Survey methodology follows guidelines specified by the United States Fish and Wildlife Service (USFWS) as outlined in the Interim Survey Guidelines for Preble' s Meadow Jumping Mouse (USFWS 1998) . PROJECT LOCATION Weld County' s proposed gravel mine project lies west of the South Platte River and east of the Koenig Gravel Pit and the town of Vollmer. The project area is located in the northwest quarter of Section 19, Township 2 North, Range 66 West in Weld County. It lies at a longitude of 104 degrees, 55 minutes, 0 seconds and a latitude of 40 degrees, 13 minutes, 0 seconds . UTM coordinates for the project area are -3607 . 8897 and 4468417 . 0828 . The elevation of the site is approximately 4 , 550 feet above sea level . QUALIFICATIONS OF THE SURVEYOR The Preble' s meadow jumping mouse survey was conducted by Darcy A. Tiglas, 5015 Swainsona Drive, Loveland, CO 80537 under Federal subpermit number 98-46 . 98 and State license number 98-TR814 . The surveyor' s general qualifications were submitted to the U. S . Fish and Wildlife Service for review and found acceptable by the Service . PROJECT DESCRIPTION Weld County proposes to mine aggregate from this project area to support the road resurfacing and construction conducted within the county itself . Rural roads are perpetually maintained with gravel to prolong their usefulness and assure safety for motorists . Two pit sites have been identified within the project area, Bearson Pond 1 to the south and Bearson Pond 2 to the north. The entire site is very disturbed from former agricultural practices . SURVEY DATE The survey was conducted on from September 3-6, 1998 from dawn (approximately 6 : 30 am to 9 : 30 am) each day. Bearson Property 3 99d&/ ' METHODS All potential habitat for the mouse was identified within the proposed project area and adjacent areas and these areas were investigated for presence or absence of the mouse with live-traps . These suitable areas were trapped using double trapping transects as recommended by the interim guidelines . Marginal suitable habitat for the species was identified as present within the project area. The decision to survey was made due to the close proximity of the South Platte River and suitable habitat to the project area. However, 400 trap nights was chosen as adequate due to the limited and marginal habitat within the project boundary, but due to the importance of gaining information on the mouse adjacent areas were intensely surveyed for the mouse . Bait used included Quaker rolled oats . A cotton ball or cotton wad was placed in each live trap and traps were cleaned out and all materials replaced each evening of the survey. Approximately a hand-full or one-eighth cup of rolled oats were added to the traps each evening. SURVEY SITE SELECTION CRITERIA Most of the project area is highly disturbed from agricultural practices , heavy equipment operations, and livestock grazing. Suitable habitat for the Preble' s meadow jumping mouse is limited and marginal . However, the project area lies adjacent to the riparian and floodplain of the South Platte River with its overstory of plains cottonwood, pockets of midstory of coyote willows , and an understory of various upland grasses and forbs with interspersed depressions of sedges and rushes . The adjacent areas were intensely surveyed for the mouse and the transition zone between the project area and adjacent area were also surveyed. RESULTS Protect Area The project area is dominated by weedy species like Canada thistle, tumble mustard, and cheatgrass . Part of the project area was formerly a corn field. Little, if any, potential habitat for the mouse was present within the project area. No individuals or populatons of the mouse were captured during the field investigation. Pond "A" & "8" X • X Figure 2 Bearson Gravel Pit Trapping Locations Dote : Jon. 20, 1998 5 Adjacent Areas As described above, the areas adjacent to the project area were dominated by a multi-strata riparian and floodplain community of plains cottonwood, pockets of coyote willows, and grasses and forbs in the understory. Upland floodplain understory species included western wheatgrass, blue grama, Kentucky bluegrass, saltgrass, sideoats grama, boneset, annual sunflower, dotted gayfeather, and western yarrow. Mesic pockets within the understory were dominated by prairie cordgrass, Reed canarygrass, Baltic rush, three-square, great bulrush, Canada thistle, and broad- leaved cattail. Due to livestock grazing in this area, bare ground comprised approximately 45 percent of the total cover. Vegetation cover comprised approximately 30 percent of the total cover and rock and litter comprised approximately 25 percent of the survey area. The plant community was typical of areas within the floodplain of the South Platte River which has shifted across the landscape over time leaving behind a linear tree pattern and upland conditions behind it. Associated Wildlife During the field investigation, small mammals captured included the house mouse, deer mouse, thirteen-lined groundsquirrel, cottontail rabbit, rock squirrel, Norway rat, western harvest mouse, silky pocket mouse, and plains pocket mouse. Various wildlife use these riparian zones. Sign for the following wildlife or actual observations were noted during the field investigation: domestic cat, raccoon, striped skunk, coyote, wild turkey, great horned owl, mule deer, domestic dog, and red fox. Soils and Geomorphology Soils within the project area are Bankard sandy loam and soils within the South Platte River floodplain are Aquolls and Aquents, gravelly substratum (SCS 1980). Bankard soils were formed