The Weld County Council met in regular session in full conformity with the Weld
County Home Rule Charter at the Grover Town Hall, Grover, Colorado, Wednesday,
September 4, 1996, 7:30 p.m.
ROLL CALL: The meeting was called to order by President Stephanie Hayward.
The following members were present, constituting a quorum of the members thereof:
Vice President Pam Malcom, Councilman Ralph Campbell, Councilwoman Judy Curtis,
and Councilman Jim Gardner. Also present: Commissioner George Baxter, Mayor
Ralph Hayes, Al Timm, Dale Westcott, Jim and Carol Millette, Karel Smock, David Nira,
Mabel L. Baxter, Frank and Mabel E. Baxter, Marion Franks, and the Council secretary.
APPROVAL OF MINUTES: Councilman Jim Gardner made a motion to approve the
August 7, 1996 meeting minutes noting the date correction on pages two through four.
Councilman Ralph Campbell seconded the motion and it carried unanimously.
ADDITIONS TO THE AGENDA: There were no additions to the agenda.
GUEST SPEAKER AND PUBLIC COMMENTS:
President Stephanie Hayward asked Councilwoman Judy Curtis to introduce the
speaker. Councilwoman Judy Curtis introduced Commissioner George Baxter to speak
about Weld County's November ballot issues. Commissioner Baxter stated that in the
November, 1996 election County citizens will have an opportunity to vote whether a
pre-parole prison will be built in the Del Camino area of Weld County. He outlined the
history of the proposed facility. He said that local citizens opposed to the pre-parole
prison had taken the issue to court several times. He felt it was important that all
citizens understand that the County will potentially have to pay The Villa for their
"vested rights" in the project, if the pre-parole facility is rejected by the voters.
Citizens asked questions about the possibility of getting Weld County Road 390 paved.
If paving was not possible, they requested better maintenance for the road.
Commissioner Baxter explained the County's system for setting priorities for road
paving. He also suggested contacting the Road and Bridge maintenance supervisor
regarding specific sections of road needing improved maintenance. The distribution of
Bankhead Jones monies for the Pawnee Grass Lands was discussed. President
Stephanie Hayward expressed concern that the Bankhead Jones money designated for
the Pawnee Grass lands was not used in the grass lands area. Councilman Jim

Gardner suggested that the Town of Grover investigate grant money opportunities
available to municipalities.
CORRESPONDENCE: The Council reviewed the correspondence.
APPOINTMENTS: Councilman Jim Gardner said that he would attend the Elected
Officials meeting September 9,1996. Councilman Ralph Campbell said that he would
attend the Council's September 12 appointment with the Commissioners for its "Early
Warning Budget Hearing."
Councilman Jim Gardner also committed to do the September 17 KFKA "Coffee Break."
President Stephanie Hayward suggested that Councilman Gardner ask a former Home
Rule Charter Commission member to participate with him for the "Coffee Break."
COORDINATOR REPORTS:
County Legal Notices - President Stephanie Hayward
President Stephanie Hayward asked the secretary to get a copy of the public notice for
bid for the County Newspaper. After reviewing that information she will make her
report regarding the printing of County legal notices. Mr. Timm suggested that the
Council initiate advertising to Weld citizens where the County's legal notices are
published.
Building Inspection Concerns - Councilwoman Judy Curtis
Councilwoman Judy Curtis expressed concern about the building inspection process
within Weld County's boundaries. The jurisdiction of the County's inspection services
and those of municipalities within the County was discussed. She mentioned
homeowners' problems in a subdivision in Mead noting that she did not feel that the
problems were the fault of Weld County's inspection department.
UNFINISHED BUSINESS:
After-Election County Officials Reception
The Council secretary was asked to research costs and plans for an after-election
reception for current and future County officials. This will be discussed at the October
Council meeting. The Council decided to plan the reception for 5:30 p.m. December 4,
1996 in the Centennial Center Solarium.

