O. Box 467, Golden, Colorado 80402, for an Amended Certificate of Designation to allow the disposal of mine waste rock in an existing solid waste (ash) disposal facility and surface coal mining operation, on the following described real estate, to-wit: Part of Sections 25 and 36, Township 3 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was represented by Ben Doty, Consultant, at said hearing, and WHEREAS, said request for an Amended Certificate of Designation was submitted in conjunction with an application for a Site Specific Development Plan and Special Review Permit #1160 (Second Amended Special Review Permit#386) to allow the disposal of mine waste rock in an existing solid waste (ash) disposal facility and surface coal mining operation, which was approved by the Board, and WHEREAS, Section 30-20-100.5, et seq., CRS, and regulations promulgated thereunder, provide standards for review of said Amended Certificate of Designation, for which the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and WHEREAS, Section 30-20-104, CRS, as amended, requires the Board to take into account certain factors to approve an amended Certificate of Designation and, having taken into account said factors and having been fully informed, the Board finds that this request shall be approved for the following reasons: 1. The Conditions of Approval and Development Standards in Use by Special Review Permit#1160 (Second Amended Special Review Permit#386) will minimize the impacts on the surrounding property and the area to the greatest extent possible. The Conditions of Approval and Development Standards will also provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the county. The Colorado Department of Health and the Weld County Health Department have reviewed this request and find, subject to conditions, the use will comply with the Regulation Pertaining to Solid Waste Disposal Sites and Facilities Act, Section 30-20, Part 1, CRS, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that an Amended Certificate of Designation for Coors Energy Company, to allow the disposal of mine waste rock in an existing solid waste (ash) disposal facility and surface coal mining operation, on the hereinabove described real property be, and hereby is, granted subject to the following condition(s): 1.
