The Department of Planning.Services has reviewed your request to transfer USR-835, permitted for a satellite and leather goods store, to a gift shop selling herbal/organic teas and handcrafted items. Staff has determined that the proposed use of the property would still be considered a home business, which requires a Special Use Permit under the Weld County Zoning Ordinance. If the proposed change in the use, however, has similar intensities and externalities as the use permitted in USR 835, the Department of Planning Services will waive the Special Use Permit requirement and document the change in use in the USR-835 file. In order for the Department to determine the intensity of the use, please have your client submit information on the following items: (1) number of employees on the site; (2) hours of operation (3) items sold or stored at the store; (4) any type of outside storage; (5) any signage of the use and (6) frequency and type ofvehicles coming onto the site to deliver goods. Please note that if the intensity and/or externalities of the new use changes in the future, the Department of Planning Services may re-evaluate the use to determine if a new Special Use Permit is warranted on the site. As the site also accesses directly onto State Highway 14, you may want to contact the Colorado Department of Transportation, as they control the access point and have access requirements based upon the traffic to and from the site.
