RE: APPROVE PURCHASE OF SERVICES AGREEMENT BETWEEN HUMAN SERVICES'
AREA AGENCY ON AGING AND HEALTH DEPARTMENT'S NURSING DIVISION AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Purchase of Services Agreement
between Weld County Human Services' Area Agency on Aging, and Weld County Health
Department's Nursing Division, commencing May 20, 1995, and ending August 10, 1995, with
further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Purchase of Services Agreement between Weld County Human
Services' Area Agency on Aging, and Weld County Health Department's Nursing Division be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 5th day of June, A.D., 1995, nunc pro tunc May 20, 1995.

Purchase of Services Agreement
THIS AGREEMENT, made and entered into this 1st day of June, 1995 by and
between Weld County Division of Human Services' Area Agency on Aging, hereinafter
referred to as "AAA" and the Weld County Health Department's Nursing Division,
hereinafter referred to as "WCHD."
WITNESSETH:
WHEREAS, AAA develops and administers the Area Plan for a comprehensive and
coordinated system of services, and
WHEREAS, AAA desires to promote strategiesfor maintenance of good health,
among older adults in order to maintain their independence, and
WHEREAS, WCHD is a Weld County Governmental organization existing for the
purpose of providing health education, health screening, and in home case
management, and
WHEREAS, AAA desires to purchase health promotion/disease prevention
services from WCHD for older persons at risk of declining health due to isolation
and irregular monitoring of health status,
NOW THEREFORE, it is mutually agreed:
1. The AAA hereby agrees to purchase up to 72 hours of public
$16.00 per hour for two rural well adult clinics (3 hours
site); one to be located in South Weld County.
2. The AAA agrees to purchase up to 400 hours of public nurse
per hour for in home health case management for at risk,

3. The AAA agrees to reimburse mileage associated with in home public nurse
visits at .25 per mile up to 3,790 miles.
4. The AAA agrees to reimburse WCHD for all eligible project costs up to but
not exceeding the sum of $8,500.
5. The AAA agrees to provide training to WCHD staff on access to and
utilization of elderly community support services.
6. WCHD agrees to utilize the resources of Weld County's elderly community
support services to the maximum extent possible to improve the quality of
life of each client served under this agreement.
7. WCHD agrees to attend the Weld County Continuum of Care Coordination
Committee meetings on a regular basis for the purpose of enhancing the
coordination of services among service providers.

8. WCHD agrees that the services to be provided under this agreement will
begin within thirty (30) days of the signing of this agreement and will
include any or all of the services outlined in EXHIBIT A (SCOPE OF
SERVICES).
9. WCHD agrees to document and report any project income received as a result
of services provided under the Agreement.
10. WCHD agrees to include the following statement in any written materials
(pamphlets, brochures, announcements, etc.) or in any verbal
presentations: "WCHD is supported, in part by funds provided by the Weld
County Area Agency on Aging through the Older Americans Act."
11. WCHD understands that AAA is required to conduct periodic evaluations of
the activities conducted under this Agreement and to monitor on an ongoing
basis the performance of WCHD to insure that the funds made available by
the Agreement are expended in keeping with the purposes for which they
were awarded; and WCHD accordingly agrees to cooperate fully with the AAA
in the conduct of such evaluation and monitoring, including the keeping
and supplying of such information, and providing access to documents and
records to the AAA for the purpose of audit; and further agrees to do all
things necessary to enable AAA to fulfill its obligation to the State of
Colorado and the United States Government.
12. Any changes, including any increase or decrease in the amount of WCHD's
compensation, and including changes in budget allocations which are
mutually agreed upon by and between the AAA and WCHD, shall be
incorporated in written amendments to this Agreement and in appropriate
revisions to the grant proposal.
13. WCHD understands and agrees that the following provisions are part of the
official application and as such become binding upon commencement of the
project:
a. Agrees that the project will be carried out in accordance with the
Federal program and fiscal regulations, the policies and procedures
established for grants by the State Agency, and the terms and
conditions of the project application approved by AAA in making this
award of funds; specifically, agrees to abide by the dollar amounts
as shown in the budget by program and cost categories.
b. Understands that if there is Federal/State cash unearned at the time
the project is terminated, this amount must be returned to the AAA
unless the AAA otherwise stipulates.

