RE: APPROVE RESUBDIVISION OF A MINOR SUBDIVISION S #426 - ARC
DEVELOPMENT, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 2nd day
of July, 1997, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of ARC Development, LLC, 5448 West 7th Street, Greeley, Colorado 80634, for
Resubdivision of a Minor Subdivision, S #426, on the following described real estate, to -wit:
Lots 1 and 2 of the ARC Minor Subdivision, located
in the SE''A of Section 4, Township 5 North, Range
65 West of the 6th P.M., Weld County, Colorado
WHEREAS, Doug Coleman, applicant, was present, and
WHEREAS, Section 8.3 of the Weld County Subdivision Ordinance provides standards
for review of said Resubdivision of a Minor Subdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Sections 8.3.1 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Sections 8.3.2 and 7.3.8 of the Weld County Subdivision
Ordinance including specifically:
a. Section 8.3.2.3.1 -- The proposed lot line revision is consistent with the
previously approved Minor Subdivision. The proposed new lot line
between Lots 1 and 2 will result in an acreage transfer of approximately
1/3 acre from Lot 2 to Lot 1 and will allow for better use of the property as
it exists on -site.

b. Section 8.3.2.3.2 -- The Conditions of Approval address the issues
concerning the regulations and ordinances that affect this proposal. The
proposed lot line adjustment will not create any problems with the existing
circulation on the site and the existing structures will comply with all
setback and offset requirements of the Weld County Zoning Ordinance.
The Weld County Public Works Department and Health Department
reviewed this request and find no conflicts.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of ARC Development, LLC for Resubdivision of a
Minor Subdivision, S #426, on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1. The Resubdivision plat shall be submitted to the Weld County Department of
Planning Services for recording within 30 days of approval by the Weld County
Board of County Commissioners.
2. Prior to recording the plat:
a. The Resubdivision plat shall meet all requirements of Section 4.5.21 of
the Weld County Subdivision Ordinance, as amended.
b. The Resubdivision is conditional upon the following and each shall be
placed on the plat, as follows:
(1) Foundations within the ARC Minor Subdivision Resubdivision shall
be engineered as per the 1994 Building Code Requirements.
(2) Lots 1 and 2 shall maintain compliance, at all times, with the Flood
Hazard Overlay District.
(3)
The site shall maintain compliance, at all times, with the
requirements of the Weld County Public Works and Health
Departments, Colorado Department of Transportation, and
Department of the Army Corps of Engineers.
(4) Lots 1 and 2 shall maintain compliance, at all times, with the
Airport Overlay District.
(5)
Installation of utilities shall comply with Section 12 of the Weld
County Subdivision Ordinance, as amended.

(6) Lots 1 and 2 shall maintain compliance, at all times, with the
approved Site Plan Review and with Sections 23 and 40 of the
Weld County Zoning Ordinance. Any proposed substantial
change, as determined by the Weld County Department of
Planning Services, requires the submittal, review, approval, and
all conditions of a Site Plan Review being met.
c. A 75 -foot right-of-way reservation from the centerline of State Highway
263 shall be delineated on the plat.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 2nd day of July, A.D., 1997.

BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 8.3.1 of the
Weld County Subdivision Ordinance, as amended.
2. The request is in conformance with Section 8.3.2 & 7.3.8 of the Weld County Subdivision Ordinance,
as amended as follows:
a. Section 8.3.2.3.1 -- How the lot line revision complies with the approved recorded final plat.

affect this proposal. The proposed lot line adjustment will not create any problems with the

Department and Health Department reviewed this request and finds no conflicts.
Staffs recommendation is conditional upon the following:

