("U S WEST"), filed Advice Letter No. 2554, dated September 1, 1995 (attached as Exhibit 1). 2. U S WEST stated that the purpose of this filing is to remove a portion of the Brighton exchange and add it to the Denver Metro Exchange Aurora Zone and to extend the Brighton exchange boundary by one quarter mile to the East in Township 1N, Range 65W, Sections 18 and 19. U S WEST requested that the tariffs accompany- ing Advice Letter No. 2554 become effective on 30 days' statutory notice or, in this instance, on October 2, 1995. /ij j • - V./� T CC: aAtnt). ; P-5 S52140 3. Under § 40-6-111(1), C.R.S., the Commission may, in its discretion, set the tariffs for hearing which will suspend their effective date for 120 days. Section 40-6-111(1), C.R.S., also provides that the Commission may, in its discretion, by separate order, suspend the effective date of the tariffs for an additional 90 days. Thus, the Commission has the power and authority to sus- pend the effective date of the tariffs for a maximum of 210 days or, in this docket, until April 29, 1996. In addition, under the provisions of § 40-15-206(2), C.R.S., rearrangements of exchange areas such as those proposed in Advice Letter No. 2554 require that the Commission conduct a public hearing. B. Findings of Fact 1. The Commission finds that it will set the proposed tar- iffs for hearing and will suspend their effective date in order to conduct a public hearing as required by § 40-15-206(2), C.R.S. 2. II. ORDER A. The Commission Orders That: 1. The effective date of the tariffs filed by U S WEST Communications, Inc., on September 1, 1995, pursuant to Advice Letter No. 2554, dated September 1, 1995, is, as of the adopted 2 date of this Decision and Order, suspended for 120 days until January 30, 1996 or until further order of the Commission. 2. The tariffs filed by U S WEST Communications, Inc., under Advice Letter No. 2554, will be set for hearing before the Commission as follows: DATE: September 27, 1995 TIME: 1:30 p.m. PLACE: Commission Hearing Room Office Level 2 (OL2) Logan Tower 1580 Logan Street Denver, Colorado 3. Any person, firm, or corporation, includingany who have previously filed a document protesting the proposed tariffs, who desire to intervene and participate as a party in this proceed- ing shall file a motion to intervene with the Commission within ten days after the mailing date of this Decision, and shall serve a copy of the motion on U S WEST Communications, Inc.'s attorney of record. 4. First, transmitted with this advice letter are maps which remove a portion of the Brighton exchange and add it to the Denver Metro Exchange Aurora Zone. When the Denver International Airport (DIA) boundaries were established by the City and County of Denver and the DIA wire center became operational, a portion of the Brighton exchange became part of the Aurora Zone of the Denver Metro Exchange. Also, in February 1994, the Monaghan wire center began providing telephone service to U S WEST customers in a portion of the Denver Metro Exchange Aurora Zone. Presently, the Denver Metro Exchange Aurora Zone has four wire centers located within its boundaries: Aurora, Montbello, DIA and Monaghan. The attached maps correct the current Denver Metro Exchange Aurora Zone Base Rate Area map, the current Denver Metro Exchange Aurora Zone map and t Brighton Exchange Area Map. THE PUBLIC UTILITIES COMMISSION FILED C95-911 Exhibit 1 Page Two Advice No. 2554 SEP - 1 1995 BY STATE OF COLORADO The DIA wire center and the portion of the Denver Metro Exchange Aurora Zone it serves, is considered to be all Base Rate Area. Although the telephone service for DIA and the businesses located at the airport are served by the DIA wire center, there are several U S WEST customers physically located within the DIA Base Rate Area whose telephone service continues to be served by the Brighton wire center since no DIA facilities have been provided to serve them. At present, there are five residential lines (five residential customers) and nine business lines (two business customers) provided telephone service from the Brighton wire center. These same customers were served by the Brighton wire center prior to the City and County of Denver's purchase of this territory, therefore, there is no change to the local calling area of these seven customers since they will continue to be served by the Brighton wire center. The Monaghan wire center and the part of the Denver Metro Exchange Aurora Zone it serves, has been divided into Base Rate Area, Zone One and Zone Two on the maps accompanying this advice letter. Since this wire center became operational February 18, 1994, U S WEST has applied a credit (including interest) to all customer bills dated June 19, 1995 for any difference in charges between February 18, 1994 and the customer billing date of June 19, 1995. Service orders were issued to begin charging the appropriate base rate area and/or zone rates with the June 19, 1995 bills. These customers retained the same calling area as they had when they were being served by the Aurora wire center. The second purpose of this advice letter is to extend the Brighton exchange boundary by one quarter mile to the East in Township IN, Range 65W, Sections 18 and 19. At present, this quarter -mile portion of territory is shown as part of the Hudson exchange. However, all service to the four residential customers in this quarter mile portion (address range 18500 to 18749 Weld County Rd. 8) is provided from the Brighton exchange. One customer has had Brighton service since 1964, one since 1979, one since 1982 and one since the Spring of 1995. The installation of the latter customer's service resulted in the discovery that a correction in the boundary was necessary. There are »Q customers in this address range with Hudson service and the only street in this territory is Weld County Rd. 8, which forms the section line between Sections 18 and 19. Hudson facilities actually begin at 18750 Weld County 8 and continue East Since all four customers are served by the Brighton wire center and will continue to be served by the Brighton wire center, this correction will cause no change to their local calling area, C95-911 Exhibit 1 Page Three Advice No. 2554 Should you have any questions, please call Jean Hash, 896-7406.
