RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #2297 - BARBARA WERTH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.RS., as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2297, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #2297 was submitted by Barbara Werth, 16734 Highway 52, Fort Lupton, Colorado 80621, for property which is located in Lot A of RE #646, NW% SEY of Section 2, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 8.3 acres and 2.5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2297 submitted by Barbara Werth be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. Lots A and B shall utilize an existing permitted access easement meeting the standards of Weld County Ordinance#180, as amended, and the Colorado Department of Transportation's referral from and to State Highway 52. The joint access agreement shall be clearly shown on the plat and dedicated for the use as shown utilizing the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. B. The applicant shall obtain from the Colorado Department of Transportation an access permit for the existing access from State Highway 52. The permitting process may require improvements to the existing access. C. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the Zone District in which the property is located. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. E. The applicant shall submit evidence to the Department of Planning Services that Lot A has received approval of a domestic well permit from the Colorado Division of Water Resources. F. The applicant shall submit to the Department of Planning Services evidence that the applicant has attempted to meet all of the requirements of School District RE-8 and the Colorado Department of Transportation with respect to the school bus services for loading and unloading children. 3. The applicant must submit evidence to the Department of Planning Services that Lot A has received approval of a domestic well permit from the Colorado Division of Water Resources. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. The 10.82 acre parcel is located South of and adjacent to State Highway 52,approximately%z mile west of WCR 35. The parcel of land under consideration is the total contiguous land holdings of the applicant. Based upon submitted information, referral agencies, and the governing mechanism of the County, the Department of Planning Services' staff recommends this request be denied. The applicant is requesting to divide this section into 2 parcels. Planning staff believes the applicant is compromising the character of the Agricultural zone through the proposed Recorded Exemption request. This application,combined with previous Recorded Exemptions and other pre-Zoning land splits,will create a total of 20 buildable lots in this section, 17 of which will exist in the South 'A of the section. Staff has the following concerns: 1. The applicant has not demonstrated that this application is consistent with efficient and orderly development. This is the fourth request for a Recorded Exemption in the South half of this section, the last of which having been submitted by this applicant: Recorded Exemption 646, William and Marilyn Bosk, recorded on November 21, 1983, aeaiadtwo buildable lots in the Northwest 1/4 of the Southeast 1/4 of this section Recorded Exemption 1949, Philip and Bonnie Johnson, recorded on January 7, 1997, created two buildable lots in the South '/1 of the Southeast 1/4 of this section. Recorded Exemption 2131, Dwayne and Carol Bowen, recorded on April 6, 1998, created two buildable lots in the Southwest 1/4 of the Southwest 1/4 of this section. 981645 2. The conflict between rural and urban activities is evident in this request. When an urban growth pattern is established without regard to long range comprehensive planning the outcome lacks the essential elements of long term desirability. Higher costs are incurred by providing many public services to urban sprawl areas. As urban areas develop and expand they inadvertently influence surrounding areas. These areas are either converted to urban uses themselves or are in direct conflict and competition with agricultural areas. 3. The applicant has failed to comply with the A(Agricultural)zone district intent. This parcel is located outside of an Urban Growth Boundary Area. Continued division of this parcel opposes the intent of the A (Agricultural) zone district. The potential to interfere and encroach upon the agricultural activities of this area is evident. The A(Agricultural)zone district was established to promote and maintain agriculture as a vital support element for Weld County Citizens, and not to be continually decreased for residential development. The Agricultural zone policies discourage the conversion of agricultural land for residential uses within an area located outside of an urban growth boundary. The intent is to eliminate incompatibilities that exist and minimize costs to Weld County tax-payers. The applicant has chosen to further subdivide land in a section that has already experienced a large number of subdivision requests. This request indicates a lack of regard for the long term impacts of the division. If approved,the applicant will not have been required