Dear Bruce:
This office represents Bill and Rene Hange who own property
approximately 3/4 of a mile east of State highway 37, on County
Road 388.
During the week of April 3, 1995, the County engaged in
construction; specifically, the replacement of a 48 inch culvert
under County Road 388. The worksite adjoined the Hange property.
During construction, the County placed signs at either end of the
construction site indicating that the road was closed and that a
detour was necessary; however, no detour route was provided.
Travelers took various routes across the hange property including
through their yard and when the Ranges blocked the road through
their yard, the travelers then drove across the recently planted
alfalfa field, causing monetary damages to Mr. & Mrs. Hange.
Prior to the County's construction, the culvert was located on
the north side of County Road 388 which allowed the Hange
irrigation wastewater to flow into the seep ditch which runs under
road 88 and the installation of the culvert was for the purpose of
carrying the seep ditch water under road 88. The County crews
ripped out Hanges' culvert and did not replace it. Since that time
whenever the Hange property is irrigated, water floods portions of
County Road 88, since the tailwater now has no outlet.
The County crews removed a tree which was not located in the
right-of-way causing monetary damage to the Hange property.
The County's employees were generally at the worksite were
generally inconsiderate of the Hange complaints and generally
ignored their request to keep traffic off of the private property.
The County administrative employees ignored the Hange complaints.
Please consider this letter notice pursuant to C.R.S. 24-10-

Claimants: Bill and Rene Hange, 5121 W. 11th Street,
Greeley, Colorado
The employees involved are not known; however, they are
employees of the County Engineer's office and the county Road &
Bridge Department. The damages requested are as follows:
a. The County replace the culvert or pipe allowing the Hange
wastewater to flow into the seep ditch.
b. That the County replace the tree destroyed on the Hange
property or pay compensation in the amount of $4000.
That the County pay compensation for reseeding of the
farm land in the -amount of $250.
d. That the County provide evidence of the location of the
right-of-way of County Road 388 as it borders the Hange property.
e. That the County pay compensation in the amount of $1000
as compensation for the public's use of the private property during
construction.
f. That the County pay the appropriate compensation for
property taken for use of the roadway, which is not within the
County right-of-way.
