RE: REGULATING, WARNING AND GUIDING TRAFFIC DURING THE TEMPORARY
CLOSURE OF WELD COUNTY ROAD 52 BETWEEN WELD COUNTY ROADS 87 AND 97
AND ON WELD COUNTY ROAD 97 BETWEEN WELD COUNTY ROADS 52 AND 74
INDEFINITELY UNTIL SUCH TIME AS THE DIRT BLOWING PROBLEM HAS BEEN
ALLEVIATED
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 42-4-410(6)(a), CRS:
"...local authorities, with their respective jurisdiction may, for the
purpose of road construction and maintenance, temporarily close to
through traffic or to all vehicular traffic any highway or portion thereof
for a period not to exceed a specified number of work days for project
completion and shall, in conjunction with any such road closure
establish appropriate detours or provide for an alternative routing of
the traffic affected...", and
WHEREAS, the Board, pursuant to said statute and upon the basis of traffic and personal
investigations, has determined that conditions exist which make it necessary to temporarily close to
through traffic and to regulate, wam and guide vehicular traffic on said County roads by posting signs
thereon.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, deems it necessary to regulate, warn and guide vehicular traffic on County roads
and any intersections thereof, and it hereby authorizes and orders the posting of such traffic control
devices as shall be reasonably necessary to regulate, warn and/or guide traffic thereon for the safety
of the general public and that said traffic control devices shall conform to the Federal Manual on
Uniform Traffic Control Devices.
BE IT FURTHER RESOLVED that the Board of County Commissioners of Weld County,
Colorado, does declare and establish that Weld County Road 52 between Weld County Roads 87
and 97 and Weld County Road 97 between Weld County Roads 52 and 74 be temporarily closed,
with said closure being effective March 20, 1996, until such time as the dirt blowing problem has
been alleviated, and further, that standard official traffic control devices shall be erected at said
closure giving notice of the restrictions.

Please place the following item on the Board's agenda for Wednesday,
March 20, 1996:
Consider a solution to blowing sand on WCR 52 between WCR 87 X WCR 97
and on WCR 97 between WCR 52 X WCR 74 .
The wind has caused the sand to build up and the road will have to be
closed.
Bruce Barker will produce documentation at the Board Meeting.

RE: Dirt Blowing From Property Located in
Sections 1, 12, 13, 25, 26, 27 and 28,
Township 5 North, Range 61 West of the 6th

Dear Mr. Packard:
The Weld County Public Works Department has informed the Board of County Commissioners
of Weld County that dirt is blowing from properties farmed by you located in Sections 1, 12, 13,
25, 26. 27, and 28, Township 5 North, Range 61 West of the 6th P.M., Weld County, Colorado.
The dirt is blowing onto Weld County Roads.52 and 97, including that portion of WCR 97 which
is maintained by Morgan County (between Morgan County Roads AA and DD). These
roadways have been inundated by dirt during recent storms and are now impassable.
Section 35-72-103, C.R.S., requires all owners of lands in Colorado to control and abate dirt
blowing from their lands. Additionally, the landowners are responsible for the costs of any
damage caused by dirt blowing onto public and private properties, including the costs of cleanup.
To date, Weld County has expended approximately 62 man hours using two cat graders to clean
WCR's 52 and 97. The Board of County Commissioners has considered setting the matter for a
formal hearing in order to obtain reimbursement from you for the costs of cleanup. The Board is '
willing to refrain from setting such a hearing, as long as you perform remedial measures to
alleviate the dirt blowing in the short term, and take steps to fix the situation for the long term.
You are currently discussing the issue of remedial measures with Mr. Ray Mallory of the
U.S.D.A. Soil Conservation Service. He has recommended as a short term measure that you
apply sludge over an area 100 feet back from the roadways. According to Mr. Mallory, you are
in the process of receiving bids for the sludge application. His long term solution is for you to
plant a cover crop of grass on the properties.

Please be advised that the short term remedial measures must be performed on the properties no
later than April 10, 1996. If such measures arc not completed by that date, the Board will set the
matter for formal hearing and may seek reimbursement for a portion or all of the costs incurred
by Weld County in cleaning the roadways.
