WHEREAS, That part of State Highway No. 3 from the Base Line Road at
the Adams-Weld County line North to its junction with State Highway No. 52 at
the intersection of Denver Street and First Street in the Town of Fort Lupton is
a part of the main highway system between Greeley and Denver and is a direct
connecting link between the City of Brighton and the Town of Fort Lupton and is
necessary for use as a public highway, and
WHEREAS, the abandonment of said section of highway would be of great
damage to the public generally and particularly to the people of Adams and Weld
Counties and would add greatly to the traffic burdens and hazards on the newly
constructed Federal Aid Highway to the West thereof, and
WHEREAS, said new constructed highway does not enter nor directly
serve said City and Town, and said above mentioned "old portion" is absolutely
essential to proper service of the public, and
WHEREAS, under and by Session Laws of Colorado 1955, Chapter 248,
page 752, it is the declared public policy of the State of Colorado that said
original portion of said highway with the proper markings thereon shall be
maintained by the State of Colorado, and
WHEREAS, said County and said Town and the communities between Brighton
and Fort Lupton do not have facilities available for the maintenance of said
highway; NOW, THEREFORE,
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that the Highway Commission of the State of Colorado, be and it is
hereby requested and urged to rescind forthwith its certain Resolution No. 356-C
dated January 10, 1956, wherein it is recited that said portion of said "old
highway" be abandoned as a part of the state highway system.
BE IT FURTHER RESOLVED that Weld County, Colorado, declines and it does
hereby decline to accept said portion of said "old highway" as a county highway,
and that said County, in the event said Commissioner persists in abandoning said
portion of said road contrary to the public policy of this state declared as afore-
said, shall and it does hereby decline to assume responsibility for the maintenance
thereof.

Dear Mark,
we hays had our attorney drew up a legal resolution in regard to
our resisting taking over maintenance of the old "BY between Fort Lupton
and Brighton.
His resolution, naturally from a legal mind, sounds rather cold.
We, as Commissioners of Weld County, do not intend it that way. "
The Legislature passed a By-Pass Law which in our opinion is not
too clear. Our whole object in our resolution is to clarify the law. It
is our hope that through this gppeal you can get an answer from the Attorney
General to clear up the Legislative Act of 1955. If the Attorney General
says it is our road, we will certainly take over the maintenance.
It is the hope of our board that this letter or resolution not be
antagonistic. We have had very congenial working relations with your deport-
ant and we do not want to jeopardize a good working relationship between
the two departments.

Gentlemen:
In connection with the State Highway routings in Weld and Adams
Counties we are enclosing, herewith, one (1) copy of Resolution No. 356-C
approved January 10, 1956, effective February 1, 1956, together with
copies of the Weld and Adams County Maps, and the Fort Lupton and Brighton
City Plats, upon which have been indicated in color the additions and
deletions to the State Highway System resulting therefrom.
This Resolution is forwarded for your information and file. If it
is the desire of your board that the abandoned portion should remain
public highway, your board should adopt the necessary resolution to add
it to your county system as the 1953 Colorado Statutes Annotated,
Chapter 202, Section 6 states that the right-of way of all abandoned
portions of a state highway shall ievert to the adjacent property owners,
unless the abandoned portions are 'necessary for use as a public highway
and a resolution so stating is adopted by the County Board of Commissioners
within ninety days of the abandonment as part of the State Highway System.

RESOLUTION
BE IT RESOLVED, that State Highway No. 3 in Adams
sad Welds-Counties be seloaated to follow the alignment
of Federal Aid Primary Projects No. F 0061 (11) Unit 2
and F 006-1 (12), effective February 1, 1956, and
BE 1T FURTHER RESOLVED, that the portion of the old
highway fran the Base Line Road at the Adams-Weld County
Line, north to the junction with State Highway Noe 52 at
the intersection of Denver and First Streets in Fort Lupton
is hereby abandoned as a part of the State Highway System►.
