RESOLUTION
RE: APPROVE RELEASE OF WARRANTY COLLATERAL IN THE AMOUNT OF
$8,525.60 AND ACCEPT ROADS FOR FULL MAINTENANCE - INDIANHEAD
ESTATES SUBDIVISION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 27, 1993, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements and an
Escrow Agreement for Indianhead Estates between John H. Hanna/Indianhead Estates Limited
Liability Company and the County of Weld, State of Colorado, and
WHEREAS, by Resolution dated November 7, 1994, the Board did accept the roads
within said subdivision for partial maintenance, and
WHEREAS, by Resolution dated December 7, 1994, the Board, did accept Warranty
Bond No. 43-21-33 with Old Republic Surety Company, in the amount of $8,525.60, and
WHEREAS, Indianhead Estates Limited Liability Company has requested the release of
said bond and acceptance of all roads within said subdivision for full maintenance, and
WHEREAS, after study and review and based upon the recommendations from the
Department of Planning Services, Public Works, and County Attorney staff, the Board deems it
advisable to approve said request to release collateral in the amount of $8,525.60 and accept
the roads within said subdivision onto the Weld County road system.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Warranty Bond No. 43-21-33 with Old Republic Surety Company,
in the amount of $8,525.60, be, and hereby is, released.
BE IT FURTHER RESOLVED by the Board that the roads within the Indianhead Estates
Subdivision be, and hereby are, accepted for full maintenance by Weld County.

John Hanna of Indianhead Estates Limited Liability Company requests release of Warranty Bond No. 43-
21-33 in the amount of $8,525.60 issued by Old Republic Surety Company for improvements to Indianhead
Subdivision.
Street (Arikaree Road and Lakotah Court) and utility improvements to serve the above referenced lots have
been completed in accordance with the Improvements Agreement According Policy Regarding Collateral
for Improvements, dated November 10, 1993.
The Public Works Department and Department of Planning Services have inspected the site and have no
objection to the release of funds. The County Attorney's Office has reviewed the request and has no
conflict.
Staff recommends the Board authorize release of the $8,525.60 warranty bond.

Attached you will find a copy of the Warranty Bond furnished to
Weld County in the amount of $8,525.60, written for the period
ending September 30, 1995. Since warranty work has either been
non-existent or completed, we would like to ask for release of
the bond at this time.
Please sign and date the enclosed Release form, and return it to
the agency who provided the bond: Bartels & Noe Agency, Inc.,
P.O. Box B, Greeley, CO 80632.

WARRANTY BOND
KNOW all men by these presents;
That Indianhead Estates Limited Liability Company, as Prin-
cipal, and Old Republic Surety Company, as Surety, are hereby
bound unto the County of Weld, State of Colorado, in the sum of
Eight Thousand Five Hundred Twenty -Five and 60/100 Dollars
($8,525.60), to be held as "Warranty Collateral" for 10% of the
value of improvements, excluding improvements fully accepted for
maintenance by the responsible governmental entity or utility
company, for a period ending September 30, 1995, as contained in
the agreements between the County of Weld, State of Colorado, and
Indianhead Estates Limited Liability Company, to which payment
well and truly to be made we do bind ourselves, our heirs, execu-
tors, and assigns jointly and severally by these presents.
NOW THEREFORE, if said Principal shall complete all warranty
work as specified, then this obligation shall be null and void,
otherwise to remain in full force and effect.

Subject: Indianhead Estates --Release of Warranty bond request
Dear Mr. Emrys:
Thank you for your letter dated October 9, 1995, in which you request release of Warranty bond
for improvements to Indianhead Estates.
The Weld County Public Works Department made an inspection of the property on October 24,
1995. Prior to release of the bond, Weld County will require that street identification signs be
placed for both Arikaree Road and Lakotah Court, in accordance with the attached
memorandum dated October 25, 1995, from Don Carroll. When written verification of the sign
placement is received from you by the Department of Planning Services, this request will be
scheduled on the Board of County Commissioners' hearing agenda for its consideration.

On October 24, 1995, I visited the site per the request of Indianhead Estates, Ltd. Liability Company.
I reinspected the asphalt, base, shoulder and drainage portion of the construction, and have found
no conflict with this project. However, the water valve at the intersection of Lakotah Court and
Arikarce Road will be raised per a spokesman of The Little Thompson Water District. In addition,
it will be the responsibility of the developer to install the street name signs.
Once the water valve is raised and the signs are installed, I recommend the warranty bond be
released and that Lakotah Court and Arikarce Road both be placed on the County system for full
maintenance. The remaining roads of the subdivision are already being maintained by the County.

At the request of the applicant, I made a final inspection of Indianhead Estates. In reference to my
memorandum dated October 25, 1995, the items that were inspected and verified were two
intersection street signs and a water valve riser. The signs were installed and the water valve riser
was installed in concrete and brought to the surface. All were placed to my satisfaction.
I recommend that the Warranty Bond is released, and that Lakotah Court and Arikaree Road both
be placed on the County Maintenance System. The remaining roads of the subdivision are already
being maintained by the County.

On December 30th, I talked to Don Carroll about the release of the warranty bond
on this project. He told me he would try to do the inspection today, the 31st. He
will probably recommend the warranty bond be released.
