RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST DAVID AND RHONDA WRIGHT FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado
statute and the Weld County Home Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, David and Rhonda Wright, VI #2223, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of October, 1995, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, David Wright, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office for legal action until March 1, 1996, to allow adequate
time for the property owners to complete their harvest and bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
by March 1, 1996.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on March 1, 1996, the Weld County Attorney be,
and hereby is, authorized to proceed with legal action against David and Rhonda Wright to remedy
the violation of the Weld County Zoning Ordinance, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties.

DATE OF INSPECTION: October 9, 1995
CASE NUMBER: VI -2223
The property was inspected to determine compliance with section 31.2, 31.2.6, 31.3.9 and
Section 43 of the Weld County Zoning Ordinance. The property is not in compliance at this
time. There are two mobile homes located on the property without the proper zoning permits.
There is also a travel trailer being lived in without the proper permits. There is also a
noncommercial junkyard consisting of used building materials and miscellaneous junk. I did talk
to Mr. Goin (Father-in-law of the property owner) while I was on the property. He did say that
the property owners where still working on getting water to the property so that one of the
mobile homes could be hooked up. To bring the property into compliance the mobile homes need
to be removed or the proper zoning permits obtained. To bring the property into compliance
concerning the travel trailer, the travel trailer has to stop being used for temporary or overnight
housing on the property or the proper zoning permit obtained. The noncommercial junkyard
needs to be removed or screened from the adjacent properties and road rights of way. If screening
is the option of choice then a detailed screening plan needs to be submitted to the Department of
Planning Services of review and approval before installation.

August 11, 1995 Telephone conversation between Julie Chester and David Wright. Julie
Chester explained the options that could be taken.
August 18, 1995 Property inspected with Mr. Goin (Tenant and relative of the property
owner). Property is still in violation
August 24, 1995 Zoning Violation Notice Sent.
September 26, 1995 Property inspected. Property is in violation.
September 27, 1995 Letter sent to property owner indicating that the violation case was
scheduled before the Board of County Commissioners.
The noncommercial junkyard is a violation of Section(s) 31.2 and 31.3.9 of the Weld County
Zoning Ordinance. To correct the violation a screening plan must be submitted and approved
or the noncommercial junkyard must be removed from the property. The mobile home without a
Zoning permit is a violation of Section 31.2.16. and Section 43 of the Weld County Zoning
Ordinance. To correct the violation the mobile home must be removed or the proper zoning
permit applied for.
The Department of Planning also recommends that the County Attorney be authorized to
proceed with legal action against any other persons occupying the properties, any person
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation. The property will be reinspected October 9, 1995.

The property was inspected to determine compliance with section 31.2, 31.2.16, 31.3.9 and
Section 43 of the Weld County Zoning Ordinance. The property is not in compliance at this
time. There is still a noncommercial junkyard on the property. The junkyard does appear to have
gotten larger. There are several flatbed trailers full of miscellaneous junk materials. There is still
mobile homes located on the property. One consists of a recreational camper that has been
hooked up to a generator and has a line leading to a large water bag. I did attempt to contact the
resident of the property but I found no one home.

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.2.16, 31.3.9 and Section 43 of the Weld County Zoning Ordinance. A non-commercial junkyard and
two mobile homes without permits. This is not a use allowed by right in the Agricultural zone district.
The violation can be corrected by removing the non-commercial junkyard and the mobile homes. The
mobile home violation can also be corrected by getting the proper zoning and building permits for the
mobile homes. The non-commercial junkyard violation can be corrected by screening it from adjacent
properties and public rights -of- way. If screening is the option of choice, then a detailed screening plan
must be submitted to the Department of Planning Services for review and approval.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from August 24, 1995 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
of any assistance in clarifying or answering questions concerning this matter. Please call or write the

The property was inspected to determine compliance with section 31.2, 31.2.16, 31.3.9 and
Section 43 of the Weld County Zoning Ordinance. The property is not in compliance at this
time. There is still an non-commercial junkyard without screening and two mobile homes
without permits located on the property. There is a large amount of clean up needed.
I did contact Mr. Don Goin on the property. He did say that he is the step -father of the owner
David Wright. Mr. Goin did say that he was going to be setting up one of the mobile homes as a
residence. He did say that he was told that it would take about three months or longer to get
sewer and water hooked up. I did recommend that he talk to a building inspector about what he
needs to do. I did explain to Mr. Goin that he would need get zoning and building permits for the
mobile homes. I also showed Mr. Goin the ordinance definition concerning junk material. There
is a large amount of used fencing material on the property. I did explain to Mr. Goin that the junk
material had to be removed or screened, and that if screening is the option of choice a detailed
screening plan would have to be submitted to the Department of Planning Services for review
and approval. A large amount of the material on the property is farm equipment. There are also
two tractor trailers that are being used as storage on the property. I did tell him to call me if he
had any questions.

The property was inspected to determine compliance with section 31.2, 31.2.16, 31.3.9 and
section 43 of the Weld County Zoning Ordinance. The property is not in compliance at this time.
There has been an enormous amount of stuff moved onto this property in a very short period of
time. There is a yellow and white mobile home without the appropriate permits, several
buildings, building materials and tons of miscellaneous junk, all of which arc just -sitting in the
middle of the property. At this time no one is living on the property. There is a lot to do to bring
the property into compliance. The appropriate permits must be applied for and approved by the
Department of Planning Staff for the mobile home and any building that would require a permit.
The junk and building materials must be removed or stored within a building or behind screening
until used. If screening is to be used a detailed screening plan must be submitted and approved
by the Department of Planning Staff before installation.