in stratified recent alluvium along streams and rivers. Aquolls and Aquents is nearly flat and is found on bottomlands and floodplains of major streams and rivers in Weld County. They are deep, poorly drained soils that formed in recent alluvium. Alkalinity is often a component to these soils and was found to be so during the field investigation. Appendix A presents photographs of the project area and adjacent sites. Climatological/Meteorological Conditions Weather conditions were warm days with typical cooling evenings after approximately 6:30 pm each night. Survey methodology follows guidelines specified by the United States Fish and Wildlife Service (USFWS) as outlined in the Interim Survey Requirements for Spiranthes diluvialis (USFWS 1992) . All wetland areas identified within the proposed project area were investigated for potential habitat for Ute ladies' -tresses . These areas were traversed on foot in a zig-zag pattern to determine the presence or absence of Spiranthes diluvialis in the survey area . No individuals or populations of the plant were identified during the July 24 , 1997 survey. Suitable habitat for the species is not present within the project area. QUALIFICATIONS OF THE SURVEYOR The Spiranthes diluvialis survey was conducted by Darcy A. Tiglas . The surveyor' s general qualifications and plant species-of-concern survey experience are included in Appendix A. The surveyor visited a known population of Spiranthes diluvialis on July 23 , 1997 . These populations are located in Boulder County, Colorado near the intersection of United States Highway 36 and Foothills Parkway. Appendix B includes photographs of the orchid in bloom on this date . Due to the hot, dry summer conditions, only two flowering plants were observed on this field visit . Two pit sites have been identified within the project area, Bearson Pond 1 to the south and Bearson Pond 2 to the north. The entire site is very disturbed from former agricultural practices . No potential wetlands occur within the project area, which is upland of the South Platte River riparian area and adjacent wetland areas . One small depression area was observed during the field survey. It was dominated by plains cottonwoods in the overstory and smooth brome in the understory. Due to the woody material present within this area, it has been excluded from mining and will be left as is . SURVEY DATE The survey was conducted on July 24 , 1997 . SURVEY SITE SELECTION CRITERIA Any wet areas, depressions, or meadows within the project area were reviewed for potential habitat for Spiranthes diluvialis since the project occurs along the South Platte River (within the 100-year floodplain) . Any potential habitat was carefully searched for flowering orchids and on hands and knees for any herbaceous plant parts, like basal leaves . RESULTS Appendix C presents photographs of the project area . The site is dominated by weedy species like Canada thistle, tumble mustard, and cheatgrass . Part of the project area was formerly a corn field. No potential habitat for the orchid was present within the project area and no individuals or populations of the orchid were found during the site survey. Weld County will make use of this additional gravel area to obtain sand and gravel for use in the immediate quadrant of County roads to eliminate the long hauling distances. This procedure establishes an intermittent use of the pit. The mining plan is to haul material to County roadways in the vicinity when the need arises. Normally,all material excavated and processed will be removed from the site and no major stockpiles will remain. Operating equipment will consist of dozers, loaders, trucks, excavators, haul trucks, portable crushed and de-watering pump. The County plans to continue the mining as it has been done previously, moving across the road to the east on the Bearson Property. Existing topsoil will be removed from the area to be mined and placed on the previously exposed and finished pit area. One (I) foot of topsoil and overburden exists. All excess topsoil will be stockpiled for the final reclamation process. The mining and processing will then take place. It is suggested that the applicant contact the Mined Land Reclamation Division of the Colorado Department of Natural Resources concerning reclamation rules and regulations. All Items of the application must be completed accurately and in their entirety or the application will be deemed incomplete and processing of the permit will not begin until all information is received. It is our position that the existing agricultural status of the proposed gravel operation be maintained, and that permission for the creation or expansion of new gravel operations in the area be be denied . As arguments in support of our position, we offer the following : 1 ) Our property at 8924 WCR-25 is currently zoned for agricul- tural activity . My neighbors both to the north and to the south along WCR-25 use their property for sundry agricultural activities , from raising horses and cattle, to growing hay, corn and grain . The introduction of increased heavy (gravel , etc . ) truck traffic along WCR-25 would create a drastically increased traffic safety hazard along WCR-25 , a raised , two lane , narrow road . 2 ) The purpose for my purchasing my property at 8924 WCR-25 was to provide an area to raise and train horses . Since I bought the property , my new neighbors have also opened up extensive horse breeding and training operations . As I am sure you are aware , young horses . such as those to be trained along WCR-25 , are usually quite skittish. To introduce a parade of large noisy gravel trucks along the road while a trainer is trying to train young, skittish and, usually, frisky young horses , is introducing an unnecessary complication to an already difficult task . 