HomeMy WebLinkAbout970127.tiff38_s RESOLUTION RE: APPROVE RELEASE OF WARRANTY COLLATERAL IN THE AMOUNT OF $8,525.60 AND ACCEPT ROADS FOR FULL MAINTENANCE - INDIANHEAD ESTATES SUBDIVISION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 27, 1993, the Board did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements and an Escrow Agreement for Indianhead Estates between John H. Hanna/Indianhead Estates Limited Liability Company and the County of Weld, State of Colorado, and WHEREAS, by Resolution dated November 7, 1994, the Board did accept the roads within said subdivision for partial maintenance, and WHEREAS, by Resolution dated December 7, 1994, the Board, did accept Warranty Bond No. 43-21-33 with Old Republic Surety Company, in the amount of $8,525.60, and WHEREAS, Indianhead Estates Limited Liability Company has requested the release of said bond and acceptance of all roads within said subdivision for full maintenance, and WHEREAS, after study and review and based upon the recommendations from the Department of Planning Services, Public Works, and County Attorney staff, the Board deems it advisable to approve said request to release collateral in the amount of $8,525.60 and accept the roads within said subdivision onto the Weld County road system. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Warranty Bond No. 43-21-33 with Old Republic Surety Company, in the amount of $8,525.60, be, and hereby is, released. BE IT FURTHER RESOLVED by the Board that the roads within the Indianhead Estates Subdivision be, and hereby are, accepted for full maintenance by Weld County. Liability Company. I reinspected the asphalt, base, shoulder and drainage portion of the construction, and have found no conflict with this project. However, the water valve at the intersection of Lakotah Court and Arikarce Road will be raised per a spokesman of The Little Thompson Water District. In addition, it will be the responsibility of the developer to install the street name signs. Once the water valve is raised and the signs are installed, I recommend the warranty bond be released and that Lakotah Court and Arikarce Road both be placed on the County system for full maintenance. In reference to my memorandum dated October 25, 1995, the items that were inspected and verified were two intersection street signs and a water valve riser. The signs were installed and the water valve riser was installed in concrete and brought to the surface. All were placed to my satisfaction. I recommend that the Warranty Bond is released, and that Lakotah Court and Arikaree Road both be placed on the County Maintenance System.
