TO SIGN EASEMENT WITH BEN H. GREGG AND ARTIE GREGG FOR SURFACE GRAVEL
LOCATED IN THE SOUTHEAST CORNER OF SECTION 14, TOWNSHIP 1 NORTH,
RANGE 63 WEST, FOR A PERIOD OF TEN YEARS WITH THE OPTION TO RENEW:
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that they sign Easement with Ben H. Gregg and Artie Greg', Box 267,
Loveland, Colorado, for surface gravel located in the Southeast corner of Section
14, Township 1 North, Range 63 West, of the 6th P.M., Weld County, Colorado, more
particularly described as follows, to-wit:
Corrected description as per agreement between Ben H. Gregg and
Commissioner Geo. L. Andersen:
Beginning at the Southeast corner of Section 14, Township 1 North,
Range 63 West of the 6th P.M., thence, North along the East line of
said Section, 590.0 feet; thence, South 89° 49' West, parallel to
the South line of said Section, 55.0 feet to the true point of beginning;
thence, continuing South 89° 49' West, a distance of 330.0 feet; thence,
North parallel to the East line of said Section, 660.0 feet; thence,
North 89° 49' East, 330.0 feet; thence, South 660.0 feet to the true point
of beginning. Contains 5.00 acres, as per attached Map surveyed 6/24/58
by Robert L. Sandquist, Registered P.E. and L.S. #2827, and as per correct-
ions noted in red. This agreement shall be in effect for a period of 10
years, with option to renew.
It is agreed that the party of the second part will gravel farm stead where
gravel pit is located and also adjoining properties of the parties of the
firsttpart so long as the ownership does not change.
Also, agreement for ingress and egress. The consideration is $750.00.
Reference is hereby made to the records of the Weld County Recorder,
Book 1512 at Page 98 .

by and between BEN H. GREGG AND ARTIE GREGG
of Weld County, Colorado, parties of the first part, and The County of Weld, in the State of Colorado,
a municipality, party of the second part:
WITNESSETH: The part ies of the first part, for and in consideration of
SEVEN HUNDRED AND FIFTY AND NO/100 ($750.00) Dollars,
to first parties in hand paid by the party of the second part, the receipt whereof is hereby confessed
and acknowledged, do hereby bargain, sell and convey unto the party of the second part, its succes-
sors and assigns, the right to remove all gravel, sand and road-making and building material which it
shall be able to remove from the following described lands, situate in the County of Weld and State of
Colorado, to-wit: IN SOUTHEAST CORNER OF SECTION 14, TOWNSHIP 1 NORTH, RANGE 63 WEST, of
the 6th P.M., WELD COUNTY, COLORADO: Beginning at the Southeast corner of Section 14,
Township L North, Range 63 West, of the 6th P.M. ; thence, North along the East line
of said Section, 590.0 feet; thence, South 89° 49' West, parallel to the South line
of said Section, 55.0 feet to the true point of beginning; thence, continuing
South 89° 49' West, a distance of 330.0 feet; thence, North, parallel to the East
line of said Section, 660.0 feet;thence, North 89° 49' East, 330.0 feet; thence, South
660.0 feet to the true point of beginning. Contains 5.00 acres,
It is agreed that the party of the second part will gravel farm stead where gravel
pit is located and also adjoining properties of the parties of the first part so
long as the ownership does not change.
This agreement shall be in effect for a period of 10 years, with option to renew.
The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees
that said tract of land shall be excluded from further assessment for taxes; the first parties hereby
granting to the party of the second part the right to enter upon said lands at any time hereafter and to
excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its
needs, together with the rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right to remove therefrom
the part of the surface thereof as hereinabove set forth. This contract shall be binding upon and inure
to the benefit of the heirs, administrators, and assigns of e parties of the first part, and the succes-
sors and assigns of the party of the second part. , f
