The application has satisfied PUD Ordinance No. 197 in regard to wat4E €(
Water will be provided by the Left Hand Water District and sewer will be provide by in ivi ua
sewage disposal systems. The minimum lot size of 4.8 acres and the overall density of one
septic system per 8 acres meets current Department policy.
The application materials also adequately address the potential environmental impacts as
described in Section 6.3.1.2.1 of the PUD Ordinance. In addition, our staff is not aware of any
potential environmental impacts or risks that this proposed development may pose that may
represent an increased environmental impact or risk in excess of other similar developments.
Our staff observed that there are other similar types of developments in the vicinity of this
proposed development. Many of these homes have livestock that include but may not be
limited to cows and horses. We also observed open agricultural fields in the vicinity of the
site, some of which may be used as biosolids application sites. It is our opinion that any
future property owner should be made aware that these agricultural uses exist and that they
may be exposed to noise, dust, flies, odors, etc. in excess of the common urban experience.
As a result, we recommend that the "Right to Farm" covenant be required to be placed on any
recorded plat.
Additionally, we recommend the following conditions be part of any approval:
1) Water service shall be obtained from the Left Hand Water District for each lot.
2) A Weld County Septic Permit is required for each proposed home septic system and shall
be installed according to the Weld County Individual Sewage Disposal Regulations.
Please note: The Weld County Health Department, Environmental Protection Services
recommends alternative strategies regarding water conservation and waste minimization.
Considerations such as xeriscaping, low flow water fixtures, backyard composting and
recycling are a few options available to home owners. We also recommend that preliminary
radon mitigation measures be incorporated in the construction of new homes. Radon kits are
available in our office. Please contact our Department for further information.

Dear Ben:
Thank you for referring the Peaks at Mountain View, Tom Russell, Change of Zone from Agricultural to PUD to
the School District. The projected student impact upon the St. Vrain Valley School District of 5 new single-
family lots on 40.6 acres is 3 students. Any students living in this subdivision would attend Erie Elementary
School and Erie Middle/Senior High School under the present school boundaries. However, due to potential
growth in these schools this development and other existing developments in this feeder could be placed in
another attendance area in the future.

The District is on record as not opposing growth so long as the growth is planned and is manageable from a
student enrollment stand point. While this development does not impact the middle/senior school capa( ity, the
elementary is already over capacity. In addition, there are other approved developments in these attendance
areas which will, together with this proposal, have a significant cumulative impact on these schools.
As the volume of developments increases in the Erie Elementary area with no alleviation of the existing
overcrowded conditions, the ability to provide the same quality education for these new students that is provided
students in other areas becomes increasingly difficult. Typically the District would oppose this development
because it adds to the enrollment of an already overcrowded school, however, the developer has indicated a
willingness to participate in the payment of a cash-in-lieu fee in their documentation. Should this agreement
and payment be accomplished the District would not oppose this development. Please let me know if ycu have

I have reviewed the submitted material pertaining to the change of zone for the Peaks at
Mountain View P.U.D. (Case Number: Z-527). The Fire District does not object to the
proposed zone change.
Final utility plans showing the location of fire hydrants and water main sizes will need to be
submitted to the Fire District for review and approval. After installation is complete a flow test
will be required to determine the available water supply for fire protection.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Change of Zone from agricultural to PUD (residential). Our requirements are as
follows:
COMMENTS:
Access to the proposed PUD shall be from Fir Avenue adjacent to WCR 5 and WCR 12 within the Carmacar
Ranchette Subdivision which is maintained by Weld County.
WCR 12 is designated on the Transportation Plan Map as a local gravel road and WCR 5 is designated as a
collector status road. Both of these roads are maintained by Weld County.
The applicant is indicating that the storm water runoff will be routed via an earthen ditch to the existing ditch running
along the west side of Fir Avenue. Storm water running onto the property will be absorbed by lawns and open
spaces.
Given the low density of adjacent Carmacar Ranchettes, the low additional traffic impact of these proposed five-lot
residential PUD, and the fact that Fir Avenue and this PUD are essentially at a "dead end" from a vehicular flow
perspective, waiver of the Traffic Impact Analysis by the Weld County Public Works Department was granted.
REQUIREMENTS:
The applicant shall indicate, on the plat, 12-foot driving lanes with four-foot shoulders and the typical cross section
shall be changed to reflect this requirement.
Carmacar Ranchettes Subdivision is an unpaved rural subdivision. The additional PUD shall be considered a non-
urban addition not requiring paving.

The storm water drainage study shall be submitted with the Detailed Development Guide and required submittals
for the Planned Unit Development Final Plan and Plat.
