HomeMy WebLinkAbout951246.tiffRESOLUTION RE: APPROVAL OF RENEWAL REQUEST FOR A TAVERN LIQUOR LICENSE, WITH EXTENDED HOURS, ISSUED TO RICE ENTERPRISES, INC., DBA FORT TWENTY-ONE - EXPIRES APRIL 2, 1996 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rice Enterprises, Inc., dba Fort Twenty -One, presented to the Board of County Commissioners of Weld County, Colorado, an application for the renewal of a Tavern Liquor License, with extended hours, for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, and WHEREAS, pursuant to Weld County Ordinance No. 6, Section II, C., said applicant has paid the sum of $128.75 to the County of Weld for the renewal of the existing license, and WHEREAS, at a hearing on April 17, 1995, Jack Rice, owner and operator of Rice Enterprises, Inc., applicant, was present, and the Board heard all of the testimony and statements of those present, heard the recommendations of the Weld County Attorney's Office and the Sheriffs Office, and studied all of the exhibits and evidence presented in this matter and, having been fully informed, did find that said Tavern Liquor License, with extended hours, shall be approved with the conditions as set forth below, and WHEREAS, said applicant has exhibited a State Liquor License for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 985 East 18th Street, Greeley, Colorado 80631 NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, having examined said application and the other qualifications of the applicant, does hereby grant License Number 95-10 to said applicant to sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, only at retail at said location; and the Board does hereby authorize and direct the issuance of said license by the Chairman of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which license shall be in effect until April 2, 1996, providing that said place where the licensee is authorized to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the license. 951246 LC0034 RENEW LIQUOR LICENSE - FORT TWENTY-ONE PAGE 2 BE IT FURTHER RESOLVED by the Board that said Tavern Liquor License, with extended hours, issued to Rice Enterprises, Inc., dba Fort Twenty -One, be, and hereby is, approved subject to the following conditions: 1. C H •%..-m C C O NON -TRANSFERABLE. 951246 AGREEMENT FOR RENEWAL OF LIOUOR LICENSE THIS Agreement is entered into this / 1 day of April, 1995, by and between the County of Weld, State of Colorado, by and through the Board of County Commissioners of the County of Weld, whose address is 915 Tenth Street, Greeley, Colorado 80631, hereinafter referred to as "the Board," and Jack Rice, President, Rice Enterprises, Inc., d/b/a Fort 21, whose address is 985 E. 18th Street, Greeley, Colorado 80631-6135, hereinafter referred to as "Fort 21." WITNESSETH: WHEREAS, the Board is the liquor licensing authority for Weld County, Colorado, pursuant to Section 12-47-106(1)(b), C.R.S., and Weld County Ordinance No. 102-A, and WHEREAS, at a public hearing on March 13, 1995, the Board considered evidence in the form of testimony and written reports which gave probable cause to believe that the following factor exists with respect to Fort 21, and thereby requires the scheduling of a renewal hearing pursuant to the procedures of Ordinance 102-A: 1. Excessive noise, rowdiness, and/or disturbances on a continual basis, as well as numerous criminal complaints, in the immediate area of the premise; and WHEREAS, by resolution dated March 13, 1995, the Board of County Commissioners set a Show Cause Hearing for April 17, 1995, at 9:00 a.m., at which time the Board is to consider evidence for the determination of whether or not at least one of the four factors listed in Weld County Ordinance 102-A exists, and if so, there is sufficient evidence for the existence of any of the items listed in the "Phase II" portion of said Ordinance 102-A which may exacerbate or ameliorate the situation, and WHEREAS, the Weld County Sheriffs office has contacted Fort 21 regarding measures which the tavern may take to reduce and/or eliminate excessive noise, rowdiness, and/or disturbances on a continual basis, and/or criminal complaints in or outside the tavern by employing security guards during operating hours and providing training to tavern employees regarding the identification of intoxicated persons who may not be served alcohol, pursuant to the provisions of Section 12-47-128, C.R.S., and/or the identification of and ways to deal with persons who are likely to cause such disturbances, and WHEREAS, the parties hereto desire to enter into this Agreement with the understanding that the steps which Fort 21 desires to take as promised to herein are intended to reduce and/or eliminate those problems which were identified in the probable cause hearing on March 13, 1995 from occuring in the future, upon the renewal of the liquor license by the Board.
