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the
required setback is measured from the future right-of- way line.
2. Section line: Any future cabins, bunk house, or structures should adhere to the setback
from the section line requirement.
3. Access Drive and Parking: Both locations should have adequate road base to
accommodate the traffic. Width of the drive should be a minimum of 24 feet to
accommodate two-way traffic. The parking area shall accommodate 25 vehicles.