RE: FIRST REPLAT - ARC SUBDIVISION IN THE NORTHEAST
QUARTER, SOUTHEAST QUARTER, SECTION 4, TOWNSHIP
5 NORTH, RANGE 65 WEST, 6th P.M., WELD COUNTY,
Gentlemen,
The ARC Subdivision was approved by Weld County and filed March 19, 1997.
This subdivision is zoned 1-3 Industrial and consists of two large lots,
average size 8.6 Acres. At the time of the subdivision, Lot 2 was under
agreement to be purchased. Since the time of the filing, the initial
purchase failed to consumate.
Now, there are new prospects for the purchase of each lot. At their re-
quest and agreement, ARC Development is making this application to satisfy
the new buyers desires.
The lot line change consists of only one common line and amounts to less
than 1/3 of an acre. The lot line adjustment will allow for better use of
the fenced areas. The change is internal of the subdivision and will not
affect any access, parking areas, drainage, types of use and will not create
any non -conforming set -back distances.

I have visited the site and have the following comments:.
I am familiar with this site through the previous case in splitting Lots 1 and 2. The applicant has
dedicated an additional 10 feet from Cherry Avenue for future expansion. Both lots have existing
accesses. I previously worked with the applicant on the access point to Lot 2 where the access
road came in at a 90° angle to provide an adequate sight distance in both directions.
I have reviewed the application and find no conflict with it.

Subject: S-426 ARC Minor Subdivision for a Lot Line Adjustment

The City of Greeley has reviewed the request for a minor subdivision to accomplish a lot line
adjustment, and noted that generally speaking, the same items of concern which were raised in my
November 27, 1996 letter to you concerning the original subdivision were still applicable. Those
issues include:
1. A paved (either asphalt or concrete surface) 20 -foot -wide access to the structure on
Lot 2 shall be provided, so minimal fire protection requirements can begin to be
addressed. To adequately fight fires, the Union Colony Fire Authority requires a
20 -foot -wide asphalt or concrete surface to the structure. Additionally, there is
currently insufficient water flow for fire fighting purposes, which makes access all
the more critical.
2. After the subdivision submittal, the property owners met the Water and Sewer
requirements. However, if a water line is desired to provide adequate water for
fire flows, the site should be annexed.
3. It appears the required right-of-way was not provided with the original subdivision.
At that time, 60 feet of right-of-way on the west side of the centerline of Cherry
Avenue and 300 feet north of the intersection with 8th Street shall be dedicated.
Additionally, 15 feet of right-of-way shall be dedicated along the balance of the
property adjacent to Cherry Avenue.

Cherry Avenue is identified as a minor arterial on our recently adopted
Transportation Master Plan. The requested right-of-way is the minimum required
to ensure adequate access to this site and future development in this area.
Additional right-of-way was also requested at the Sketch Plan and original
subdivision phase, and the applicant verbally indicated a willingness to provide the
necessary right-of-way. The required right-of-way should be dedicated, or at the
very least, reserved with this application.
4. The site shall comply with the Entryway Master Plan guidelines, which entails
installing landscaping according to a landscape plan that has quads of trees every
50 fleet, and if the site is to be fenced, a split -rail fence or its equivalent shall be
provided along 8th Street. Additionally, a perimeter treatment plan shall be put in
place for property adjacent to Cherry Avenue. Planning staff appreciates the effort
made in the installation of landscaping along 8th Street, but notes the typical
minimum requirements for size include 2 caliper deciduous shade trees, 1 1/2"
caliper ornamental trees, and 6 foot tall evergreen trees. These size trees should
be put in place to augment the existing landscaping.
The Entryway Master Plan is designed to provide a unified development theme and
attractive entryways into the City. Admittedly, most of this corridor does not
currently provide the minimum amount of landscaping necessary, but new
development, such as this proposal, should meet the minimum standards. An
example of good landscaping is seen at Cox Oil. As this area develops, these
requirements will be requested on each parcel. Additionally, this has been
mentioned to the County on this property on three previous occasions - sketch plan,
subdivision, and the site plan review. A perimeter treatment plan is required for
any subdivision which is adjacent to an arterial or collector street and, as noted
earlier, Cherry Avenue is designated as a minor arterial.
