Please review and comment on the above mentioned information and
return to the Town of Windsor Planning Department within thirty
(30) days. If comments from your office are not received within
thirty (30) , we will assume that you approve the proposal in its
current form. We do, however, appreciate a response even if you
only mark the form "no comment".
DESCRIPTION OR OTHER DETAILS: The Planning Commission will hold a
public hearing on October 16th and the Town Board on October 28th,
1996. Please feel free to request additional information from
either the Town or the developer in your response. If you do not
feel you can respond within the allotted time or can only respond
upon receipt of additional information, please let us know.

TOWN OF WINDSOR
RESOLUTION NO. 1996 - 60
BEING A RESOLUTION MAKING CERTAIN FINDINGS OF FACT AND
ESTABLISHING THE TOWN OF WINDSOR'S INTENT TO ANNEX CERTAIN REAL
PROPERTY KNOWN AS THE POUDRE TECH CENTER THIRD ANNEXATION AND
A DETERMINATION OF SUBSTANTIAL COMPLIANCE WITH THE MUNICIPAL
ANNEXATION ACT OF 1965.
WHEREAS, a petition has been filed by George A. Frye to annex to the Town certain
real property known as the Poudre Tech Center Third Annexation, more particularly described
within the petition which is attached hereto and incorporated herein by this reference; and
WHEREAS, pursuant to the Municipal Annexation Act of 1965, the Town is required
to establish a date, time, and place for a public hearing on said annexation; and
WHEREAS, the Town is further required to determine that the petition for annexation
is in substantial compliance with the Municipal Annexation Act of 1965.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED BY THE BOARD
OF TRUSTEES OF THE TOWN OF WINDSOR, COLORADO, AS FOLLOWS:
1. The petition for annexation has been signed by more than 50 percent of the land
owners in the proposed annexation, said land owners owning more than 50
percent of the land in the area to be annexed.
2. At least 1/6 of the boundaries of the proposed annexation are contiguous to the
boundaries of the Town of Windsor, pursuant to Section 31-12-104(1)(a),
Colorado Revised Statutes, as amended.
3. A community of interest exists between the area proposed to be annexed and the
Town of Windsor.
4. A public hearing shall be held at 7:00 P.M. on October 28, 1996, at the Town
Hall, 301 Walnut Street, Windsor, Colorado.
Upon motion duly made, seconded and carried, the foregoing Resolution was adopted this
9th day of September, 1996.

Annexation Petition - Poudre Tech Center 3rd Annexation
(I, We) the landowner(s) of more than 50% of the territory, excluding public streets and
alleys, described as the following:
A tract of land situate in the Southwest Quarter of Section 33 T6N, R67W of the 6th
P.M., Weld County, Colorado. More particularly described as follows: Considering the
South line of the Southwest Quarter of said Section 33 as bearing S 89°03'26" W as
determined by monuments at the Center Corner and at the CenterWest Sixteenth Corner
of said Section 33, and with all bearings herein relative thereto. Commencing at the Center
Corner of said Section 33; thence along the East-West Centerline of said Section 33 S
89°03'26" W 321.41 feet to the TRUE POINT OF BEGINNING; thence departing from
said line S 14°31'51" E 1312.94 feet; thence N 62°21'I8" W 577.30 feet; thence N
48°52'50" W 568.88 feet; thence N 64°08'18" W 503.86 feet; thence N 37°49'31" W
489.59 feet to a point on the East-West Centerline of said Section 33; thence along said
line N 89°03'14" E 243.81 feet to the CenterWest Sixteenth Corner of said Section 33;
thence continuing along said line N 89°03'26" E 1120.56 feet to the TRUE POINT OF
BEGINNING.
The above described parcel contains 23.11 acres more or less, allege the following to be
true and correct:
The perimeter of the proposed annexation has a distance of 4816.94 feet, of which
2677.31 feet are contiguous to the existing TOWN limits of the TOWN OF WINDSOR.
A minimum of 1/6 of the perimeter of the proposed annexation is contiguous to the
TOWN OF WINDSOR.
We further allege:
1. It is desirable and necessary that the said territory be annexed to the TOWN OF
WINDSOR.
2. A community of interest exists between the said territory and the TOWN OF
WINDSOR.
3. Said territory is urban or will be urbanized in the near future.
4. Said territory is integrated or capable of being integrated with the TOWN OF
WINDSOR.
5. No land held in identical ownership is divided into separate parcels unless the owner of
said tract has consented in writing or joins in this Petition.