c. Understands that the project's fiscal affairs are subject to audit.
If costs are disallowed, the proportion of Federal/State funds
disallowed must be returned to the AAA.
d. Understands that this award is made for the period amounts stated in
this Agreement. This Agreement in no way implies further funding.
e. Agrees to keep records and make reports on the forms required by the
AAA and in accordance with guidelines issued by the State of
Colorado and the Administration on Aging, specifically,
To submit monthly financial and quarterly programmatic reports
to the AAA by the 10th of the following month;
To submit a final financial report within 45 days after the
end of the project year;
f. Agrees to advise the AAA of needed program and financial changes and
await approval from the AAA prior to change implementation.

Agrees that a ten percent (10%) local, non federal cash or in -kind
match is a minimum requirement for receipt of Title III funds under
the Older Americans Act.
11. No portion of the Agreement shall be deemed to constitute a waiver of any
impunities the parties or their officers or employees may possess, nor
shall any portion of this Agreement be deemed to have created a duty of
care with respect to any persons not a party of the Agreement.
12. No portion of the Agreement shall be deemed to create an obligation on the
part of the County of Weld, State of Colorado, to expend funds not
otherwise appropriated in each succeeding year.
13. If any section, subsection paragraph, sentence, clause, or phrase of this
Agreement is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions. The
parties hereto declare that they would have entered into this Agreement
and each and every section, subsection, paragraph, sentence, clause, and
phrase thereof irrespective of the fact that any one or more sections
subsections, paragraphs, sentences clauses, or phrases might be declared
to be unconstitutional or invalid.
14. The term of this Agreement shall be from June 1, 1995 through May 31,
1996.

15. This Agreement may be terminated upon thirty (30) days written notice by
either party. This Agreement shall be terminated immediately in the event
of loss of funding to the Area Agency on Aging.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day
first written above.

EXHIBIT A: SCOPE OF SERVICE
I. Overall Description of the Project
Title III Part F Health Promotion/Disease Prevention is funded under the Older
Americans Act. The Goal of the Area Agency on Aging is to develop services in
Weld County which will be well coordinated with existing health education and "at
risk" client intervention services. This program is designed to utilize any and
all community resources available to identify and connect clients with the health
care services network and return them to the community with interventions and
support that encourage the pursuit of the healthiest lifestyle possible for both
immediate benefits and avoidance of premature Acute Care or LTC service and
facility placement.
The Health Promotion/Disease Prevention project with Weld County Health
Department is designed to:
1. Encourage referral of at risk individuals for health services
intervention
2 Provide intervention screening/assessment and "case management"
Assistance to older persons relative to health styles that exhibit
self neglect, neglect, at risk of institutionalization, unhealthy
lifestyle causing a detrimental effect on health
3. Utilize health and senior services network for intervention and
follow-up to help maintain a healthy lifestyle for the older
individual
4. Provide education to enhance awareness of health problems and
appropriate preventative/wellness activities.
II. Specific Services to be Provided
The following services may be provided; however the list is not intended to be
inclusive:
1. Health risk assessments
2. Routine health screening, such as hypertension, glaucoma,
cholesterol, cancer, vision, hearing, diabetes, and nutritional
screening
3. Nutrition education and counseling
4. Health promotion services including but not limited to chronic
disabling conditions associated with smoking, alcohol, stress
management, weight loss and control
5. Home injury control services including injury prevention assessments
6. Medication management screening and education
7. Self care training utilizing Healthwise for Life manuals
8. Information, referral, advocacy, and counseling regarding social
services and health services based on any of the above

Service Agreement with Weld County Health Department
Subject:
Enclosed for Board approval is a Purchase of Service Agreement between the
Weld County Area Agency on Aging and the Weld County Health Department to
purchase 472 hours of public nurse time at $16.00 per hour. Services
include up to 72 hours of additional well adult clinic hours and 400 hours
of home health case management for at risk, isolated older adults of rural
Weld County. Eligible project costs are not to exceed $8,500.
This project is one of several programs to be funded under Part VII Health
Promotion monies of the Older Americans Act. The program was reviewed and
approved by the Weld County Area Agency on Aging Advisory Board.