3 ) I understand that Weld County will require the gravel company to landscape the gravel area into a series of ponds and wildlife areas . This is a great idea , and it has worked well here in Boulder County, as well as in other counties . However , the gravel restoration areas I have seen here in Boulder County and in other areas are away from residences and farms . With the recent settle- ment along WCR-25 , the population density of both humans and animals , has greatly increased. When , in the future , when the gravel has been exhausted and the ponds , etc have been created, those same ponds will become major breeding grounds for mosqui- toes . The result will likely be greatly increased mosquito activity in an already active river bottom area . MST 99a0169 I 9906/(0 2 - 4 ) The Legal Description of the area to be mined seems to indicate an extensive volume of gravel to be removed . 7 would suggest that moving that volume of material in large , heavy gravel trucks for an extensive period of time will greatly deteriorate WCR-25 , as well as , any adjacent roads used by those trucks . Thus Weld County would bear the cost of providing roads over which the gravel mining company would haul away Weld County gravel (pieces of Weld County, if you will ) to places unknown . For these reasons , I would like the Weld County Planning Commission to deny the subject gravel mining permit . As the owner and partner of Westview Quarterhorses, I am very much opposed to this operation. I have sincere concerns from both a business operation and as a concerned citizen. First, let me state that I am amazed that FEMA and Weld County has even considered this project. This projected operation could cause the Platte River to more easily extend beyond its existing banks causing damage to my property. In addition, when we secured our permits we had to also insure to the County that: no more than 40 vehicles would access our property daily. This operation could easily surpass this vehicle limitation. As a business owner and partner, I am opposed to the addition of a gravel mining operation for the following reasons: The increased traffic and equipment will have an adverse impact on our pasture operations. The traffic and equipment is not conducive to brood mares and horse care in general. The equipment is inherently loud and offensive. This noise will have a definite impact to our breeding stock. This increased traffic will also have an impact on our operations through both noise and air pollution. The stress encountered by our mares through this noise and increased traffic is substantial. 990 /&' The open pit will retain stagnate water and breed undesirable insects. At great expense when we built our property, we imported fill dirt to avoid a similar pit and the insects that occupy stagnate water. Insects of any type, spread disease and will have an adverse impact our breeding operations. We are ever vigilant controlling the spread of disease from Sects. This mining operation will only produce the perfect place for insects to breed. We intend to build our house in the east area of our property near the projected gravel pit. We have no desire having such an operation in such close proximity to our principle residence. From a concerned citizen standpoint, the proposed gravel mine operations will have an ecological/environmental impact to this pristine property, in the following areas: i have already addressed the possibility that this project will more easily allow the Platte River to extend outside its established banks. Flood insurance is very expensive. Why should I and my business pay for the possibility of increased premiums? Why should this risk even be taken? This proposed gravel pit will have an effect on the breeding area of several protected species, that of the American Bald Eagle and American Turkey. The tree line along the Platte River is a natural habitat for both these species. I can not be sure what other animals and birds use this area for breeding purposes. I am confident that the County will conduct an environmental assessment/impact study of these protected species and others, prior to any new mining operations. I have coordinated these assessment's and the government does not take kindly to the notion that protected species are displaced for the reduced costs in hauling materials. This proposed gravel pit will also adversely impact the herd of white tail deer in the area. Disturbing their natural habitat is unthinkable. Finally, the established gravel pit is seen as a convenience to Weld County saving haul costs. Our neighbors, like ourselves, see it as an substantial inconvenience. We have no desire being subjected to the increased traffic, noise pollution and the devastating impact on our environment. I also share concerns with our neighbors that the property boundaries surveyed are incorrect. I can not be confident that the property that we purchased was surveyed correctly. Why are all the other parcels of property in 40 acre plots, while this property was surveyed at under 39 acres? After a review of the existing plots, it would appear that property boundaries have been shifted on several occasions. I ask that you and Weld County explore these possible irregularities. As you can clearly see, I am most opposed to this gravel mining operation, for business and environmental concerns. I am available to discuss this proposal, with yourself or others.
