HomeMy WebLinkAbout972637.tiffHEARING CERTIFICATION DOCKET NO. 97- 67 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1172 FOR A DRY SAND AND GRAVEL MINING OPERATION IN THE A (AGRICULTURAL) ZONE DISTRICT- HALL-IRWIN CONSTRUCTION COMPANY A public hearing was conducted on December 17, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Commissioner W. H. Webster Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin Health Department representative, Sheble McConnellough Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated November 20, 1997, and duly published December 3, 1997, in the Platteville Herald, a public hearing was conducted to consider the request of Hall -Irwin Construction Company for a dry sand and gravel mining operation in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She explained Adams County is responsible for maintenance of Weld County Road 2, and Condition of Approval 5a requires the applicant to submit a copy of a Road Maintenance and Improvements Agreement with Adams County for haul routes east from the entrance on Weld County Road 2 (168th Avenue) to State Highway 85. Responding to Commissioner Kirkmeyer, Don Carroll, Public Works representative, stated Adams County has been maintaining this portion of road as long as he can remember. He explained that Weld County participates with adjacent counties or municipalities in sharing maintenance for roads with shared boundaries in a manner of each being responsible for a certain number of miles at specific points along the road. Commissioner Hall stated his concern is that the maintenance might change in the future from Adams County to Weld County and, if it does, Weld County needs an approved Road Maintenance Agreement with the applicant. After discussion, Mr. Morrison stated the Conditions of Approval could be revised to require the applicant to enter into an agreement with Weld County if maintenance passed from Adam County's responsibility to Weld County. Gary Tuttle represented the applicant and stated this is a unique application because of the way the applicant seals off the main portion of the mining operation by the installation of a slurry wall, thereby keeping groundwater from entering into the operation. He stated the reclamation plan includes two reservoirs and one private lake and indicated Central Colorado Water Conservancy District (CCWCD) will operate the two reservoirs after mining is completed. He indicated CCWCD 972637 PL1234 HEARING CERTIFICATION - HALL-IRWIN CONSTRUCTION COMPANY (USR #1172) PAGE 2 will, therefore, monitor construction of the reservoirs to satisfy its requirements. Mr. Tuttle also indicated the applicant will monitor any neighboring wells and stated he is currently monitoring six wells in the area. Responding to Commissioner Kirkmeyer, Mr. Tuttle stated the applicant is finalizing an agreement regarding access to the two oil and gas wells on the property, and he indicated he agrees to enter into a Road Maintenance and Improvements Agreement if maintenance for Weld County Road 2 comes under Weld County's responsibility in the future. Carl Eiberger, who owns the property where the lake will be placed spoke in support of the proposal. He stated he has checked out the reclamations the applicant has done on various projects and is satisfied with the quality of Hall-Irwin's reclamation work. After discussion, Commissioner Kirkmeyer moved to approve the request of Hall -Irwin Construction Company for a Site Specific Development Plan and Special Review Permit 31172 for a Dry Sand and Gravel Mining Operation in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Development Standards as entered into the record and the Conditions of Approval with the addition of #6 to reflect a note on the plat stating the applicant shall enter into a Road Maintenance and Improvements Agreement with the Board of County Commissioners if, at any time in the future, maintenance of Weld County Road 2 becomes the responsibility of Weld County. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 22nd day of December, 1997.