to pay for the cost of public services and improvements that the proposed division will be producing. The Department of Planning Services' staff is concerned with this lack of consistency with the Comprehensive Plan and Subdivision Ordinance. Specifically,the Department of Planning Services' staff recommendation of denial for this request is based upon the application's inconsistency with Section 1.3 of the Weld County Subdivision Ordinance, which ensures efficient and orderly subdivision development within the county,and conflict with A. Goals 1, 3, 4, 6,7, and 9 of the Comprehensive Plan,which define appropriate development goals and policies within the Agricultural zone district. Scattered residential development in rural areas necessitates an increased demand for roads and bridges,police and fire protection,education facilities, utilities and other services. The cost of providing services and the conflicts between rural and urban land uses can be reduced if development is encouraged within urban growth boundary areas or adjacent to existing municipalities. In addition to staffs concerns regarding inappropriate lot density within the Agricultural zone,the application also violates Section 10.5.10 of the Subdivision Ordinance,which restricts flag lot configuration. In this case a flag lot would be created through a requested access easement across Lot B for the benefit of Lot A. The Department of Planning Services' staff requests that the Board of County Commissioners consider the application and determine if the standards of Sections 11.2 through 11.8 of the Weld County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld County Comprehensive Plan. ACCESS The submittal indicates that there is an existing access which is proposed to serve both lots. As this exemption is for the purpose of creating another single family dwelling, the Department would have the warrant to re-evaluate access and would require an access permit based upon the increased traffic to the access. Depending upon the existing condition of the access, it is possible CDOT could require some improvements. My comments are based upon the submittal as received July 7, 1998. Combined with the current recorded exemption under review, as well as other land splits that have occurred in the area, a total of 20 separate legal lots will exist in this section, 17 of which will exist in the south half of the section. Given these circumstances staff believes this application does not demonstrate orderly and efficient development, as directed by Section 1.3 of the Subdivision Ordinance. Specifically, staff's concerns are as follows: 1. The conflict between rural lifestyle and urban-scale infrastructure requirements is evident in this request. Urban-scale development requires an urban-level of service, as directed by the Weld County Subdivision Ordinance. This site is not located in a designated urban-growth area, and no urban-scale services are available. Therefore, while this application, by itself, does not create an urban-scale development, it does contribute to an already urban-type density, and conflicts with R. Policies 2 and 3 of the Comprehensive Plan, which require adequate infrastructure to residential areas, and directs residential development to urban-growth areas, respectively. 5 2. The applicant has failed to comply with the intent of the Agricultural zone district. In particular, A. Goals 1, 3, 4, 6, 7, and 9 of the 1 Comprehensive Plan are compromised by this application. Specifically, policies of "discouraging residential development which is not located •c ' adjacent to existing unincorporated municipalities", and "protecting agricultural land from encroachment by those urban uses which hinder the efficiency and productivity of the agricultural uses" are both challenged by this application. Also, Section 31.1 of the Zoning Ordinance describes the intent of the Ag zone as follows: "to provide areas for the conduct of agricultural activities without the interference of other, incompatible land uses". 3. Of greatest concern to staff is the apparent evasion of the intent of the Recorded Exemption process, as described in Sections 11.2.1 of the Subdiv. Ord., and the outcome of a subdivision process that does not adequately account for the services needed to provide for those living in the area, as well as the negative effect on the rural environment. ) Instead of applying for and adhering to the appropriate subdivision regulations the applicant has chosen to subdivide the land without regard for the long term impacts of the division. By doing so, the applicant will not have been required to pay for the cost of public services and improvements that the proposed divisions will be producing. In addition to compromising the intent of the Agricultural zone district, the application also demonstrates an evasion of Section 10.5.10 of the Subdivision Ordinance, which discourages flag lot configurations, whisk„ through.T.nt B.. The Department of Planning Services' staff requests that the Board of County Commissioners consider the application and determine if the standards of the Weld County Subdivision Ordinance have been met and that the goals and policies of the Weld County Comprehensive Plan have been satisfied.