Restaurant invitations to Visit with Council
President Stephanie Hayward tabled the discussion of restaurant invitations.
NEW BUSINESS:
Perceived Conflict-of-Interest Letters
Councilman Jim Gardner, whose coordinator assignment includes Centennial
Development Services, Inc., explained the research he had done regarding the letters.
He pointed out that Commissioner Harbert had one vote in five when the
Commissioners decided whether to fund CDSI. On the CDSI Board of Directors
Commissioner Harbert had one vote in at least twelve. He emphasized that Ms. Griego
and Commissioner Harbert were both on the CDSI Board because of their positions in
County government. It was pointed out that Ms. Griego's letter stated that she would
not participate in a decision before the CDSI Board if it relateed to a specific client
referred to CDSI by WCDSS. Councilman Gardner felt that neither Commissioner
Harbert or Ms. Griego had a conflict of interest in serving on the board of CDSI.
Councilman Ralph Campbell referenced the Colorado State Statues regarding conflicts
of interest that address whether or not someone is receiving personal financial benefit
in a situation that could constitute a conflict of interest. He stated that clearly there was
no financial benefit to Ms. Griego or Commissioner Harbert, and so he felt that neither
of them had a conflict of interest in serving on the board of CDSI.
Councilman Ralph Campbell made a motion that the Council found no conflict of
interest with either Judy Griego or Commissioner Connie Harbert serving on the Board
of Directors for Centennial Development Services, Inc.. Vice President Pam Malcom
seconded the motion. It carried unanimously. President Stephanie Hayward asked the
Council secretary to prepare an appropriate conflict-of-interest findings resolution to be
signed by the Council.
Payment of the Bills
Councilwoman Judy Curtis made a motion that the bills be paid as listed:

Secretarial Research Requests
The Council secretary showed the Council the new County administrative manual.
Weld County Picnic surveys were distributed to Council members.
The Council discussed the Commissioners' policy regarding standardizing all County
stationery. The secretary was advised to price brown printing on the envelopes that
match the Council's existing stationery, and discuss the findings with President
Stephanie Hayward.

In accordance with the Home Rule Charter, section 13-8-(6), attached is
a copy of the Council's Report to the People for the third quarter of 1996.
WELD COUNTY COUNCIL
REPORT TO THE PEOPLE
October 2, 1996
The Weld County Council is mandated by the Home Rule Charter of Weld County, Colorado,
to report to the people the events that have shaped the previous quarter. This report summarizes
the activities of the Weld County Council during the third quarter of the calendar year 1996.
July 3, 1996 - Mead Town Hall
• Former County Commissioner John Martin spoke at the July Council meeting regarding the
patterns of growth in Weld County. Public discussion centered on the challenges of balancing
industry, commerce, better jobs, and a desirable living environment.
• After months of research and public comment, the Weld County Council voted to set the
salaries of Weld County Commissioners at $48,000 for the years 1999 and 2000. President
Stephanie Hayward cast the only dissenting vote.
• The Council President summarized the Council's review of the Weld County Airport
Authority's payment to the former airport Manager. She noted that the source of the payment
to the airport manager would have been airport users' fees. This conclusion was based on
the fact that grants received by the Airport Authority must be used for their designated
purpose. President Stephanie Hayward emphasized that the Council is mandated by Weld
County's Home Rule Charter to review all aspects of County government, and that the review
of the Airport Authority had been conducted at the request of Weld citizens. Councilwoman
Judy Curtis reported that County Commissioners do not receive a stipend for serving on the
Airport Authority Board.
• A motion carried unanimously to submit the Council's proposed 1997 budget totaling $28,054
to the County Commissioners. The significant change from the 1996 budget was a request to
increase the amount for professional services to the 1986 budget level.
July 4, 1996
• The Weld County Council participated in the Greeley Stampede Parade. In commemoration
of its twentieth anniversary, Council members were joined by former County Council members
and members of the Home Rule Charter Commission.
August 7, 1996 - Keenesburg Town Hall
Weld County Health Education Specialist Kelly Hoime was the guest speaker at the August
•
Council meeting. Ms. Hoime spoke about the area's Community Task Force for Health
Education. She also explained other Health Department Community Assessment Projects that
have resulted in grass-root teams of citizens making a difference in health issues in Weld
communities.
• At the request of Mr. Bud Hopper, representing the Citizens Action Committee, the Council
voted unanimously to request that the Board of County Commissioners change the venue for
the August 19 Preparole Ballot Title Hearing. The Council requested that the hearing be at
the Budget Host Motel in Del Camino at 7:00 p.m.; or recess the Greeley hearing for
continuance at the Budget Host Motel at 7:00 p.m., August 19. The request was made to
provide greater opportunity for comment from citizens of the Del Camino area.
• The charge for publishing the Council's second quarter Report to the People in the Weld
County Newspaper of Public Record, The North Weld Herald, was compared to the cost of
publishing it in the more widely-read Greeley Tribune. President Stephanie Hayward
expressed concern about accessibility of Weld County legal notices to County residents and
agreed to research the matter.