6. No land held in identical ownership comprised 20 acres and together with
intprovanenis had an assessed valuation in excess of $200,000.00 in the year
preceding the filing of this Petition.
7. No proceeding for annexation of the territory have been coaame►ced for annexation to
• another municipality.
8. The signers hereof comprise the landowners of mots than 50% of the territory
proposed to be annexed exclusive of streets and alkyl,and are in fact owners of 100%
of the haeieaher daat'bed property.
Therefore, the undersigned hereby request that the TOWN OF WINDSOR approve the
annexation of the area desaibed above and do herewith pay the requited fees.

Poudre Tech Center 3rd Annexation - Supportive Information
1. Soils Description and limitation.
The subsurface soils generally consist of topsoil, overlying natural layers of clay, sand, and
silt/sandstone. Based on the soils and topography of the property we do not foresee any
limitations associated with the annex and future development.
2. Preliminary utility plan.
Not applicable
3. Mailing addresses of all property owners within three (300) feet of the annexation.
See attached information
4. Affidavit concerning the amount and historical use of all water rights owned.
Not applicable
5. Statement on community need for proposed annexation and zoning.
This property was recently purchased by the Owner of the Poudre Tech Center 1st
Annexation and is considered a house cleaning issue prior to assessing full development
potential. We are requesting single family - 1 zoning commensurate with the Poudre Tech
Center 1st Annexation.
6. For all annexations in excess of ten (10) acres, the applicant shall obtain from the
school district governing the area to be annexed a statement of the effect of the annexation
upon the school district, including an estimate of the number of students generated by the
proposed annexation and the capital construction required to educate such students.
The client and the School District are currently reviewing the potential effects of the
annexations upon the school district and will receive a statement estimating the number of
students and the capital construction required to educate such students.

- IMPACT STATEMENT -
POUDRE TECH CENTER 3rd ANNEXATION
A master plan of this parcel has not been submitted to the Town for review at
this time. A master plan and subdivision plat will be required prior to
development of the property.
The 23.11 acre parcel involved in this annexation is located south of Weld
County Road 64 in the South West Quarter of of Section 33, T6N, R67W of the
6th P.M., Weld County, Colorado. The annexation petition has been signed by
one-hundred percent (100%) of the property owners.
• Water Service - Town of Windsor - Infrastructure to be constructed by
developer at the developer's expense.
• Sanitary Sewer Service - Town of Windsor - Infrastructure to be constructed
by developer at the developer's expense. Any septic systems requested and
approved by the town will be constructed at the sole expense of the property
owner(s) and reviewed, approved and inspected by the Weld County Health
Department.
• Drainage Facilities -Town of Windsor - Infrastructure to be constructed by
developer at the developer's expense.
• School District - Weld County School District RE-4 (See attached Impact
Statement from Brian Lessman).
• Fire Protection - Windsor-Severance Fire Protection District.
• Police Protection - Town of Windsor Police Department.
• A copy of the affected districts is attached.

Dear Keith:
With respect to Poudre Tech 3rd Annexation, impact to the Windsor
School District should be minimal given the small number of acres
under consideration and zoning as proposed. Should zoning
change and this area be deemed primarily residential, the
district reserves the right to revise this statement and declare
additional impact. As proposed, we deem this annexation minimal
impact.