• Councilman Ralph Campbell outlined a suggestion that the Council prepare an invitation to be
distributed at the restaurant where the Council eats before its out-of-town meetings. The
printed invitation would be to encourage Weld residents to interact with Council members
while the Council is in Weld's outlying towns.
• Virginia Scheel presented her concerns about the O Street juvenile detention facility under
construction in Greeley, CO. She expressed concern that the facility was placed at this
location without a vote of the people.
September 2, 1996
• Council members participated in the Windsor Harvest Day Parade.
September 4, 1996 - Grover Town Hall
• County Commissioner George Baxter spoke about Weld County's November ballot issues at
the Council's September meeting. He felt it was important that all citizens understand that the
County will potentially have to pay The Villa for its "vested rights" in the project, if the Del
Camino preparole facility is rejected by County voters. In response to citizens' questions
about County roads, he also explained the County's system for setting priorities for road
paving. President Stephanie Hayward expressed concern that the Bankhead Jones money
from the Pawnee Grass Lands was not designated for County roads in the Pawnee Grass
Lands.
• Councilwoman Judy Curtis stated her concern that Mead homeowners were having to pay for
structural repairs to their new homes caused by soil problems. The jurisdiction of the County's
inspection services and those of municipalities within the County were discussed. It was
determined that Weld County was not responsible for the homeowners' problems.
• The Council decided to plan an after-election reception for current and future County officials
for 5:30 p.m. December 4, 1996 in the Centennial Center Solarium in Greeley.
• The Weld County Council voted unanimously that Judy Griego, Director of Weld County
Social Services, and County Commissioner Connie Harbert have no conflict of interest in
serving on the Board of Directors for Centennial Development Services, Inc.
September 9, 1996
• Councilman Jim Gardner represented the Council at the Early Warning County Budget
Hearings. The County Commissioners denied the Council's request to increase the Council's
line item for mandated performance audits to the 1986 funding level.
During the third quarter of 1996, Council members have researched answers to questions and
concerns brought to their attention by citizens of Weld County. In that process Council members
have talked periodically with the Commissioners and various Elected Officials and Department
Heads.
This report is not meant to be an exclusive enumeration of the activities entered into by the Council.
It is, however, an attempt to communicate with the voters regarding its activities. The County
Council believes that the Weld County Home Rule Charter continues to be a viable tool for the
citizens of Weld County.

COUNTY COUNCIL HEARS CITIZEN'S CONCERNS
The Weld County Council met in regular session on October 2, 1996 at 7:30
p.m. in the Centennial Center. The meeting was chaired by Vice President Pam
Malcom. Weld County citizen Virginia Scheel presented her concerns regarding the
juvenile detention center being constructed on "O" Street in Greeley and the proposed
Del Camino pre-parole facility. Ms. Scheel asked for the Council's help to identify the
purchase date of the property where the juvenile detention center is being built. She
also asked for the Council to research the source of the funds used to purchase that
property.
